ORDINANCE NO. 625
AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA,
APPROVING A SPECIFIC PLAN AMENDMENT (SPA 84-01SSS)
TO THE SOUTH POWAY SPECIFIC PLAN
TO CHANGE THE LAND USE DESIGNATION ON 2.67 ACRES
LOCATED AT 12345 FIRST AMERICAN WAY
FROM LIGHT INDUSTRIAL TO INDUSTRIAL PARK

WHEREAS, Chapter 17.47 (Specific Plan Regulations) of Title 17 (Zoning
Development Code) of the Poway Municipal Code provides the requirements for the
initiation, preparation, and adoption of Specific Plans in accordance with Section 65450,
et seq. of the California Government Code (Article 8, Specific Plan); and
WHEREAS, Section 17.47.020.C (Initiation) of the Zoning Development Code
provides that the City Council may initiate the preparation of, or amendment to, a
Specific Plan on property by Resolution; and
WHEREAS, on October 11, 2005, the City Council initiated Specific Plan
Amendment 84-01SSS by Resolution; and
WHEREAS, Specific Plan Amendment 84-01SSS is proposed to change the
Land Use Designation of 2.67 acres within the South Poway Specific Plan Planned
Community from Light Industrial to Industrial Park; and
WHEREAS, on October 25, 2005, the City Council held a duly advertised public
hearing to solicit comments from the public, both pro and con, relative to this
application.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS:
Section 1: The City Council finds that the proposed project has been adequately
addressed in, and is within the scope of, the Negative Declaration (ND) approved for
SPA 84-01QQ on July 17, 2001. The project is within the scope of the prior
environmental document; therefore, no additional environmental review is necessary.
Section 2: The City Council hereby conditionally approves Specific Plan Amendment
84-01SSS as follows:
A. The land use designation on the 2.67-acre property located at the 12345 First
American Way, and as shown in Exhibit A attached to this Ordinance, is hereby
changed from Light Industrial to Industrial Park, subject to the payment of traffic
impact mitigation fees totaling $10,450 to be paid within 30 days of the passage
of this Ordinance.

EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30)
days after the date of this passage; and before the expiration of fifteen (15) days after
its passage, it shall be published once with the names and members voting for and
against the same in the Po way News Chieftain, a newspaper of general circulation
published in the City of Poway.
Introduced and first read at a regular meeting of the City Council of the City of
poway held this 25th day of October 2005 and thereafter PASSED AND ADOPTED at a
regular meeting of said City Council held the 15th day of November 2005, by the
following roll call vote.
