PROCLAMATION Mayor Goldsmith presented a proclamation to Sue Herndon proclaiming 1991, as "Poway Salutes the Troops - Past and Present." July 4, NAYOR AHD CZTY COUI, ICIL-ZHITIATEO ITEN~ 31. Councllmember Emery stated the City Council had concurred to hear a status report from the Poway Music Boosters regarding their recycling efforts at the beginning of the meeting. Terry Henderson, President of the Music Boosters, and John Baildon, Chairman of the Recycling Committee, explained their current program and plans to expand. Council suggested a workshop on recycling and how Poway will comply with AB 939. 4220 Page 2 - CITY OF POWAY - June 18, 1991 Mayor Goldsmith explained the procedure for Public Oral Communications. The following persons were present to speak: Orval Hill, 13001 Bowron Road, spoke regarding traffic at Bowron and Civic Center Drive. Lane King, 13237 Ridgedale Drive, stated opposition to an auto agency in the Western Lumber site and asked why Dixieline Lumber would have to do major creek improvements to move into the site. City Manager Bowersox stated Dixieline could move in with no improvements if they occupied the building on site and cited the revenue benefits of auto dealerships. e Alan Herridge, 5369 Balboa Avenue, San Diego, requested the City Council adopt a resolution urging interest-free loans from the federal government to local governments to finance improvements. CONSENT CALENDAR Motion by Councllmember Emery, seconded by Councilmember Snesko, to adopt the Consent Calendar as follows: 20. Ratification of Warrant Register for May 30, 1991. 23. Denial of claim for damages from Richard, Rosemary and Joseph Caputi. 24. Approval of agreement with the County of San Diego for Animal Control Services for fiscal years 1991-92 through 1995-96. 25. Approval of an agreement between the City of Poway and the Poway-Midland Railroad Volunteers for the renovation and operation of the train equipment at Old Poway Park and appropriation of $1,000 for operating expenses. 26. Approval of 18-month time extension, to February 11, 1994, of Standard Agreement for Tentative Parcel Map 89-02, Gelb/Stobbs applicants; located on the west side of Tierra Bonita Road, 15D0 feet north of Donart Drive. 28. Award of bid for the Midland Road Master Drainage Facility to Southern California Underground Contractors, Inc. in the amount of $785,545. 28.1 Adoption of Resolution No. 91-059, entitled, "A Resolution of the City Council of the City of Poway, California for the Waiver of Plumbing Permits for the Installation of Ultra-low Flush Toilets as Part of the City of Poway Ultra-Low Flush Toilet Rebate Program." 28.2 Appropriation of $48,166.50 from the traffic mitigation fee fund for pay- ment to R&R Partners as reimbursement for improvements costs associated with development of Twin Peaks Plaza located at the southeast corner of Twin Peaks and Pomerado Roads, and authorization for traffic mitigation fee credits for build-out of the project. 28.3 Adoption of Resolution No. 91-060, entitled, "A Resolution of the City Council of the City of Poway, California, Approving a Joint Exercise of Powers Agreement by and Among Several Cities of the County of San Diego to Conduct a Solid Waste Disposal Alternative Analysis." Motion carried unanimously. ITEM 4 TENTATIVE PARCEL MAP 91-05 DEVELOPMENT REVIEW 91-04 ERB ENGINEERING~ APPLICANT Item introduced by City Manager Bowersox. Staff report by Director of Planning Services Wright-Quastler. This item was continued from May 21, 1991, when Council directed the applicant and staff to meet with the neighbors to try to resolve their concerns which include impact on their property values of a lower priced project; noise; loss of privacy; and increased traffic. Such a meeting was held but consensus was not reached. This project would meet the criteria of being affordable for moderate income households. The project has been redesigned to cause the driveway to line up with the driveway to Valley School. Speaking in opposition to staff recommendation: Lonnie Sarvis, 13259 Creek Park Lane Shirley Jans, 13022 Creek Park Drive Linda Burke, 13256 Creek Park Lane Speaking in favor of staff recommendation: Don Ayles, ERB Engineering, 13260 Poway Road 4222 Page 4 - CITY OF POWAY - June 18, 1991 Following discussion regarding density of the project, motion by Mayor Goldsmith, seconded by Councilmember Snesko, to continue this item to July 16, 1991, and requested the applicant look at a redesign to eight units. Motion carried unanimously. ITEM 5 1991-92 BUDGET Staff report by City Manager Bowersox. Committee's work in this process. He explained the Budget Review John Mullin, 14002 Midland Road, Chairperson of the Budget Review Committee stated there