GRANT OF EASEMENT
(DRAINAGE)
DANIEL KAUFMAN and MARCI KAUFMAN. Husband and Wife as Community ProDertv.
(hereinafter "GRANTOR") hereby grants to CITY OF POWAY (hereinafter "GRANTEE")
its successors, or assigns, an easement for roadway slopes and drainage
structures, over and across that certain real property in the City of Poway,
County of San Diego, State of California, described as follows:
(See Attached Legal Description and Exhibit Plat)
The Grantor hereby reserves for himself and his successors or assigns, the
right to eliminate such slopes and/or drainage structures or portions thereof,
when in the written opinion of the City Engineer of Grantee, the necessity
therefore is removed by substituting other protection, support and/or drainage
facility, provided such substitution is first approved in writing by said
Engineer.
The Grantor hereby further grants to Grantee all trees, growth (growing or
that may hereafter grow) and road building materials within said easement,
including the right to take water, together with the right to use the same in
such manner and at such locations as said Grantee may deem proper, needful or
necessary, in the construction, reconstruction, improvements or maintenance of
said roadway.
The Grantor, for him/herself, his/her successors and assigns, hereby waives
any claim for any and all damages to Grantor's remaining property contiguous
to the easement hereby conveyed by reason of the location, construction,
landscaping or maintenance of said roadway.

LEGAL DESCRIPTION
An Easement for Drainage purposes in, on, over, under, and across that portion of said
Kaufman described land included within a strip 20.00 feet wide, lying 10.00 feet on each side
of the following described centerline:
Beginning at a point on the Northerly line of said Kaufman land, said line also being the
Southerly line of Vali Hai Road (40.00 feet wide), said point being North 86019'26 East, as
measured along said existing right of way line, a distance of 97.77 feet from the Northwest
comer of said Kaufman land;
Thence South 23042'49" East a distance of 43.29 feet to the terminus of this line description.
The sideline of herein described strip shall terminate Northwesterly in said existing right of way
line of Va Ii Hai Road, and Southeasterly at right angles to herein described centerline.
Containing 866 sq. ft, more or less.
Attached hereto and made a part of this legal is a plat designated as Exhibit B.
This legal description was prepared by me, or under my supervision on December 22,1995.
