RESOLUTION NO. 06-006
RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA, ADOPTING AN AMENDED TRAVEL AND
MEETING REIMBURSEMENT POLICY, AND REQUIRING ETHICS TRAINING
WHEREAS, California Government Code section 53232.2 requires any local
agency that reimburses members of a legislative body for actual and necessary
expenses incurred in the performance of official duties to adopt a written policy
specifying the types of occurrences that qualify a member of the staff, ("Officials")
legislative body to receive payment and/or reimbursement of expenses relating to travel,
meals, lodging, and other actual and necessary expenses; and
WHEREAS, City of Poway's ("City") resources should only be used when there is
a substantial benefit to the City; and
WHEREAS, such benefits include:
1. The opportunity to meet with state and federal officials to discuss the City's
interests;
2. Participating in regional, state, and national organizations whose activities
affect the City;
3. Attending educational seminars designed to improve expertise and
information levels; and
WHEREAS, 1) legislative and other regional, state and federal agency business
is frequently conducted over meals; 2) sharing a meal with regional, state and federal
officials is frequently the best opportunity for a more extensive, focused and
uninterrupted communication about the City's policy concerns; and 3) each meal
expenditure must comply with the limits and reporting requirements of local, state and
federal law; and
WHEREAS, the City should bear the cost of the actual and necessary expenses
incurred by members of legislative bodies and staff members in the performance of their
official duties; and
WHEREAS, this policy provides guidance to elected and appointed officials and
to City staff on the use and expenditure of City's resources, as well as the standards
against which those expenditures will be measured; and
WHEREAS, this policy satisfies the requirements of AB1234, including
Government Code sections 53232 et. seq. and 53234 et. seq.
WHEREAS, this policy supplements the definition of actual and necessary
expenses for purposes of state laws relating to permissible uses of public resources;
and

WHEREAS, this policy also supplements the definition of necessary and
. reasonable expenses for purposes of federal and state income tax laws; and
WHEREAS, this policy also applies to any charges made to a City credit card,
cash advances, or other line of credit; and
WHEREAS, this policy also includes a requirement for ethics training for Poway
Officials required by AB1234 to have such training;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
That the City Council of the City of Poway does hereby adopt the attached Travel and
Meeting Reimbursement Policy.

at the regular meeting this ih day of February 2006.
