CONSENT CALENDAR Motion by Councilmember Emery, seconded by Councilmember Higginson, to adopt the Consent Calendar as follows: 11. Approval of Minutes - City Council: May 7, 1991, Regular Meeting 13. Ratification of Warrant Register for May 9, 1991. 4189 Page 2 - CITY OF POWAY - May 28, 1991 14. Denial of claim for damages from Joseph Rodriquez. 15. Approval of City's Investment Report for April 30, 1991. 16. Receive and file transportation improvement projects quarterly status report. 17. Adoption of Resolution No. 91-046, entitled, "A Resolution of Intent of the City Council of the City of Poway, California, Regarding the Initiation of the Preparation of Amendments to the South Poway Specific Plan {SPA 84-01M and SPA 84-01N)," to reduce the required parking ratio to one space per 1,000 square feet for accessory storage areas, and to require a conditional use permit for multi-tenant commercial office use in the IP designation. 18. Adoption of Resolution No. 91-047, entitled, "A Resolution of the City Council of the City of Poway, California, Detaching Carriage Road Townhomes (TTM 89-06) from Poway Landscape Maintenance District 83-01, and Ordering the Expansion of Poway Landscape Maintenance District 86-03 with the Annexation of the Same into Landscape Maintenance District 86-03, with Written Consent of all Property Owners and Rescinding Resolution No. 90-180." 19. Acceptance of the replacement Floating Log Boom on Lake Poway from Randazzo Construction Company and authorization for the City Clerk to file a Notice of Completion. 20. Acceptance of the Modular Office Unit at Lake Poway Recreation Area from Gelco Space, Inc. and authorization for the City Clerk to file a Notice of Completion. 21. Award of bid for landscape maintenance services for Landscape Maintenance Districts 83-01 and 86-01 {Twin Peaks Plaza, Poway 16, Stone Canyon Ranch, and Piedmont Park) to Heaviland Enterprises, Inc. 22. Approval of the following positions on pending legislation: oppose SB 208 which would prohibit exemption from disclosure of public attorney records in several areas; continue to oppose AB 315 which would increase the amount of tax increment revenues allocated for the use of low and moderate income housing; oppose AB 652 which places new requirements on fees for new deve- lopment; support AB 350 which would create the California Rivers Riparian Parkway Act. 22.1 Authorization to expend $350,000 to acquire .9 acres from Edward and Juanita Harmon at 11907 Old Pomerado Road for the construction of the South Poway Expressway and for staff to execute a contract with a relocation consultant. Motion carried unanimously. 4190 Page 3 - CITY OF POWAY - May 28, 1991 ITEM 4 TENTATIVE TRACT MAP 91-02 APPLICANT: AL YAR OEHGHANI Mayor Goldsmith opened the public hearing. Item introduced by City Manager Bowersox. Staff report by Director of Planning Services Wright-Quastler. This is a request for a subdivision of 10.3 acres into five parcels, located between Camino del Valle and Calle Colina south of Valle Verde Road in Silver Saddle. This property was originally a stable and riding arena area for the Silver Saddle subdivision. The neighbors have raised the issue of providing trails through this project to connect to the extensive network of trails in the area. Staff proposes trails on the western boundary, and one bisecting the subdivision roughly north to south along lot lines. The developer agrees with the western one, but is opposed to the one through the subdivision. Staff recommends appro- val. Speaking in opposition to staff recommendation: Bob Perkin, 13433 Calle Colina Speaking in favor of staff recommendation: Richard Baldwin, 16466 Bronco Lane, President of Silver Saddle Homeowners Association Larry Stine, 13201 Valle Verde Terrace Tom Dobransky, 16657 Valle Verde Road Stephen Riddle, 13080 Camino del Valle Speakers from the neighborhood requested that CC&R's compatible with the Silver Saddle CC&R's be required and that trails be provided. Don Ayles, ERB Engineering, 13260 Poway Road, requested that the requirement to relocate a water line be deleted; stated they will conform to Silver Saddle's CC&R's including