Those present wishing to speak included: Robert Sayles, 14057 Riverbend Road, spoke regarding the curfew law for youth under 18. He asked when the law was enacted and how it can be changed. 2. James Dolan, 13047 Dana Vista, requested better access to the fishing facilities at Lake Poway for handicapped persons. Approval of Memorandum of Understanding for Emergency Services with the California Conservation Corps. 28. Approval of Agreement to Exchange Real Property Among Robert T. Approval of loan of $5,000 from the unappropriated general fund to the ARTS ALIVE Foundation for the Performing Arts to be repaid by September 30, 1991. 30.1 Award of bid for construction of Phase I of Traffic Signal Synchronization project to Steiny & Company, Inc. in the amount of $94,405. Motion carried unanimously. ITEM 13.2 SOCCER FIELD NEEDS ASSESSMENT Mayor Goldsmith stated that because of the number of people present, this item would be considered out of order. Staff report by City Manager Bowersox. The Poway Youth Sports Association assisted in the update of the sports facilities needs assessment, including soccer. The soccer association has prepared a field needs assessment for their sport since they felt the original needs assessment did not adequately address their needs. The Parks & Recreation Committee will consider this report on July 24, 1991 and will subsequently report to the City Council. The City Council has expressed their commitment to youth sports in the past and is working to iden- tify sites and funding sources for a variety of fields. Recommendation is to receive and file this report. Speaking in favor of additional soccer fields: Jim Jennings, 13816 Putney Road Lawrence Drummond, 13708 Somerset Road Alan Dusi, 13944 Northcrest Lane Stephen Soules, 14350 Garlyn Court Cindy Hicks, 13242 Lingre Avenue Skip Hicks, 13242 Lingre Avenue Brian Quinn, 11873 Glenhope Road, San Diego Ray Eaton, 12923 Conley Street Charles Cross, 13514 Mora Circle April Cofrancesco, 13608 Carriage Road Speakers spoke of teams that had been displaced from the school fields because the ESS program has pre-empted their use; need to upgrade the soccer field at the Community Park; and offered to assist with field maintenance. Mayor Goldsmith emphasized the need to clarify short-term and long-term needs and suggested the "Committee for a Day" approach might be useful. Council concurred to receive and file the report RECESS AND CALL TO ORDER Mayor Goldsmith recessed the meeting at 7:55 p.m., and called it back to order at 8:03 p.m., with all Councilmembers present. 4245 Page 4 - CITY OF POWAY - July 16, 1991 ITEM 4 TENTATIVE PARCEL MAP 91-05 DEVELOPMENT REVIEW 91-04 APPLICANT: ERB ENGINEERING Staff report by City Manager Bowersox. This is a request for a ten unit con- dominium project located on the east side of Bowron Road, 300 feet south of Civic Center Drive. This item was originally considered on June 18, 1991 and was continued to allow the applicant to attempt to resolve the concerns of the residents of Park Creek, including preparation of an eight unit layout. The developer has presented a pro forma showing that an 8 unit project would sell for $170,000 and a 10 unit for $202,000. Neither one meets the guidelines for affordable housing. Director of Planning Services Wright-Quastler reviewed the six layouts being presented, E-l, E-2, F-l, F-2, G-1 and G-2. The last two were prepared following a meeting with the neighbors and developer last week. Staff prefers E-l, F-1 or G-1. Speaking in opposition to staff recommendation: Lonnie Sarvis, 13259 Creek Park Lane Shirley Janus, 13022 Creek Park Drive Nikki Dawson, 13239 Creek Park Lane John Knotwell, 13280 Creek Park Lane Larry Poole, 14790 Deerwood Street All speakers spoke in favor of the least number of units possible. Speaking in favor of a ten unit project: Don Ayles, ERB Engineering, 13260 Poway Road Jack Roberts, 33792 Blue Lantern, Dana Point, property owner Don Patch, 14005 Midland Road, project developer Council concurred that the site is more suitable for an eight unit project. Motion by Councilmember McIntyre, seconded by Councilmember Higginson, to close the public hearing, issue a Negative Declaration, and adopt Planning Resolution No. P-91-41, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Tentative Parcel Map 91-05 and Development Review 91-04, Assessor's Parcel Number 317-474-01," for an eight unit {layout F-l) condominium project. Motion carried unanimously. ITEM 5 TENTATIVE PARCEL MAP 91-06 APPLICANT: FRANK PIERSON, SR. Staff report by City Manager Bowersox. This is a request to subdivide two existing legal lots totaling 18.5 acres into four lots at the southern terminus of Welton Lane. This item was continued from June 18, 1991 at the request of the applicant. 