PROCLANATIOH Mayor Goldsmith declared September 22-28, 1991 as the "Week of the Family Day Care Provider" and presented the proclamation to Linda Love, Vice President of the San Diego County Family Day Care Association. PUBLIC ORAL CQNNOHICATIOH$ Mayor Goldsmith explained the procedure for Public Oral Communications. 1. Davi d Rinaldo, 13035 Corona Way, President of the Poway Royal Homeowners Association, expressed concern regarding the questionnaire distributed by staff to the residents since it was different from the survey proposed by the Association. Director of Planning Services Wright-Quastler stated that the information requested by staff was required to determine if Redevelopment Agency housing funds could be used for assistance. Mayor Goldsmith suggested the Council sub- committee meet with the Homeowners Association. 4328 Page 2 - CITY OF POWAY - September 24. 1991 2. Carl e Henderson, 15335 Skyridge Road; Krysty Emery, 1436D Mountain Road; and Bill Carr, 14533 Wildgrove Road, members of the Poway High School Marching Band, the Emerald Brigade, requested city funding assistance for their travel to a national competition in Dallas, Texas. They will be the only band from California. City Manager Bowersox stated this will be included on next week's agenda. Howard Stacklin, 13149 Tobiasson Road, stated he did not believe United Way should be allowed to solicit City employees for funds; he did not sup- port the transfer of funds from the Poway grade project to the South Poway Expressway project; and he did not like the water billing system. CONSENT CALENDAR Motion by Councilmember McIntyre, seconded by Councilmember Higginson, to adopt the Consent Calendar as follows: 10. Approval of Minutes - City Council: September 3, 1991, Regular Meeting 12. Ratification of Warrant Registers for August 29, and September 5, 1991. 13. Award of bid for citywide striping/pavement marking and pavement marker replacement to Orange County Striping, in the amount of $48,219.50. 14. Receive and file annual review of Conditional Use Permit 90-01 and Minor Development Review 90-07 for two modular buildings in front of City Hall. 15. Adoption of Resolution No. 91-103, entitled, "A Resolution of the City Council of the City of Poway, State of California, Declaring the Intention to Vacate Public Streets, to Wit: Eden Grove, Harvest Crescent, Harvest Court, Harrow Lane, Harrow Place and Bounty Way, All in City of Poway Tract 84-08, Map No. 12044 {Vacation 91-08)," and setting the public hearing for October 22, 1991. 16. Acceptance of public improvements and release of securities for Tentative Map 87-11, Jonathan Park Lane; Stratford Communities, applicant; located north of Twin Peaks Road on Merritt Park Lane. 17. Approval of contract for editorial services for city's newsletter, Poway Today, with Judy Jones. 18. Adoption of Resolution No. 91-104, entitled, "A Resolution of the City Council of the City of Poway, California Ordering the Expansion of Poway Landscape Maintenance District 86-1 with the Annexation of MDR 91-24 into Landscape Maintenance District 86-1 with Written Consent of Property Owner, APN 275-240-46," Patrice and Jerry Simonsen, 13180 Glen Circle Road. 4329 Page 3 - CZTY OF PONAY - September 24, 1991 19. Adoptlon of Resolut10n No. 91-105, entitled "A Resolution of the City Council of the Clty of Poway, California Ordering the Expansion of Poway Landscape Maintenance District 83-1 with the Annexation of MDR 91-27 Into Landscape Malntenance Dlstrlct 83-1 with Written Consent of Property O~ner, APN 314-194-53," Fernando Sanchez, 14452 Midland Road. 20. Adoption of Resolution No. 91-106, entitled, "A Resolution of the City Council of the City of Poway, California Ordering the Expansion of Poway Landscape Maintenance District 86-1 with the Annexation of CUP and DR 89-18 Into Landscape Maintenance District 86-1 with Written Consent of Property Owner, APN 321-241-01" Church of Jesus Christ of Latter Day Saints, southeast corner of Twin Peaks and Tierra Bonita Roads. 20.1 Adoption of Resolution No. 91-107, entitled, "A Resolution of the City Council of the City of Poway, California, Approving Formation of the San Diego Abandoned Vehicle Abatement Service Authority and Service Program and Plan." 20.2 Adoption of Resolution No. 91-108, entitled, "A Resolution of the City Council of the City of Poway, California, Reducing Water Rates Established for Fiscal Year 1991-1992, and Rescinding Resolution No. 91-093." 