is good news and bad news. The good news is the budget is in balance. The bad news that it is in balance only because of some "one-time" accounting aberrations. He reviewed the Committee's recommendations. Speaking in opposition to staff recommendation: Cynthia John, 12833 Shadowline Street, representing the Library Advisory Committee presented their request for increased funding for library materials. Following discussion, motion by Councllmember Emery, seconded by Councilmember McIntyre, to appropriate an additional $3,677.75 in the 1991-92 budget for library materials. Motion carried unanimously. Council discussed the need for an updated list of capital improvement projects. City Manager Bowersox stated that the newly hired Redevelopment Manager will be looking at the list of projects in the 1983 Redevelopment Plan to determine what has been completed and what remains to be done. Motion by Councilmember Emery, seconded by Councilmember Snesko to continue consideration of the 1991-92 budget to June 25, 1991. Motion carried unani- mously. ITEM 6 TENTATIVE PARCEL MAP 91-01 APPLICANT: POWAY LAND CO.~ DOUGLAS KEYES Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request for a three lot subdivision of 16 acres at the northeast corner of Pomerado Road and Metate Lane. The applicant will be required to improve Metate Lane and Poway Creek. Staff recommends approval. Director of Planning Services Wright-Quastler requested a change to condition 8 on page 13 to require the creek access ramp to be to the satisfaction of staff rather than stating a maximum grade of 12 percent. Mayor Goldsmith stated the standard condition regarding water conservation offset had been omitted. 4223 Page 5 - CITY OF POWAY - June 18, 1991 Speaking in opposition to staff reconmendation: Robert Good, 12730 Soule Street. Mr. Good requested a continuance to give opportunity for public input. Speaking in favor of staff recommendation: Douglas Keyes, Poway Land Company, 6910 Miramar Road, San Diego Motion by Councilmember Higginson, seconded by Councilmember McIntyre, to close the public hearing and adopt Planning Resolution No. P-91-35, entitled, "A Resolution of the City Council of the City of Poway, California Approving Tentative Parcel Map 91-01, Assessor's Parcel Number 317-211-02, 04," as amended regarding the creek access road and water conservation offset. Motion carried 4-1 with Councilmember Emery voting "no." ITEM 7 TENTATIVE PARCEL MAP 91-06 FRANK PIERSEN, APPLICANT Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request to subdivide 18.5 acres into four residential lots at the southern terminus of Welton Lane in the South Poway Planned Community, immediately south of the Welton Reservoir. Today we received a request from the applicant's representative to continue this item to July 16, 1991. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember McIntyre, to continue consideration of Tentative Parcel Map 91-06 to July 16, 1991. Motion carried unanimously. ITEM 8 TENTATIVE TRACT MAP 91-03 DIORAMA ESTATES, APPLICANT Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request to subdivide 1.5 acres into five lots at 14469 Midland Road in the Old Poway Specific Plan area. The applicant is being encouraged to use the design guidelines for the Old Poway area, although they are not mandatory for single family homes. Staff recommends approval. There was no one present wishing to speak. Motion by Councilmember Snesko, seconded by Councilmember Emery to issue a Negative Declaration, close the public hearing and adopt Planning Resolution No. P-91-37, entitled, "A Resolution of the City Council of the City of Poway, California Approving Tentative Tract Map 91-03, Assessor's Parcel Number 314-192-88." Motion carried unanimously. 4224 Page 6 - CITY OF POWAY - June 18, 1991 ITEM 9 TENTATIVE PARCEL MAP 91-04 DOUGLAS PEIRSON, OWNER Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request to subdivide 2.1 acres into two lots on the east side of the 1560D block of Oakstand Road. Staff recommends approval. Speaking in favor of staff recommendation: Douglas Pierson, 14082 Valley Springs Road, questioned the requirement to leave the rock outcroppings where they are. Director of Planning Services Wright-Quastler stated that the applicant is free to present a better layout and it can be brought back to Council for a determination. Motion by Councilmember Hlgglnson, seconded by Councilmember Snesko, to close the public hearing and adopt Planning Resolution No. P-91-37, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Tentative Parcel Map 91-04, Assessor's Parcel Number 278-442-35." Motion carried unanimously. ITEM 10 VARIANCE 91-03 JERRY DOUGLAS, APPLICANT Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request