allowing horses; and proposed alternate trails including one on the eastern side of the subdivision. Motion by Councilmember McIntyre, seconded by Councilmember Emery to close the public hearing, issue a Negative Declaration and adopt Planning Resolution No. P-91-32, entitled, "A Resolution of the City Council of the City of Poway, California Approving Tentative Tract Map 91-02, Assessor's Parcel Number 275-560-17, 18, 19," amended to require two trails proposed by staff and the easterly trail proposed by the developer; and to require the CC&R's to be similar to the Silver Saddle CC&Rs. Motion carried unanimously. ITEM 5 LANDSCAPE MAINTENANCE DISTRICT 83-1 INTENT TO LEVY ASSESSMENTS Councilmember McIntyre disqualified herself and left the meeting. 4191 Page 4 - CITY OF POWAY - May 28, 1991 Item introduced by City Manager Bowersox. Staff report by Director of Public Services Archibald. The proposed 1991-92 assessment for LMD 83-01 is $118.68 per unit and staff recommends approval of the engineer's report and setting the public hearing for June 18, 1991. There was no one present wishing to speak. Motion by Councllmember Higginson, seconded by Councilmember Emery to adopt Resolution No. 91-048, entitled, "A Resolution of the City Council of the City of Poway, California, Declaring the Intention to Levy and Collect Assessments Within Poway Landscape Maintenance District 83-01 for Fiscal Year 1991-92," which sets the public hearing for June 18, 1991 and approve the engineer's report. Motion carried 4-0 with Councilmember McIntyre disqualified. (Councilmember McIntyre re-entered the meeting.} ITEMS 6 THROUGH 9 LANDSCAPE MAINTENANCE DISTRICTS 86-1, 86-2, 86-3, 87-1 INTENT TO LEVY ASSESSMENTS Mayor Goldsmith stated these items would be discussed together. Item introduced by City Manager Bowersox. Staff report by Director of Public Services Archibald. The proposed assessments for these four districts have all decreased this year and there is no assessment proposed for 86-2 Zone A because of a cash settlement from the developer which leaves a balance in that account sufficient to cover projected expenditures. Staff recommends adoption of the appropriate resolutions. Speaking in favor of staff recommendation: Joyce Eiswald, 14640 Brookstone Drive, Vice Chairperson of the Landscape Maintenance District Advisory Committee. Motion by Councilmember Emery, seconded by Councilmember Higginson, to adopt the following Resolutions: Resolution No. 91-049, entitled, "A Resolution of the City of Poway, California Declaring the Intention to Levy and Within Poway Landscape Maintenance District 86-01 for Fiscal proposed assessment is $231.95 per unit. Council of the City Collect Assessments Year 1991-92." The Resolution No. 91-050, entitled, "A Resolution of the City of Poway, California Declaring the Intention to Levy and Within Poway Landscape Maintenance District 86-02 for Fiscal proposed assessment is $30.15 per unit in Zone B. Council of the City Collect Assessments Year 1991-92." The Resolution No. 91-051, entitled, "A Resolution of the City of Poway, California Declaring the Intention to Levy and Within Poway Landscape Maintenance District 86-03 for Fiscal proposed assessment is $137.25 per unit. Council of the City Collect Assessments Year 1991-92." The 4192 Page 5 - CITY OF POWAY - May 28, lg91 Resolution No. 91-052, entitled, "A Resolution of the City Council of the City of Poway, California Declaring the Intention to Levy and Collect Assessments Within Poway Landscape Maintenance District 87-01 for Fiscal Year 1991-92." The proposed assessment is $298.52 per unit. Motion carried unanimously. The public hearing on each of these LMDs will be June 18, 1991. ITEM 10 ARJIS BUDGET Staff report by City Manager Bowersox. At the April 30, 1991 meeting, Council requested that staff review the proposed changes to the billing structure for the Automated Regional Justice Information System. It appears there will be no net change in the amount billed, they are just increasing the membership fee and lowering the utilization fee. Council concurred to receive and file the report. ITEM 10.1 NOVICE SWIM PROGRAM Staff report by