COVENANT REGARDING REAL PROPERTY
The First Baptist Church of Poway, California, a corporation ("OWNER' hereinafter) Is the owner of
real property described In Exhibtt A which Is attached hereto and made a part hereof and which Is
commonly known as Assessor's Parcel Number 317-110-45, 62, 70 and 71 ("PROPERTY" hereinafter). In
consideration of the approval of Environmental Assessment and Modification to Major Use Permtt P62-
188(M) and Development Review 95-15 by the City of Poway ("CITY" hereinafter), OWNER hereby agrees
to abide by condttlons of the attached resolution (Exhibtt B).
This Covenant shall run wtth the land and be binding upon and Inure to the beneftt of the future
owners, encumbrancers, successors, heirs. personal representatives, transferees and assigns of the
respective parties.
In the event that anvlronmental Assessment and Modification to Major Use Permtt P62-188(M) and
Development Review 95-15 expires or is rescinded by City Council at the request of the OWNER. CITY shall
expunge this Covenant from the record title of the PROPERTY.
If etther party Is required to Incur costs to enforce the provisions of this Covenant, the prevailing
party shall be entitled to full reimbursement of all costs, Including reasonable attorneys' fees, from the other
party. The CITY may assign to persons Impacted by the performance of this Covenant the right to enforce
this Covenant against OWNER.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING MAJOR USE PERMIT P62-188(M)
DEVELOPMENT REVIEW 95-15
ASSESSOR'S PARCEL NUMBER 317-110-45,62,70 AND 71
WHEREAS, Major Use Permit P62-188(M) and Development Review 95-15,
submitted by First Baptist Church of Poway, requests approval to expand the
present church complex in four phases, for the property located at 13604 Midland
Road, in the RS-7 zone; and
WHEREAS, on February 13, 1996, the City Council held a hearing on the above
referenced item.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Environmental Findinos:
The City Council hereby issues a Negative Declaration with mitigation in
the areas of Hydrology and Transportation.
Section 2: Findinos:
Maior Use Permit P62-1881Ml
1. The proposed project is consistent with the general plan in that
churches are permitted to located within all residential zones with
the benefit of a conditional (major) use permit.
2. That the location, size, design, and operating characteristics of
the use will be compatible with and will not adversely affect or be
materially detrimental to adjacent conrnercial uses, residents,
buildings, structures, or natural resources in that the church has
operated compatibly on the present site since 1962. More land has
been purchased to provide room for needed off-street parking to
accommodate growth.
3. That the scale, bulk, coverage, and density is consistent with the
adj acent uses, in that there are two story apartments on the
adjoining lot to the south, a new church complex under construction
directly across Midland Road at Cynthia Lane, which are similar in
size and building massing on the lot. There are conrnercia1 uses to
the north and east.
4. That there are available public facilities, services, and utilities
to serve the use.
5. That there will not be harmful effects upon desirable neighborhood
characteristics, in that churches provided needed support services
within the community, including meeting facilities for non-profit
community groups.

6. That the generation of traffic will not adversely impact the
surrounding streets and/or the City's Transportation Element in that
the church will provide all needed off-street parking within its
property. Needed improvements to Agsten Lane, a private road will
be accomplished in the process of church expansion.
7. That the site is suitable for the type and intensity of use as this
project is the expansion of an existing church which has existed on
the present site for RIOre than thirty years. The property is a
corner lot, on Midland Road, across the street from another church.
8. That there will not be significant harmful effects upon the
env i ronmenta 1 qual i ty and natural resources in that the site is
completely developed, and contains no native plants or animals.
9. That there are no other relevant negative impacts of the use that
cannot be mitigated.
Develooment Review 95-15
I. The approved project is consistent with the General Plan as
discussed above.
2. That the approved project will not have an adverse aesthetic,
health, safety, or architecturally related impact upon adjoining
properties in that it will be located on a corner lot, across the
street from another church. All city development standards will be
met.
3. That the approved project encourages the orderly and harmoni ous
appearance of structures and property within the City in that the
building designs are reflective of the Old Poway Historic District
theme.
*Environmental mitigation measures are indicated by the use of *asterisks.
Section 3: City Council Decision:
The City Council hereby approves Modification of Major Use Permit P62-
188(M) and Development Review 95-15, subject to the following conditions:
Within 30 days of approval (1) the applicant shall submit in writing that
all conditions of approval have been read and understood; and (2) the
property owner shall execute a Covenant on Real Property.
The use conditionally granted by this permit shall not be conducted in
such a manner as to interfere with the reasonable use and enjoyment of
surrounding residential and commercial uses.
This conditional use permit shall be subject to annual review by the Director of
Planning Services for compliance with the conditions of approval and to address