for approval of 5.5 to 6.5 foot retaining wall with a five foot high solid wood fence located one foot in back of the wall located at 13435 Maryearl Lane. Current standards limit retaining wall height to six feet and require a minimum separation of five feet between the two fences. Staff recommends approval. The applicant stated he had not reviewed the conditions and Mayor Goldsmith tabled this item for a few minutes to give him a chance to meet with Steve Streeter. After review, Mr. Douglas stated he was in favor of staff recommen- dation. Motion by Councilmember Emery, seconded by Councilmember Higginson, to close the public hearing and adopt Planning Resolution No. P-91-38, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Variance 91-03, Assessor's Parcel Number 314-411-06." Motion carried unanimously. 4225 Page 7 - CITY OF POWAY - June 18, 1991 ITEM 11 VARIANCE 01-02 CRAIG BREIHAN, APPLICANT Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request for a 16 foot high crib wall on the east side of Community Road, south of Civic Center Drive, along a cut slope at the rear of the proposed Briehan Mobile Home Park {Camelot Terrace). The current standards limit crib walls to six feet. Staff recommends approval. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councllmember Higginson, to close the public hearing and adopt Planning Resolution No. P-91-38, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Variance 91-02, Assessor's Parcel Number 317-480-10." Motion carried unanimously. ITEM 12 RENTAL RATES FOR THE PERFORMING ARTS CENTER Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. The Performing Arts Advisory Committee is recommending a revised third party rental rate schedule. The rates are scaled by whether the applicant is in or out of the service area and whether they are non-profit or for-profit groups. Staff recommends approval. Motion by Councllmember Emery, seconded by Councilmember Higginson, to close the public hearing and adopt Resolution No. 91-081, entitled, "A Resolution of the City Council of the City of Poway, California, Establishing the Schedule of Fees for Rental of the Poway Center for the Performing Arts and Rescinding Resolution No. 90-040." Motion carried unanimously. ITEM 13 LANDSCAPE MAINTENANCE DISTRICT 83-1 1991-92 ASSESSMENTS Mayor Goldsmith opened the public hearing. Councilmember McIntyre stated she would disqualify herself from voting on this item. Staff report by City Manager Bowersox. The City Council adopted the Engineer's Report on June 4, 1991 and staff recommends an assessment of $118.68 per unit for fiscal year 1991-92. There was no one present wishing to speak. 4226 Page 8 - CITY OF POWAY - June 18, 1991 Motion by Councilmember Emery, seconded by Councilmember Higginson to close the public hearing and adopt Resolution No. 91-062, entitled, "A Resolution of the City Council of the City of Poway, California, Establishing Assessments for Landscape Maintenance District No. 83-1 to be Collected on the Property Tax Roll for Fiscal Year 1991-92." Motion carried 4-0 with Councilmember McIntyre disqualified. ITEM 14 LANDSCAPE MAINTENANCE DISTRICT 86-1 1991-92 ASSESSMENTS Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. The City Council adopted the Engineer's Report on June 4, 1991, and staff reco, m~ends an assessment of $231.95 per unit for fiscal year 1991-92. Motion by Councilmember Emery, seconded by Councilmember Higginson, to close the public hearing and adopt Resolution No. 91-063, entitled, "A Resolution of the City Council of the City of Poway, California, Establishing Assessments for Landscape Maintenance District No. 86-1 to be Collected on the Property Tax Roll for Fiscal Year 1991-92." Motion carried unanimously. TTEM 15 LANDSCAPE MAINTENANCE DISTRICT 86-2 1991-92 ASSESSMENTS Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. The City Council adopted the Engineer's Report on June 4, 1991 and staff recommends an assessment of $-0- in Zone A and $30.15 per unit in Zone B for fiscal year 1991-92. Motion by Councilmember Higginson, seconded by Councilmember Snesko, to close the public hearing and adopt Resolution No. 91-064, entitled, "A Resolution of the City Council of the City of Poway, California, Establishing Assessments for Landscape Maintenance District No. 86-2 to be Collected on the Property Tax Roll for Fiscal Year 1991-92." Motion carried unanimously. ITEM 16 LANDSCAPE MAINTENANCE DISTRICT 86-3 1991-92 ASSESSMENTS Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. Motion carried unanimously. ITEM 17 LANDSCAPE MAINTENANCE DISTRICT 87-1 1991-92 ASSESSMENTS Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. The City Council adopted the Engineer's Report on June 4, 1991 and staff reco. m,ends an assessment of $298.52 per acre for fiscal year 1991-92. