Res P-05-75 RESOLUTION NO. P-05-75 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT 05-87 TO HOLD CHRISTMAS IN THE PARK 2005 AT OLD POWAY PARK WHEREAS, Temporary Use Permit 05-87, City of poway Community Services Department, Applicant, requests approval to hold "Christmas in the Park 2005" at Old Poway Park, located at 14134 Midland Road, on Saturday, December 10, 2005, from 4:30 p.m. to 8:30 p.m.; and WHEREAS, on November 15, 2005, the City Council considered the above- referenced item. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as follows: Section 1: The City Council finds that Temporary Use Permit 05-87 is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will have no effects on the environment. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.Aofthe Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 05-87, "Christmas in the Park 2005" at Old Poway Park, located at 14134 Midland Road, on Saturday, December 10, 2005, from 4:30 p.m. to 8:30 p.m., subject to the following conditions: A. The event and related off-site parking shall be conducted as shown on the site plan and application on file in the Development Services Department. B. This permit is valid during the hours of 4:30 p.m. to 8:30 p.m. on Saturday, December 10, 2005, after which time the site shall be restored to its original condition. C. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. D. The site shall be developed in accordance with the approved site plan on file in the Development Services Department, Planning Division, except as otherwise provided herein. E. Prior to the event, the applicant shall comply with the following: 1. The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Resolution No. P-05-75 Page 2 Community Services, Development Services, Safety Services, and the Sheriff's Department. The San Diego County Health Department shall also be contacted. 2. Obtain permits from the Fire Department for any tent that exceeds 200 square feet or any canopy that exceeds 400 square feet. 3. All proposed signs shall be approved by the Development Services Department, Planning Division, and shall be in accordance with Section 17.40 of the poway Municipal Code. F. During the event, the applicant shall comply with the following: 1. Do not block emergency vehicle access to any street, building, fire hydrant, or fire sprinkler connection. 2. Provide a fire extinguisher with a minimum rating of 2A 1 OBC at any booth where food is cooked. 3. Secure any compressed gas cylinders to prevent them from falling over. G. At the conclusion of the event, the applicant shall comply with the following: 1. Public streets, off-street parking sites, and areas within and adjoining the proposed area for the event shall be cleared of debris, litter, temporary signs and all other evidence of the event. Section 4: This approval shall become null and void on Saturday, December 10, 2005, at 10:00 p.m., at which time the site utilized shall have been restored to its original condition.