City Manager Bowersox. This report is in response to questions raised by Mr. Scandalis at the May 21, 1991 City Council meeting regarding the Council's May 14, 1991, direction to staff to solicit proposals for operation of the novice swim program this summer. Mr. Scandalis felt the United Poway Swim Team had a contract with the city based on a letter from staff dated April 23, 1991, and their response. However, no contract had been signed and several issues were unresolved after two meetings. The RFPs have been mailed and June 4 is the deadline for receipt of proposals. Staff recommends the Council receive and file this report. Speaking in opposition to staff recommendation: Ricki Peitchel, 12881 Indian Trail William Scandalis, 807 Glenwood Way, Escondido, head coach for the United Poway Swim Club. Mr. Scandalis stated the UPSC had printed flyers and registration forms at the direction of City staff. Following discussion, Council concurred to receive and file the report, but requested staff report back on the RFP process and reimburse the UPSC for their costs if they do not receive the contract. ITEM 23 CITY MANAGER ITEMS A. City Manager Bowersox reported that Poway has a 25% reduction in water usage over the base 1989 year for the past 8 days. 4193 Page 6 - CITY OF POWAY - May 28, 1991 City Manager Bowersox announced that the city has received an award from the San Diego Chapter of the American Planning Association for the Haley Trust Project. ITEM 24 CITY ATTORNEY ITEMS Assistant City Attorney Smith withdrew her request for a closed session. 14AYOR ANO CITY COUNCIL-INITIATEO ITEI~ 29. A) Mayor Goldsmith requested this item be taken out of order since there are citizens present wishing to speak to this item. Councilmember McIntyre disqualified herself and left the room. Attorney Jim Jeffries has written a letter to the Mayor requesting a block wall be built to replace the wood fence on the west side of Espola Road, north of Twin Peaks, adjacent to "The Ranch" subdivision. Speaking in favor of a wall: Dick Mays, 1435 Alando Place Thomas Livengood, 14743 Alando Place Following discussion, Council concurred to look at this area for a wall when Espola Road is widened, and to refer this request to the Redevelopment Advisory Committee for consideration of funding. A) Councllmember Emery reported that the City of E1Cajon lost its lawsuit against MTDB regarding the trolley extension to Santee. B) Councilmember Emery stated he has received a request from Sue Herndon for any funds left over from the Poway Assistance Line appropriation to be donated to the 4th of July celebration to be held at Lake Poway. Staff will report back. c) Councilmember Emery stated David Rinaldo, the new President of the Poway Royal Mobile Estates Board, has some concerns. Director of Planning Services Wright-Quastler will contact him. D) Councilmember Emery invited Larry Cruse to come forward and present a request he had made to Councilmember Emery. Mr. Cruse asked if SANDAG could map census data rather than having it printed out in a linear format. Staff will report back. 27. Councilmember McIntyre requested that an additional "no parking, bike lane" sign be placed on the south side of Twin Peaks Road across from Tierra Bonita School. 4194 Page 7 - CITY OF POWAY - May 28, 1991 29. B) Mayor Goldsmith reported on the May 24, lggl SANDAG meeting. 1. The Board voted to support legislation to make the extension of SR 125 between Poway and Santee a toll road. 2. The Board voted to continue environmental studies on the western end of the proposed SR 56 alignment. 3. The Board is in favor of a market based approach to reducing cars on the freeways. 4. The Board of Supervisors is pursuing an aggressive program for recycling to relieve the landfills. AD,31XIRHgE#T Mayor Goldsmith adjourned the meeting in memory of Barbara Brooks who died early this morning. Her husband, Bob Brooks, was active in Poway's incorporation efforts and served on the Budget Review Committee for ten years. Upon motion by Councllmember Hlgglnson, seconded by Councilmember Emery, Mayor Goldsmith ordered the meeting adjourned to 4:30 p.m., Thursday, May 30, 1991.
