A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, ORDERING THE SUMMARY VACATION
OF PORTIONS OF A WATER UTILITY EASEMENT ON PARCEL
2 OF THE CITY OF POWAY TPM 06-04, PARCEL MAP NO. 21053
(VACATION NO. 20-004)
WHEREAS, the City Council of the City of Poway desires to summarily vacate portions of
a water utility easement in accordance with the procedures provided in Chapter 4, Part 3, Division
9 of the Streets and Highways Codes of the State of California, commencing at Section 8330;
WHEREAS, said portions of the water utility easement was dedicated to the City of Poway
through the recordation of a Grant of Water Easement, Document No. 2019-0343649; and
WHEREAS, a new water utility easement has been granted to replace the portions of the
water utility easement that are proposed for vacation.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
SECTION 1: This summary vacation is made under the provisions of Chapter 4, Part 3,
Division 9 of the Streets and Highways Code of the State of California.
SECTION 2: The City Council hereby finds that the portions of the herein below
described water utility easement have been superseded by relocation. (Section 8333(c)).
SECTION 3: The City Council hereby declares that the portions of the water utility
easement as described in Exhibit A and Exhibit B, attached hereto, is hereby vacated.

SECTION 4: The City Clerk of the City of Poway is hereby directed to cause this
Resolution to be recorded in the Office of the San Diego County Recorder in accordance with the
provisions of Section 8336 of the Street and Highways Code of the State of California.
PASSED, ADOPTED AND APPROVED at a Regular Meeting of the City Council of the
City of Poway, California, on the 19th day of January, 2021 by the following vote, to wit:
