Resolution No. 90-172
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ACCEPTING THE DEDICATION
FOR STREET PURPOSES OF CERTAIN ONE-FOOT WIDE STRIP
OF LAND IN PORTIONS OF LOTS 17 AND 18,
WESTGATE UNIT NO.1, MAP NO. 6950
WHEREAS, on the final map of Westgate Unit No.1, Map No. 6950, therein was
offered for dedication for public street purposes certain one-foot wide strip of
land at the westerly end of Fairgate Drive, being portions of Lots 17 and 18 of
said map; and
WHEREAS, on said Map No. 6950, the Board of Supervisors of the County of San
Diego rejected said offer of dedication of said one-foot wide strip as
hereinafter more particularly described; and
WHEREAS, the State of California Government Code (Subdivision Map Act)
Section 66477.2(a) provides that a rejected offer of dedication shall remain
open and may be accepted by resolution at any later date; and
WHEREAS, said Section 66477.2(a) of the Government Code was referred to as
Section 11616 of the Business and Professions Code of the State of California at
the time of said map recordation on June 1, 1971; and
WHEREAS, upon incorporation on December I, 1980, the City of poway became
the successor in interest to the County of San Diego for said offer of dedica-
tion; and
WHEREAS, in 1988, the City of Poway constructed the street improvement on
Midland Road extension from poway Road to its connection to Fairgate Drive; and
WHEREAS, to provide unconditional through vehicular access rights to and
from Fairgate Drive to Midland Road and vice versa, it is in the best public
interest of the City of poway that said one-foot strip be now accepted for
pUblic street purposes.
NOW, THEREFORE, the City Council of the City of poway does resolve, deter-
mine, and order as follows:
1. The City of Poway hereby rescinds the rejection of said one-foot wide
strip, and does hereby accept for public use for street purposes those
portions of Lots 17 and 18 designated "Portions of Lots 17 and 18
Reserved for Future Street" on the final map of Westgate Unit No.1,
recorded on June I, 1971, as Map No. 6950, in the Office of the San
Diego County Recorder of San Diego County, California.

2. The City Clerk of the City of Poway is authorized and directed to cause
a certified copy of this resolution to be recorded in the Office of the
Recorder of San Diego County.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 28th day of August, 1990.
