Caliguri ("OWNER" hereinafter) are the owners of certain real property located in the City of Poway, California, more particularly described as Parcel 9 of Parcel Map number 15725, as filed in the County of San Diego, State of California in the office of the County Recorder of San Diego County, October 28, 2008 and which is commonly known as 14880 Sunset Ridge Court ("PROPERTY" hereinafter). In consideration of the approval of Minor Development Review Application 19-035 and Grading Permit G20-0009, by the City of Poway ("CITY" hereinafter), OWNER hereby agrees to not develop, grade or build any structure in the area of Parcel 9 where uncertified fill was previously placed as shown on the record grading plans G1565-07 and documented on the current grading plans G20-0009, which are on file with the CITY. The City agrees to allow the uncertified fill to remain on Parcel 9 instead of remediation and restoration to original topography. This Covenant shall run with the land and be binding upon and inure to the benefit of the future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties. In the event of litigation to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party.