20.3 Award of contract to SunCal Outdoor Advertising for construction, main- tenace and administration of a new City Kiosk Sign Program. Motion carried 3-0 with Councilmembers Emery and Snesko absent. ITEMS 4, 5, 6 UPDATED GENERAL PLAN Mayor Goldsmith stated that the updated General Plan hearings with focus on the Land Use Element and Housing Element were continued from August 27, 1991. The public hearing for the three zone changes 91-01A, B, and C is opened and will be continued to October 29, 1991. Councilmember McIntyre suggested several amendments to the draft, as follows: Motion by Councilmember McIntyre, seconded by Councilmember Higginson, to add a definition for landscaping that goes beyond planting on page 11-16. Motion carried 3-0 with Councilmembers Emery and Snesko absent. Motion by Councilmember McIntyre, seconded by Councilmember Higginson, to add a number 12 on page II-28 to cite the merits of public/private partnership in financing. Motion carried 3-0 with Councilmembers Emery and Snesko absent. Motion by Councilmember McIntyre, seconded by Councilmember Higginson, to add commercial uses to number 19 on page II-24. Motion carried 3-0 with Council- members Emery and Snesko absent. 4330 Page 4 - CITY OF POWAY - September 24, 1991 Motion by Councilmember McIntyre, seconded by Councilmember Higginson, to add the concept of personal self-reliance in time of emergency to the Public Safety Master Element. Motion carried 3-0 with Councilmembers Emery and Snesko absent. Motion by Councllmember McIntyre, seconded by Mayor Goldsmith, to revise the third paragraph on page V-lO to read, "The most important benefit of deletin9 .... "Motion carried 3-0 with Councilmembers Emery and Snesko absent. Councilmember McIntyre stated the Library Advisory Committee has proposed changes to the Public Facilities Element and requested they be discussed by the Council when the report from the architect comes forward regarding the two sites. Motion by Councllmember Hlgglnson, seconded by Councilmember McIntyre, to continue discussion of the Public Facilities Element to October 22, 1991. Motion carried 3-0 with Councilmembers Emery and Snesko absent. Motion by Councllmember Hlgglnson, seconded by Councilmember McIntyre, to continue the General Plan to October 29, 1991. Motion carried 3-0 with Councilmembers Emery and Snesko absent. ITEM 7 TENTATIVE TRACT MAP 88-17TE APPLICANT: CHIA-SHEN HOU Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. This is a request for a one year time extension for a six lot ten- tative tract map located at the western end of Rimbach Road. Staff recommends approval. Motion by Councilmember Higginson, seconded by Councilmember McIntyre to close the public hearing and adopt Planning Resolution No. P-91-61, entitled, "A Resolution of the City Council of the City of Poway, California Approving Tentative Tract Map 88-16TE, Assessor's Parcel Number 317-520-05, 06." Motion carried 3-0 with Councilmembers Emery and Snesko absent. ITEM 8 RECREATION FACILITY USE REGULATIONS AND FEES Mayor Goldsmith opened the public hearing. Staff report by City Manager Bowersox. Fees and policies for the use of City recreational facilities were last revised in November, 1988. Staff is proposing new fees to reflect increased city operation and maintenance costs, and revised use regulations to clarify advance reservation policies, cancellation fees and application procedures. 4331 Page 5 - CITY OF POWAY - September 24, 1991 Motion by Councilmember Higginson, seconded by Councilmember McIntyre to close the public hearing and adopt Resolution No. 91-109, entitled, "A Resolution of the City Council of the City of Poway, California Adopting Rules and Regulations for Operation of City of Poway Recreational Facilities," and Resolution No. 91-110, entitled, "A Resolution of the City Council of the City of Poway, California, Establishing the Facility Use Regulations, Classification of Applicants and Fees, and Fee Schedule for Use of City of Poway Facilities and Rescinding Resolution No. 88-133." Motion carried 3-0 with Councilmembers Emery and Snesko absent. ITEM 9 ORDINANCE NO. 344 - FIRST READING SPEED LIMIT - SOUTH POWAY EXPRESSWAY Mayor Goldsmith opened the public hearing and read the title of Ordinance No. 344, "An Ordinance of the City of Poway, California, Establishing a Speed Limit of 55 MPH on South Poway Expressway from Community Road to Pomerado Road." Staff report by City Manager Bowersox. On August 2D, 1991, Council requested a speed survey on South Poway Expressway from Community Road to Pomerado Road. Staff is recommending the speed limit be increased from 45 