Jack Swain, 12667 Cobblestone Creek Road, requested that the Redevelopment Agency build a bridge across Poway Creek at Cobblestone Creek Road. CONSENT CALENDAR Councilmember McIntyre pulled Item 15.2 from the Consent Calendar. Motion by Councilmember Emery, seconded by Councilmember Higginson, to adopt the Consent Calendar as follows: Approval of Minutes - City Council: August 13, 1991, Regular Meeting August 20, 1991, Regular Meeting 10. Ratification of Warrant Registers for August 21, 1991 (FY 90-01), and August 23, 1991, {FY 91-92). 4311 Page 2 - CITY OF POWAY - September 10, 1991 12. Appropriation of $50,750 for the City of Poway Lighting District from assessments allocated for that purpose. 13. Appropriation of $17,437 for replacement of Safety Services automobile and Sheriff's motorcycle. 15. Adoption of Resolution No. 91-099, entitled, "A Resolution Council of the City of Poway, California, Supporting the Funding Project." of the City Immigration 15.1 Concurrence to have final adoption of the updated General Plan continued from September 24, 1991 to October 29, 1991. Motion carried unanimously. ITEM 5 RAW WATER RATES Mayor Goldsmith stated this item was continued from August 20, 1991. Staff report by City Manager Bowersox. Staff is still working with StoneRidge Country Club, which is the only account affected by this action, to resolve several issues. Staff recommends continuance to October 1, 1991. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Higginson, to continue consideration of raw water rates to October 1, 1991. Motion carried unanimously. ITEM 6 SPECIFIC PLAN AMENDMENT 84-01P/CONDITIONAL USE PERMIT 91-09 DEVELOPMENT REVIEW 91-27/SOUTH POWAY SPORTS COMPLEX APPLICANT: CITY OF POWAY Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is an amendment to the South Poway Specific Plan creating a Sports Complex land use designation and applying that designation to three lots. In addition, staff has prepared a Conditional Use Permit and Development Review for the proposed sports complex located at the northeast corner of Stowe Drive and McIvers Court. Staff recommends approval. There was no one present wishing to speak. Motion by Councllmember Emery, seconded by Councilmember Higginson, to close the public hearing; find that the previously certified EIR and subsequent EIR for 4312 Page 3 - CITY OF POWAY - September 10, 1991 the South Poway Planned Community is adequate for Specific Plan Amendment 84-01P; adopt Resolution No. 91-098, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Specific Plan Amendment 84-01P, Assessor's Parcel Number 317-281-17, 18, 317-280-46"; issue a Negative Declaration with mitigation measures for Conditional Use Permit 91-09 and Development Review 91-27; adopt Planning Resolution No. P-91-57, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Conditional Use Permit 91-09 and Development Review 91-27, Assessor's Parcel Number 317-281-17, 18; 317-280-46." Motion carried unanimously. ITEM 7 VARIANCE 91-08 APPLICANT~ ALICE FRIEMARK Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request to construct a 6 foot cedar fence on top of a 3 foot 4 inch retaining wall in the rear yard at 13726 McKenzie Avenue. This pro- perty is located approximately 100 yards east of Community Road and is separated from COflWllunity Road by the floodplain of Rattlesnake Creek. Staff recommends approval. Speaking in favor of staff recommendation: Michael Friemark, 13726 McKenzie Avenue. He requested the requirement for 18 inches of landscaping behind the wall be eliminated. Motion by Councilmember Emery, seconded by Councilmember Snesko, to close the public hearing and adopt Planning Resolution No. P-91-58, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Variance 91-08, Assessor's Parcel Number 317-761-07," deleting the requirement for landscaping. Motion carried unanimously. ITEM 7.1 TENTATIVE PARCEL MAP 91-09 REQUEST FOR REHEARING APPLICANT: LAWRENCE AND KATHERINE GROVER Staff report by City Manager Bowersox. On August 20, 1991, the City Council adopted Planning Resolution P-91-55 denying Tentative Parcel Map 91-09, a two parcel divison of a 25,150 square foot parcel at 17543 Boca Raton Lane because findings could not be made that the design was consistent with the General Plan and that the site was suitable for the density and type of development proposed. The applicant has requested a rehearing. The Municipal Code has a provision for the Council to grant a rehearing if the applicant presents new evidence not avaiable at the original hearing. Staff has found that no new and different evidence has been provided and recommends denial of the rehearing request. Speaking in opposition to staff recommendation: Lawrence Grover, 17543 Boca Raton Lane, stated he had paid a premium for this property because its size would allow two lots. 4313 Page 4 - CITY OF POWAY - September 10, lg91 Motion by Councllmember Hlgginson, seconded by Councilmember Snekso to deny the request for a rehearing on Tentative Parcel Map 91-09. Motion carried unanimously. ITEM 7.2 POMERADO WATER RECLAMATION FACILITY EIR TRANSFER RESPONSIBILITY TO CITY OF SAN DIEGO Staff report by City Manager Bowersox. The City of San Diego has raised several issues in the draft environmental impact report for the Pomerado Water Reclamation Facility, particularly the project description and alternative site analysis. Staff recommends that the City of Poway acknowledge the City of San Diego as an appropriate lead agency for preparing the EIR as part of the Clean Water Program, particularly as it was proposed that they take over the project after certification of the EIR. The Clean Water Program is presently hiring a consultant to do the environmental work for the entire county-wide program and would be available to prepare the EIR with San Diego as the lead agency. Staff further recommends direction to negotiate an agreement with the City of San Diego to include assurances that the project will