Pursuant to Poway Municipal Code Section 17.08.180(A)(14) and in consideration of the approval of Building Permit B20-0971, a request to construct a detached Accessory Dwelling Unit ("ADU" hereinafter) at the above -referenced property, by the City of Poway ("CITY" hereinafter), OWNER hereby agrees that if either the main residence or the ADU is rented, the rental term shall be longer than 30 days. OWNER hereby agrees that the ADU encroaching into the setback area for the main residence must remain an ADU. On May 10th, 1988, Minor Conditional Use Permit 88-08 and Minor Development Review 88-39 were conditionally approved by the CITY to construct a habitable accessory structure, which still remains on the property. In accordance with Resolution P-88-61, the installation of kitchen facilities within this 735 -square -foot studio and renting the studio as a separate unit at the above referenced property is prohibited. Reference the San Diego County's Recorder's Office Document Number 88- 278108. This Covenant shall run with the land, inure to the benefit of and be binding upon Owner, future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties, and is hereby expressly declared to be enforceable by the City of Poway. In the event of litigation to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party.