concerns that ~ay have occurred during the past year. If the permit is not in
compliance with the conditions of approval, or the Planning Services Department
has received complaints, the required annual review shall be set for a public
hearing before the City Council, to consider modification or revocation of the
use permi t.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF PLANNING SERVICES.
SITE DEVELOPMENT
I. Site shall be developed in accordance with the approved site plans on file
in the Planning Services Department and the conditions contained herein.
2. Revised site plans and building elevations incorporating all conditions of
approval shall be submitted to the Planning Services Department prior to
issuance of building permits.
3. Approval of this request shall not waive compliance with all sections of
the Zoning Ordinance and all other applicable City Ordinances in effect at
the time of building permit issuance.
4. Trash receptacle shall be enclosed by a six foot high masonry wall with
vi ew-obstruct ing gates pursuant to Ci ty standards. location shall be
subject to approval by the Planning Services Department.
5. All roof appurtenances, including air conditioners, shall be
architecturally integrated, screened from view and sound buffered from
adjacent properties and streets as requi red by the Pl anning Servi ces
Department.
6. A sound attenuation wall shall be constructed along the western property
line in the vicinity of the adjacent dwelling unit to the satisfaction of
the Director of Planning Services and a solid wood fence shall be
constructed along the remainder of the property line.
7. Prior to any use of the new building space, all conditions of approval
contained herein shall be completed to the satisfaction of the Director of
Planning Services.
8. The applicant shall comply with the latest adopted Uniform Building Code,
Uniform Mechanical Code, Uniform Plumbing Code, National Electric Code,
Uniform Fire Code, and all other applicable codes and ordinances in effect
at the time of building permit issuance.
9. This approval shall become null and void if building permits are not
issued for this project within two years from the date of project
approval.
PARKING AND VEHICULAR ACCESS
1*. Parking lot expansion shall take place with Phase I of the project in
order to provide sufficient parking for expanded activities which will
result from the enlargement of the facility.
2. All parking lot landscaping shall include a minimum of one IS gallon size
tree for every three spaces. For parking lot islands, a minimum 12 inch

wide walk adjacent to parking stalls shall be provided and be separated
from vehicular areas by a six inch high, six inch wide portland concrete
cement curb.
3. Parking lot lights shall be low pressure sodium and have a maximum height
of 18 feet from the finished grade of the parking surface and be directed
away from all property lines, adjacent streets and residences.
4. All two-way traffic aisles shall be a minimum of 25 feet wide. A minimum
of 24 feet wide emergency access shall be provided, maintained free and
clear at all times during construction in accordance with Safety Services
Department requirements.
5. All parking spaces shall be double striped.
LANDSCAPE IMPROVEMENTS
1. Comp1 ete 1 andscape construction documents shall be submi tted to and
approved by the Planning Services Department prior to the issuance of
building permits. Plans shall be prepared in accordance with City of
Poway Guide to Landscape Requirements (latest edition).
2. A Master Plan of the existing on-site trees shall be provided to the
Planning Services Department prior to the issuance of building permits and
prior to grading, to determine which trees shall be retained.
3. Existing on-site trees shall be retained wherever possible and shall be
maintained in a horticulturally acceptable manner. Dead, decaying, or
potentially dangerous trees shall be approved for removal at the
discretion of the Planning Services Department during the review of the
Master Plan of existing on-site trees. Living trees which are approved
for removal shall be replaced on a tree-for-tree basis as required by the
Planning Services Department.
4. Street trees, a minimum of 15 gallon size or larger, shall be installed in
accordance with the City of Poway Guide to Landscape Requirements and
shall be planted at an average of 30 feet on center spacing along all
streets.
5. Landscaped areas within the adjacent public right-of-way shall be
permanently and fully maintained by the church.
6. All landscaped areas shall be maintained in a healthy and thriving
condition, free from weeds, trash, and debris. The trees shall be
encouraged and allowed to retain a natural form. Pruning should be
restricted to maintain the health of the trees and to protect the public
safety. Unnatural or excessive pruning, including topping, is not
permitted.

