CA 958:: Prone: (916) 648-1717 Fax: 1.916) 922-0972 Email: CALi, CALIFORNIA FIREFIGHTER JONI APPRENTICESHIP COMM FIREFIGHTER CANDIDATE TESTING CENTER AGREEMENT This Agreement is made and entered into by and between the Firefighter Candidate Testing Center (FCTC), a licensed corporation of the State of California and a subsidiary of the California Firefighter Joint Apprenticeship Committee (Cal-JAC), and the Poway Fire Department (AGENCY). 1.0 — RECITALS FCTC will administer an entry-level firefighter candidate written exam, developed and validated by the CAL-JAC, on a quarterly basis (or more or Tess as necessary). From this exam, a Statewide Eligibility List (SEL) of qualified firefighter candidates will be developed and maintained by the CAL-JAC. Candidates on the statewide list will have met, at minimum, the following criteria: Be 18 years of age or older Possess a high school diploma or equivalent ▪ Possess a valid driver's license ▪ Receive a passing score on the FCTC written exam Possess a valid CaI-JAC Candidate Physical Ability Card (CPAT) 2.0 — TERMS FCTC will provide the SEL when requested by the AGENCY's authorized representative. The list will be transmitted to the AGENCY in alphabetical order. The AGENCY will receive the entire list of qualified candidates unless there is a request that only candidates meeting certain fire department minimum hiring qualifications be transmitted. FCTC will not provide the list sorted by rank, gender or ethnicity. It is understood that the AGENCY will use the SEL as its pre-employment list for the position of entry-level firefighter or firefighter paramedic only. FCTC must be notified immediately, by the AGENCY, when a candidate has accepted an offer of employment. The AGENCY will assume responsibility for the prospective employee chosen and hired by the AGENCY. 3.0 — WARRANTIES FCTC makes no warranties, expressed or implied with respect to the performance of the employee. Once the AGENCY approves the results of the pre-employment physical examination and written exam, the AGENCY relieves FCTC of all future rights and responsibilities relating to the performance of the prospective employee. 4.0 — COMPENSATION Participating CAL-JAC fire departments/agencies may view and hire from the SEL at no charge. If the AGENCY requires the establishment of its own list, testing and/or proctoring services, or other services not identified in this agreement, a separate quote for such services will be provided. 5.0 — TERMINATION The AGENCY may terminate this "Agreement" at any time and for a legitimate and verifiable reason upon thirty (30) days advance notice. FCTC may terminate this "Agreement" upon the breach of any provision by the AGENCY. 6.0 — CONTACTS The AGENCY will designate a responsible party to be the contact for FCTC and authorized to receive the SEL. In addition, the AGENCY will provide FCTC with a list of any additional representatives who are authorized to receive the SEL on behalf of the AGENCY. Individuals not named as a responsible party or agency representative are not authorized to receive the SEL.
