Although these comments were not received during the public review period, these letters have been reviewed and it was determined that no new California Environmental Quality Act (CEQA) topics or issues have been presented that were not adequately addressed in the Final EIR. The Final EIR remains legally adequate under CEQA and does not require modification or recirculation per the CEQA Guidelines 15088.5. To provide some further clarification and information for the administrative record, the following general responses are provided: 1.One comment indicates that the EIR does not address the Covid-19 or other pandemic public health risks. CEQA requires the analysis and focus of a project's significant effects on the physical environment. The topic of Covid-19 is speculative at this time and is not a CEQA issue. The City acknowledges the commenter's general concern about public health and the well-being of the residents of Poway. Based on current legal guidance and the State Public Health Officer's list of essential workers, construction workers who support construction projects, such as but not limited to housing, are allowed to work. It should be noted that any construction workers at the site would be required to follow all executive orders, public health directives and applicable laws at the time of construction to ensure public safety. Similarly, any uses allowed during operation of the project would be required to follow all executive orders, public health directive and applicable laws. Further, CEQA does not require analysis of the impacts of the existing environment on a proposed project (California Bldg. Indus. Assn. v. Bay Area Air Quality 1 of 2 June 16, 2020, Item #19 Mgmt. Dist. (2015) 62 Cal. 4th 369.). 2.One comment indicates that the EIR project description is contradictory regarding public accessibility. The City does not agree because the EIR project description does not say, or imply, that the project will be "fully open to the public" as the commenter suggests. For clarification purposes, it is correct that there would be membership based recreational facilities, such as The Club, but it is also correct that there would be publicly accessible trails and parks. Additionally, in the Traffic and Transportation Improvements section of the Agenda Report for this item, it is incorrectly stated that "a curb-separated left turn lane into the project will be added and the existing left turn lane onto Martincoit Road will also become curb-separated." These left turn lanes will not be curb separated and will continue to be striped.