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councllmember Snesko, to close the public hearing and adopt Resolution No. 91-066, entitled, "A Resolution of the City Council of the City of Poway, California, Establishing Assessments for Landscape Maintenance District No. 87-1 to be Collected on the Property Tax Roll for Fiscal Year 1991-92." Motion carried unanimously. ITEM 18 ASSESSMENT POLICY FOR LANDSCAPE MAINTENANCE DISTRICTS Staff report by City Manager Bowersox. The Landscape Maintenance District Advisory Committee has reviewed the policy of the 50% rate assessment for all developments, including single family homes, and finds it to be consistent and fair. Recommendation is to receive and file the report. Council concurred. ITEM 19 CREEK ROAD SEWER INSTALLATION STATUS REPORT Staff report by City Manager Bowersox. The Creek Road sewer project was prograFfmied for completion by April, 1992. Transfer of a design engineer from the Capital Improvement Program to the Drought Assistance Response Team will delay the completion until April, 1993. There have been no septic failures reported in the area. Recommendation is to receive and file. Council concurred, 4228 Page 10 - CITY OF POWAY - June 18, 1991 ITEM 19.1 FOURTH OF JULY CELEBRATION APPROPRIATION OF FUNDS Staff report by City Manager Bowersox. A co. mr~unity volunteer committee is planning a "Salute to the Troops" celebration at Lake Poway on July Fourth. Additional funds will be needed, over and above their fund-raising efforts, to put on this event which is planned to include a fireworks display. There will be $13,547 of non-personnel costs, including the fireworks and shuttle buses, and $10,246 of personnel costs. Staff recommends allocating the personnel costs from the 1991-92 budget. Council discussed eliminating the fireworks display since that would eliminate much of the cost; there are many other fireworks displays in the County on that day; and Poway traditionally has a very large fireworks display during Community Day in September. They also discussed development of a policy on community events that would get commitments up front so the city isn't in the position of spending funds that have not been planned for and budgeted. Motion by Councilmember Higginson, seconded by Councilmember Emery, to appropriate $6,000 from the 1991-92 budget for personnel costs for the one time event on the Fourth of July at Lake Poway, and directed staff to prepare a policy on city participation in community events. Motion carried unanimously. ITEM 19.2 SUMMER BEACH BUS Staff report by City Manager Bowersox. Council requested staff review options for providing bus service to local beaches this summer. Staff has identified four options, including a special flyer on the existing transit routes; assisting the schools if they wish to sponsor a trip to the beach; chartering buses and providing supervision; chartering buses without supervision. The costs associated with each option vary and the City's insurance carrier has recommended that if buses are chartered, the City provide supervision. Staff recommends the Council review the options and give direction. Following discussion, Council concurred to just do option one this year and Councilmember Snesko stated he will pursue a more cost effective program for next summer. ITEM 29 CITY MANAGER ITEMS City Manager Bowersox stated that the city had reduced its water consumption 30% during the period of June 1-18. 4229 Page 11 - CITY OF POWAY - June 18, 1991 City Manager Bowersox announced that Director of Planning Services Wright-Quastler had received an award from the American Planning Association, San Diego Section, for helping women in planning. MAYOR AND CITY COUNCIL-INITIATED ITEM5 31. Councllmember Emery requested that the City Attorney review the new no smoking ordinance adopted by the City of San Diego to determine how it dif- fers from our existing ordinance. 35. A) Mayor Goldsmith announced appointments to the Water Appeals Board: Jim Faaborg (McIntyre) and Joseph Sinacore (Snesko). B) Mayor Goldsmith stated he will take Councilmember McIntyre's place on the Creekside subcommittee. c) Mayor Goldsmith requested a status report on the sound wall and road improvements planned along Poway Road west of Oak Knoll. Director of Engineering Services Mark Weston stated this project is budgeted and the environmental review is scheduled to come to Council on August 6, 1991. Completion is anticipated in April, 1992. Upon motion by Councilmember Emery, seconded by Councilmember McIntyre, Mayor Goldsmith ordered the meeting adjourned to 3:30 p.m., Thursday, June 20, 1991.