4246 Page 5 - CITY OF POWAY - July 16, 1991 Director of Planning Services Wright-Quastler stated staff has met with the applicant's representative and issued a revised report responding to their written requests. There are three changes to that report: condition 2, page 7 remains as is; condition 9, page 7, any gate relocation is the responsibility of the developer, not ADI; condition 13, page 9, the requirement for two street lights remains. Staff recommends approval with these changes. Speaking on behalf of the applicant: Barry Hogan, Michael Brandman & Associates, 7676 Hazard Center Drive, Suite 400, San Diego. Mr. Hogan expressed opposition to installation of street lights because of the rural residential nature of the property. Following discussion, motion by Councilmember Snesko, seconded by Councilmember Higginson, to close the public hearing, issue a mitigated Negative Declaration and adopt Planning Resolution No. P-91-42, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Tentative Parcel Map 91-06, Assessor's Parcel Number 323-09D-52, 59," amended to delete the requirement to install two street lights. Motion carried unanimously. ITEM 6 COUNTY MAJOR USE PERMIT MODIFICATION P74-77{M2) APPLICANT: ST. MICHAEL'S CATHOLIC PARISH Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request to construct a new sanctuary building to replace the church which was destroyed by fire last year at 15546 Pomerado Road. Staff recommends approval. There was no one present wishing to speak. Motion by Councilmember Higginson, seconded by Councilmember Emery to close the public hearing, issue a Negative Declaration and adopt Planning Resolution No. P-91-43, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Modification of Major Use Permit P74-77, Assessor's Parcel Number 275-460-26, 58." Motion carried unanimously. ITEM 7 MAJOR USE PERMIT P81-13 MODIFICATION RANCHO ARBOLITOS SWIM & TENNIS CLUB Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is consideration of modification to the use permit issued to Standard Pacific for the Rancho Arbolitos Swim & Tennis Club which was initiated by staff in response to Standard Pacific's request to light the remaining three tennis courts. Standard Pacific has requested continuance to August 6, 1991. 4247 Page 6 - CITY OF POWAY - July 16, 1991 There was no one present wishing to speak. ITEM 8 TENTATIVE TRACT MAP 85-03 MODIFICATION MINOR DEVELOPMENT REVIEW 91-02 HILLSIDE/RIDGELINE APPLICANT: JEANNE SHINNICK Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request to construct a 3,365 square foot single-family residence and 833 square foot detached guest house at 15650 Boulder Mountain Road at an elevation 51 feet higher than approved on the Tentative Tract Map. Staff recommends approval. There was no one present wishing to speak. Motion by Councilmember Higginson, seconded by Councilmember Emery to close the public hearing and adopt Planning Resolution No. P-91-44, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Tentative Tract Map 85-D3 Modification and Minor Development Review 91-02, Assessor's Parcel Number 275-800-08." Motion carried unanimously. ITEM 9 CONDITIONAL USE PERMIT 91-07 MINOR DEVELOPMENT REVIEW 91-19 HILLSIDE/RIDGELINE APPLICANT: LINDA & RICHARD SNYDER Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request to construct a 6,034 square foot single-family residence and 1,264 square foot accessory unit at 14652 Sunset Mountain Way. Staff recommends approval. Speaking in favor of staff recommendation: Linda Snyder, 17534 St. Andrews Drive, thanked staff for their help in the process. Motion by Councilmember Emery, seconded by Councilmember Higginson to close the public hearing and adopt Planning Resolution No. P-91-45, entitled,"A Resolution of the City Council of the City of Poway, California, Approving Conditional Use Permit 91-07 and Minor Development Review 91-19, Assessor's Parcel Number 278-280-32, 33." Motion carried unanimously. 4248 Page 7 - CITY OF POWAY - July 16, 1991 ITEM 10 SOVEREIGNTY ORGANIZATION Staff report by City Manager Bowersox. On June 18, 1991, a San Diego resident addressed the City Council on behalf of the Sovereignty Organization and Tax Movement. Staff reco~lwFlends monitoring this proposal if addressed by the League of California cities. Council concurred. ITEM 11 REDEVELOPMENT AND HOUSING ADVISORY COMMITTEE REVISED CHARTER Staff report by City Manager Bowersox. He reviewed the proposed changes to the Redevelopment Advisory Committee to expand it by four members and change the title to Redevelopment and Housing. He pointed out that a majority of the current eleven members are from the northern portion of the city and suggested Council look at the mid section of the city for the new members. Councilmember McIntyre pointed out that the Housing Element calls for the Housing Committee to recommend criteria for sites suitable for the Affordable Housing overlay and suggested that be spelled out in the charter. Motion by Councilmember Emery, seconded by Councilmember Snesko to adopt the revised charter for the Redevelopment and Housing Advisory Committee amended as suggested by Councilmember McIntyre. Motion carried unanimously. ITEM 12 COMMUNITY FACILITIES