GRANT OF EASEMENT
STORM DRAINAGE EASEMENT
Will iam T. Schneider, a married man (herei nafter "GRANTOR") hereby grants tD
CITY OF POWAY (hereinafter "GRANTEE") its successDrs, Dr assigns, the fDllDwing
described easement fDr a right-of-way 1S-feet in width, in, upon, Dver, under,
and acrDSS the lands described belDw, to erect, cDnstruct, recDnstruct,
replace, repair, maintain, and use a pipeline Dr pipelines fDr any and all pur-
poses, together with such fixtures and appurtenances, including, but nDt
limited to, facilities fDr power transmissiDn and cDmmunicatiDn purposes, at
such lDcatiDns and elevations, upDn, alDng, over and under the right-Df-way
described below as GRANTEE may now or hereafter determine in its sDle discre-
tion without any additiDnal compensation the ref Dr, tDgether with the right of
ingress and egress frDm the easement by a practical rDute or routes in, upDn
over Dr across the land described belDw, together with the right tD use this
easement for access to GRANTEE's rights-of-way situated in adjacent lands,
withDUt any additiDnal cDmpensatiDn therefor.
The land encDmpassing this easement is situated in the CDunty of San DiegD,
State of California, and is more particularly described as follows, tD wit:

GRANTOR, it heirs, succeSSDrs and assigns shall nDt erect or cDnstruct Dr per-
mit tD be erected or cDnstructed any building, structure or imprDvement Dn,
Dver or under any pDrtion Df the easement, nor shall GRANTOR, its heirs, suc-
cessDrs, or assigns, plant any tree Dr trees Dr plant any Dther vegetation Dr
flDra, nDr dig Dr drill any hDle or wells Dn any portiDn Df the easement.
GRANTOR may, in its sDle discretiDn, erect, maintain, Dr use gates in all
fences which nDW cross Dr later cross any portiDn Df the easement. GRANTEE
shall also be entitled to trim, cut, or clear away any trees, brush, or Dther
vegetation Dr flora from time tD time as GRANTEE determines in its sDle discre-
tion withDut any additiDnal cDmpensation.
GRANTOR agrees that no other easement or easements shall be granted on, under,
or Dver this easement without obtaining the prior written consent Df GRANTEE.
GRANTEE may at any time increase its use Df the easement, change the location
Df pipelines Dr Dther facilities within the boundaries Df the easement right-
Df-way, Dr modify the size Df existing pipelines Dr Dther imprDvements as it

may determine in its sole discretion from time to time without paying any addi-
tional cDmpensation to GRANTOR or GRANTOR's heirs, successors, Dr assigns, pro-
vided GRANTEE does not expand its use Df the easement beYDnd the easement
boundaries described above.
It is also understood and agreed by the parties that the GRANTOR and the
GRANTOR's heirs, successDrs, Dr assigns, shall not increase Dr decrease Dr per-
mit tD be increased Dr decreased the existing grDund elevations of the abDve
described easement which exists at the time this document is executed without
Dbtaining the prior written consent Df the GRANTEE.
In the event of any dispute involving this Agreement, whether or nDt litigation
is commenced, or if any arbitration proceeding, administrative prDceeding or
litigation in law or in equity, including an action fDr declaratDry relief, is
brDught to enforce Dr interpret the provisions Dr performance of this easement,
the prevailing party shall be entitled to an award of all attorney's fees and
the costs of the proceeding, which shall be determined by the court Dr the pre-
siding officer having authority to make this determination.
GRANTOR expressly warrants and represents that GRANTOR has the pDwer tD grant
this easement in accordance with its terms.
IN WITNESS WHEREOF, the GRANTO~s executed this easement
