hereinafter called GRANTOR, do hereby grant, convey and dedicate to lhe CITY OF POW A Y,
a political subdivision of lhe STATE OF CALIFORNIA, hereinafter called GRANfEE, a
Biological Conservation easement to maintain an area for protection of sensitive plant species, wildlife
species and lheir natural habitats over, upon, and across that certain real property, in lhe City of Poway,
COImty of San Diego, State of California, described as follows :
A portion of lhe Soulheast Quarter of lhe Soulheast Quarter of Section 8, Township 14 South,
Range 1 West, San Bernardino Meridian, County of San Diego, State of California, according to
Official Plat lhereof,
Beginning at lhe Soulheast comer of said Section 8 lhence Northerly along lhe Easterly line lhereof
according to Record of Survey Map No, 8339 Recorded February 22, 1979 as File No, 79-078219
of 0, R. North 70 35' 13" East 20.00 feet to lhe TRUE POINT OF BEGINNING; lhence
continuing along said Easterly line North 70 35' 13" East 600,00 feet: lhence leaving said Easterly
line North 820 24' 47" West 251.20 feet; lhence Soulh 7035' 13" West 600,00 feet; lhence
Soulh 820 24' 47" East 251.20 feet to lhe TRUE POINT OF BEGINNING.
SEE ATTACHED EXHIBIT "A",
A) GRANTOR also grants lhe right to GRANfEE to enter upon lhe subject land and remove any
buildings, structures, or other things whatsoever constructed, erected, placed or maintained on lhe subject
land contrary to lhe purpose of lhe easement.
B) GRANTOR covenants and agrees for himself and his successors and assigns not to construct any
structure or olher thing whatsoever on lhe subject land.

C) GRANTOR covenants and agrees for himself and his assigns that he shall not excavate, clear, or place
sand, soil, rock, grave~ or other material whatsoever on the subject land. No cultivation, grazing, clearing,
or removal of vegetation shall be pennitted ( with the exception of brush clearing as required and
approved by the Poway Planning Department ),
D) The granting of this easement is for the purpose of controlling the use of the land within the
"Conse1Vation"'easement and does not authorize or imply that subject land may be used by the general
public.
E) GRANTEE shall release and vacate this easement if legislation and regulations are revised to deem the
easement not necessary or not legally required.
