A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
STATE OF CALIFORNIA, ORDERING THE SUMMARY VACATION OF
A SLOPE EASEMENT LOCATED WITHIN LOT 63 OF COUNTY OF
OF SAN DIEGO TRACT NO. 3864, MAP THEREOF 9766
RECORDED IN THE OFFICE OF THE COUNTY RECORDER OF
SAN DIEGO COUNTY ON AUGUST 20, 1980
(Vacation 90-04)
WHEREAS, the City Council of the City of poway desires to summarily vacate a
certain public easement in accordance with the procedures provided in Chapter 4,
Part 3, Division 9 of the Streets and Highways Code of the State of California,
commencing at Section 8330; and
WHEREAS, a slope easement within the attached legal description titled
"Exhibit A" was dedicated to the County of San Diego on Map No. 9766 recorded
August 20, 1980 in the Office of the County Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
1. This summary vacation is made under the prOV1Slons of Chapter 4, Part
3, Division 9 of the Streets and Highways Code of the State of
Cal ifornia.
2. The City Council hereby finds that the herein described slope easement
has become obsolete due to the development of the area.
3. The City Council hereby declares that the following described slope
easement is hereby vacated:
See attached legal description titled "Exhibit A."
4. The City Clerk of the City of poway is hereby directed to cause a cer-
tified copy of this resolution to be recorded in the office of the
Recorder of San Diego County in accordance with the provisions of
Section 8336 of the Streets and Highways Code.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 17th day of July, 1990.

That oortion of Lot 63 of San Diego Tract 3864, in the City of Poway, County of
San Diego, State of California, according to the Map thereof No. 9766, filed in
the Office of the County Recorder of San Diego County, August 20, 1980, more
particularly described as follows:
Beginning at the Southwest corner of said Lot 63, being the beginning of a
curve concave Northerly and having a radius of 793.00 feet, a radial line from
said.beginning bearing North 77014'16" East; thence Northerly along said curve,
through a central angle of 12011'57", a distance of 16B.84 feetL thence tangent
North 0033'47" West a distance of 372.68 feet: thence North 89 26'13" East a
distance of 10.00 feet: thence South 2040'IS"'East a distance of 541.03 feet;