mph to 55 mph. Motion by Councilmember Higginson, seconded by Councilmember McIntyre to waive further reading and continue the public hearing to October 8, 1991, for second reading. Motion carried 3-0 with Councilmembers Emery and Snesko absent. ITEM 9.1 VARIANCE 91-05/MINOR DEVELOPMENT REVIEW 91-30 REQUEST FOR REHEARING APPLICANT: GABRIEL DEROSA Staff report by City Manager Bowersox. This is a request to rehear Variance 91-05 and Minor Development Review 91-30, a 5,445 square foot addition to a single family dwelling, with an eight foot encroachment into the front yard set- back at 16637 Sagewood Lane which was denied by the City Council. In staff's opinion there is no new and different evidence and they recommend the Council deny the rehearing request. The applicant has redrawn the project to remove the variance and can submit a new application for a minor development review which is considered at staff level. Speaking in opposition to staff's recommendation: David Ferguson, 613 W. Valley Parkway, Escondido, representing Mr. DeRosa Speaking in favor of staff's recommendation: Rosalind Orner, 16609 Sagewood Lane Following discussion, motion by Councilmember Higginson, seconded by Councilmember McIntyre to deny the request to rehear Variance 91-05 and Minor Development Review 91-30. Motion carried 3-0 with Councilmembers Emery and Snesko absent. 4332 Page 6 - CITY OF POWAY - September 24, 1991 ITEM 21 CITY MANAGER ITEMS Ae City Manager Bowersox reported that the community's water conservation efforts resulted in a 29% savings for the week and 28% for the month to date. City Manager Bowersox reported that Chrysler, Dodge, Jeep/Eagle and Volkswagen will be opening on the former Dodge/Dodge truck property this month and agreements will be coming forward soon for a Pontiac, Buick, GMC truck dealership. Ce City Manager Bowersox stated that a letter will be going out this week to all water accounts explaining the latest rates. A postcard with consumption history will be mailed in October. NAYOR AHO CITY COUNCIL-INITIATEO ITEI~ 26. Councilmember McIntyre raised the following water-related questions/issues to be included in the November 7 workshop discussion: a) Can water bills be more private? City Attorney Eckis stated they are public records. b) Can Council get a copy of the landscaping standards? Director of Planning Services Wright-Quastler stated they are currently being revised and will come to the Council for adoption in the near future. c) How much did the city receive in rebates from San Diego County Water Authority and can we use those revenues to offset future rate increases? d) How do we go about coordinating our water year with the County Water Authority's and have rate increases in January rather than July? e) Can we have information on the Katz bill concerning the reallocation of agriculture water in the state? f) Can Poway Dam be raised to increase capacity? g) Can Council get a copy of the Water Authority's agenda front sheets? City Manager Bowersox stated he receives them and will distribute them to the City Council. 24. C) Mayor Goldsmith moved that the ultra low-flow flush toilet rebate program be extended to businesses. Motion seconded by Councilmember Higginson and carried 3-0 with Councilmembers Emery and Snesko absent. 4333 Page 7 -C[TY OF POWAY - September 24, 1991 A) Mayor Goldsmith stated he had received letters from Mike Swanson, owner of property on the south side of Poway Road at the westerly city limits, requesting reconsideration of installation of medians on Poway Road in front of his residence, citing the difficulty in gaining access to his driveway. Dottle Brewster-Martin, 11835 Poway Road, stated they also use Mr. Swanson's driveway for access to their property and suggested, if the medians are installed, a cut be provided at that location. Council directed staff to meet with the residents again to determine if there is a solution that will not compromise the safety in the area. B) Mayor Goldsmith reviewed the report regarding the meeting held by the mayors and city managers of the nine cities that contract with the Sheriff for law enforcement. A "Blue Ribbon Committee" consisting of Councilmembers and staff, including Mayor Goldsmith and City Manager Bowersox, was formed to begin meeting with the County to review contract law enforcement from both a quantitative and qualitative perspective. Council concurred with this concept. Upon motion by Councllmember Hlgglnson, seconded by Councllmember McIntyre, Mayor Goldsmith ordered the meeting adjourned.