be completed expeditiously and guaranteeing Poway an adequate wastewater treatment capacity and supply of reclaimed water. Mayor Goldsmith read a Joint statement from San Diego Councilmember Behr and himself regarding the project. Council requested that Pardee Development notify all buyers in the Sabre Springs project, including those north of Poway Road, of the proposed project, and that when the City of San Diego holds the scoping hearing for the EIR, all residents of Sabre Springs be noticed. Motion by Councilmember Emery, seconded by Councilmember Higginson, to adopt staff recommendation. Motion carried unanimously. ITEM 15.2 PAGUAY REDEVELOPMENT PLAN UPDATE Staff report by City Manager Bowersox. The Paguay Redevelopment Plan was adopted in December, 1983 and contained a list of capital improvement projects benefitting the Redevelopment Plan area. Many of those projects have been completed, others have changed in scope and cost, and new ones have been iden- tified. It is essential to have good cost estimates for the projects to help in financial planning for the life of the Agency. Staff recommends appropriating $35,000 for BSI Consultants Inc., to prepare the update. Councllmember McIntyre asked about Council input into the "wish list" of projects; new "wish list" from the Poway Unified School District; and why economic revitalization was not included in the Plan as a category for projects. 4314 Page 5 - CITY OF POWAY - September 10, 1991 City Manager Bowersox stated he has met with PUSD Superintendent and they are preparing a new "wish list." He suggested that the October 3 workshop include an item for the City Council to talk about their "wish lists" since the goals and objectives workshop is not until October 31. Following discussion, motion by Councilmember McIntyre, seconded by Council- member Emery, to appropriate $35,000 from the Redevelopment Agency unappropriated reserve to Special Studies; to add economic revitalization as a category for projects; and to receive input from the City Council at the October 3 workshop regarding their "wish list" for redevelopment projects. Motion carried unanimously. ITEM 16 CITY MANAGER ITEMS City Manager Bowersox stated that water conservation efforts for the first nine days of the month resulted in a 27% savings. Mayor Goldsmith stated he and Councilmember Snesko had submitted their ideas to staff for the hearing on water rates next week and suggested if the other Councilmembers had input, they give it to staff for analysis prior to the meeting. ITEM 17 CITY ATTORNEY ITEMS City Attorney Eckis requested a closed session pursuant to Government Code Section 54956.8 to instruct the city's negotiator, City Manager Bowersox or his designee, regarding the acquisition of real property at Aubrey and Midland owned by Marjorie Ogle. He will be negotiating with Mrs. Ogle or her representative. NAYOR AHO CiTY COUNCiL-iNiTiATED ITEIL~ 18. Councilmember Emery asked staff to report back regading a long-range plan for the eradication of bees at Lake Poway. 19. Mayor Goldsmith announced Susan Callery as Councilmember Emery's appointment to the Redevelopment and Housing Advisory Committee replacing Alan Sugarman who recently resigned. Mayor Goldsmith reported that the TransNet Committee of SANDAG has voted unanimously to support the transfer of funding from Poway Grade to South Poway Expressway. This item goes to the Executive Committee on September 13, and the full Board on September 27. 4315 Page 6 - CITY OF POWAY - September 10, lggl 21. 22. A) Mayor Goldsmith reported on the meeting held last week regarding State Route 125 attended by representatives from the cities of Poway and Santee, CalTrans and state legislators. They will be petitioning the California Transportation Commission to fund preparation of the environmental impact report. Representative Steve Peace has introduced legislation to allow this road to be a toll road, subject to approval of the Santee and Poway City Councils. B) C) Councilmember McIntyre asked if the October 31 workshop could be rescheduled since it is Halloween. Councilmember Snesko stated that CalTrans has said they do not have to do an EIR on the 1-15/Poway Road ramp metering project since the State Department of Planning & Research issued a categorical exemption for all ramp metering projects in California. He asked City Attorney Eckis to research whether they should be doing an EIR. Council concurred. Councllmember Snesko stated the parking at the Community Park is not adequate when there are several events going on such as bingo, a wedding, and swimming. He suggested the city purchase one or two acres of the Western Lumber site for parking. City Manager Bowersox suggested one of the problems is people's unwillingness to walk from the Bowron Road lot. He also stated we should be encouraging car pooling and public transit. Following discussion, motion by Councllmember Snekso, seconded by Councilmember McIntyre to direct staff to report back on how we can better accommodate the parking demands, particularly for Poway Valley Senior Citizens. Motion carried unanimously. Councilmember Snesko suggested that letterhead with the individual Councilmembers' name, rather than the entire Council, be used. Following discussion, motion by Councilmember Snesko, seconded by Councilmember Higginson to allow a Councilmember to have their own letterhead at city expense. Motion carried 4-1 with Councilmember Emery voting "no." CLOSED SESSION AND CALL TO ORDER Mayor Goldsmith called for a closed session at 8:40 pom. as requested by the City Attorney. He called the meeting back to order at 10:13 p.m. with all Councilmembers present and stated the City Council had instructed its negotiator during the closed session. 4316 Page 7 - CITY OF POWAY - September 10, 1991 Upon motion by Councilmember McIntyre, seconded by Councilmember Emery, Mayor Goldsmith ordered the meeting adjourned to 4:30 p.m., Thursday, September 12, 1991.