DISTRICT NO. 1 ACQUISITION AGREEMENT Staff report by City Manager Bowersox. This is an amendment to the First Amended and Restated Acquisition Agreement for Community Facilities District No. i which allows C.F. Poway to be reimbursed for certain public improvements. Staff recon~ends approval of the agreement and appropriation of the remainder of the acquisition fund. Motion by Councilmember Higginson, seconded by Councilmember Emery to approve staff recommendation. Motion carried unanimously. ITEM 13 NOVICE SWIM PROGRAM Staff report by City Manager Bowersox. At the May 28, 1991 meeting, Council directed staff to provide an update on the novice swim program once the bid for operation was awarded. The United Poway Swim Club is operating the program and staff will continue to monitor the program. Council concurred to receive and file the report. 4249 Page 8 - CITY OF POWAY - July 16, 1991 ITEM 13.1 ORDINANCE NO. 341 - URGENCY BRUSHING AND GRUBBING Mayor Goldsmith read the title of Ordinance No. 341, "An Ordinance of the City of Poway, California, Amending Chapters 16.40 and 16.44 of the Poway Municipal Code Pertaining to Clearing, Brushing and Grubbing and Declaring the Urgency Thereof." Staff report by City Manager Bowersox. Staff is rewriting the city's grading ordinance, however as a result of the Old Coach Road lawsuit and to prevent property owners from destroying habitat, there is an immediate need to have an ordinance in place regulating clearing, brushing, and grubbing. Staff recommends adoption of the urgency ordinance. Motion by Councilmember, seconded by Councilmember, to adopt Ordinance No. 341 as an urgency measure. Motion carried unanimously. ITEM 31 CITY MANAGER ITEMS Ae City Manager Bowersox stated the water savings for the week was 25% and the monthly savings is 32% to date. Council asked about the timeframe for digging wells in the City parks; plans for the package plant; and the seven stage ordinance. Director of Public Services Archibald stated that bids will be opened on July 23 for five test wells in city parks and the seven stage ordinance will be before Council in six to eight weeks. City Manager Bowersox stated the package plant is being held in inventory. Be City Manager Bowersox stated, in response to Council query recently, that the population center of Poway is at the intersection of Poway Mesa Drive and Hillndale. C. City Manager Bowersox stated that construction began today on State Route 56 west of Pomerado Road. ITEM 32 CITY ATTORNEY ITEMS Assistant City Attorney Smith requested the Council hold a closed session pursuant to Government Code Section 54956.9{b){1), threatened litigation. I~YOR AND CITY COUNCIL-INITIATED ITEt~ 36. A) Councilmember McIntyre stated she was absent from the June 25 City Council meeting when water rates were adopted and expressed concern that there was a policy shift regarding the funding of the Drought 4250 Page 9 - CITY OF POWAY - July 16, 1991 Assistance Response Team {DART} from water rates rather than from reserves. Following discussion, motion by Councilmember McIntyre to not fund DART from water rates, but from the reserves which will be replenished by penalties. There was no second to the motion. Bill Barnick, 14645 Sunrise Canyon Road, expressed concern over the lack of water in case of a severe fire season. B) Councllmember McIntyre stated she had been contacted by the principal of Valley School to attend a parents meeting regarding the children traversing the bottom of Poway Creek to get to school. It was decided that PUSD does provide bus service to all but the mobilehome park, however there is interest in having a pedestrian bridge across the creek for access to the Community Center and businesses on Poway Road. Following discussion, motion by Councilmember McIntyre, seconded by Councilmember Emery to conduct a survey of the residents on the south side of Poway Creek to determine an appropriate location for a crossing and add it to the "wish list" for capital improvements. Motion carried unanimously. Connie Shelley, 12844 Blanco Court, spoke in favor of the bridge. c) Councilmember McIntyre asked staff to report back regarding the letter received from residents of Starridge Street regarding parking in their cul-de-sac by park-goers. Director of Engineering Services Weston stated it is scheduled to go to the Traffic Safety Committee first. D) Councilmember McIntyre requested a report on the Fourth of July celebration in order to determine if this should be an annual event. Council concurred that an annual celebration with fireworks would be desirable. Staff will bring back a report. 37. Councilmember Snesko stated a computer in the City Council office with a modem to access City Link would be desirable. City Manager Bowersox stated the cost would be approximately $3,500.00. Motion by Councilmember Snesko, seconded by Councilmember Emery to appropriate funds to provide a computer with modem in the City Council's office. Motion carried unanimously.
