CC 2005 09-13 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING SEPTEMBER 13, 2005 The September 13, 2005, Regular Meeting of the City Council of the City of Poway, was called to order at 7:01 p.m. by Deputy Mayor Emery at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PRESENTATIONS San Diego County Tax Collector Dan McAllister made a presentation regarding the New Homeowner Property Tax Kit. Deputy Mayor Emery announced the presentation of the APWA Award for Poway City Hall acknowledging and thanking the work done by Assistant City Manager Penny Riley and Senior Engineer Jonathan Smith. CITY COUNCILMEMBER ANNOUNCEMENTS Deputy Mayor Emery gave a restaurant review of Eat Your Heart Out Deli on Stowe Drive. 8483 Page 2- CITY OF POWAY - September 13, 2005 Council members thanked staff and the community for the enjoyable Poway Days. Councilmember Rexford announced California Art Day on October 7tn and suggested the City adopt a resolution in support. Councilmember Rexford announced the City's "Neighborhood Resource Guide" containing contact information for the City's services and other helpful contact information on programs and services provided by other public agencies and nonprofit organizations. PUBLIC ORAL COMMUNICATIONS Deputy Mayor Emery explained the procedures for Public Oral Communications. There was no one present wishing to speak. CONSENT CALENDAR Items 3 through 7. Motion by Councilmember Boyack, seconded by Council member Rexford to approve the Consent Calendar as submitted. Motion carried 3-0 with Mayor Cafagna and Councilmember Higginson absent. 3. Ratification of Warrant ReQister for the period of August 15 through August 19, 2005. (0475-20) 4. Approval of Release of GradinQ Securities for G1461-04. SloUQh Parkway Business Center, Lots 1 and 2, Map No. 13852, located at Kirkham Way. Slough Poway I, LLC, Applicant. APN: 323-500-01,14. (0810-70) 5. Acceptance of the Fire Protection for the Orchard Bend Area Proiect (#1744) from RMR Construction. (0700-10) 6. Approval of a construction contract between the Poway Redevelopment AQency and Sun Countrv Builders for the Community Road Office Building site work for the property located at 13422 Community Road, in the amount of $250,000. (0700-10) CONTINUED PUBLIC HEARING ITEM 1 (0210-50) MINOR CONDITIONAL USE PERMIT 00-006M(2) MARK ABELKOP, APPLICANT POWAY MITSUBISHI AND HYUNDAI 13864 AND 13910 POWAY ROAD APN: 323-201-22 AND 232-203-20 8484 Page 3 - CITY OF POW A Y - September 13, 2005 Deputy Mayor Emery opened the public hearing. Assistant City Manager Riley and Director of Development Services Fritz gave the staff report. This is a request to extend the hours of operation for the existing Poway Mitsubishi and Hyundai auto dealership, located at 13864 and 13910 Poway Road. The existing hours of operation for the Service Department are Monday through Friday, 7:30 a.m. to 6:00 p.m. There are no Saturday hours at this time. The applicant is requesting the hours of operation for the Service Department to be Monday through Friday, 7:00 a.m. to 7:00 p.m. and Saturday from 8:00 a.m. to 5:00 p.m. The request for extended hours is to better serve their customers' needs, including offering repair service on Saturdays similar to other dealerships in Poway. There would be no repair activities on Sundays. The original conditions of approval have been amended to allow onsite delivery during the hours of 7:30 a.m. - 6:00 p.m., Monday through Saturday with no deliveries allowed on Sundays. Parts and supplies may also be delivered on Monday through Friday from 7:00 a.m. to 7:00 p.m., and on Saturdays from 7:00 a.m. to 6:00 p.m. All deliveries must take place on the site located on the east side of Evanston. Deliveries may not take place in the residential areas, on public streets or on the access to the future housing site to the north. Monica Vuong, Cicero Court, expressed concerns about the noise ofthe neighboring Toyota dealership and spoke in opposition to the extended hours. Sue Young, representing the Amesbury Court Homeowners Association, spoke in opposition to the extension of hours. Mark Abelkop, owner of Poway Mitsubishi and Hyundai, spoke in support of his project. Motion by Councilmember Rexford, seconded by Councilmember Boyack to close the public hearing and adopt Planning Resolution P-05-62 entitled, "A Resolution of the City Council of the City of Poway, California Approving a Modification to Minor Conditional Use Permit 00- 006M(2) to Request to Expand the Hours of Repair Service, APNs: 323-201-22 and 323-203- 20" and provided direction to staff for follow-up with a review of any noise impacts from the service bays and any impacts from the delivery of vehicles on the site. Motion carried 3-0, with Mayor Cafagna and Council member Higginson absent. PUBLIC HEARINGS ITEM 2 (0200-25) ENVIRONMENTAL ASSESSMENT TENTATIVE PARCEL MAP 05-01 GEORGE CATRAMBONE, APPLICANT APN: 278-240-20 Assistant City Manager Riley gave the staff report. This is a proposal for a 3-lot residential subdivision of an approximate 7.7-acre site that will consist of lots ranging in size from 2.1 to 2.8 acres. The site is currently being developed with a single-family home on a portion ofthe site that was approved under MDRA 04-105 by the City Council on March 1,2005. 8485 Page 4 - CITY OF POWAY - September 13, 2005 The proposed subdivision would enable the construction of two additional single-family homes on the site. Construction of the additional homes is not proposed at this time. Nick Arthman, East yale Road, has concern oyer the trail location and inquired as to what portion of the trail he will be responsible for improving. Don Ayles, representing ERB Engineering, Stowe Driye, stated there is a 30-foot easement at the southerly boundary of the trail, which gives adequate room for the road and trail. Larry Aker, Eastvale Road, spoke in favor of the project. Motion by Council member Rexford, seconded by Deputy Mayor Emery to close the public hearing and adopt Planning Resolution No. P-05-63 entitled: "A Resolution of the City Council of the City of Poway, California, Approving a Negative Declaration and Tentative Parcel Map (TPM) 05-01 Assessor's Parcel Number 278-240-20." Motion carried 3-0 with Mayor Cafagna and Council member Higginson absent. MAYOR AND CITY COUNCIL-INITIATED ITEMS 11. Council member Rexford asked that staff review with her the financing of the Fine Arts Center project including budget and prior expenditures. 13A. Deputy Mayor Emery gave his restaurant review of Eat Your Heart Out Deli during City Council member Announcements. Deputy Mayor Emery noted that at the last meeting, the City Council approved, on the Consent Calendar, a contribution from the City of Poway to the Hurricane Katrina victims in the amount of $50,000 and wanted to highlight this community's relief efforts.