Any signs proposed for this development shall be designed and approved in
conformance with the Sign Ordinance.

EXISTING STRUCTURES
Existing sewage disposal facilities shall be removed, filled and/or capped
to comply with appropriate grading practices and the Uniform Plumbing
Code.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF ENGINEERING SERVICES.
GRADING
I. Grading of the subject property shall be in accordance with the Uniform
Building Code, City Grading Ordinance, approved grading plan and
geotechnical report, and accepted grading practices.
2. A soils report shall be prepared by a qualified engineer licensed by the
State of California to perform such work.
3. The final grading plan, prepared on a standard sheet of ~lar, shall be
subject to review and approval by the Planning and Engineering Services
Departments and shall be completed prior to issuance of building permit.
4. A pre-blast survey of the surrounding property shall be conducted to the
satisfaction of the City Engineer prior to any rock blasting. A blasting
permit shall be obtained from the Engineering Services Department prior to
any rock blasting. Seismic Recordings shall be taken for all blasting and
blasting shall occur only at locations and levels approved by the City
Engi neer.
5. All new slopes shall be a minimum of 2:1 (horizontal to vertical).
6. A fi na 1 compact i on report shall be submitted and approved pri or to
issuance of building permits.
7. A certification of line and grade, prepared by the project civil engineer,
shall be submitted prior to issuance of building permits.
8. Buildings and parking lots shall be at least five feet from tops and toes
of slopes, unless waived by Planning and/or Engineering Services
Departments prior to grading permit issuance.
9. Non-supervised or non-engineered fill is specifically not allowed. Rock
<.Iisposal areas shall be graded in compliance with City-approved soils
investigations and recommendations and grading plans.
10. Erosion control, including but not limited to desiltation basins, shall be
installed and maintained from Oct. 15th to April 15th. An erosion control
plan shall be prepared by the project civil engineer and shall be
submitted as part of the grading plan. The developer shall make
provisions to insure the proper maintenance of all erosion control devices
throughout their intended life.
11. Paving of the new parking lot shall be in accordance with the
specifications for cOlllllercial use per Section 12.20.080 of the Poway
Municipal Code.

STREETS AND SIDEWALKS
1. The Southerly 35.00 feet of the 60.00-foot wide Agsten Lane, contiguous
with the property's boundary, shall be improved as follows:
A. From Midland Road to a point 3.00 feet west of the westerly sideline of
the new driveway shall be improved to a roadway width of 24.00 feet
minimum with concrete curb and gutter on the Southerly side and an AC
berm on the Northerly side. The minimum structural section for paving
of the street shall be in accordance with the specifications for Non-
dedicated Rural Street (Local) standards per Sections 12.20.110 and 120
of the Poway Municipal Code.
The above improvements shall be completed prior to occupancy of the first
building of this development review application.
2. Remove and replace existing broken concrete curb, gutter, and sidewalk
along the property's frontage on Midland Road. It shall be completed prior
to issuance of a certificate of occupancy of the first building of this
development review application.
3. Improvement plans for streets and any other public utility lines, prepared
on standard sheets of mylar by a Registered Civil Engineer shall be
submitted for approval by the Director of Engineering Services. Plan
check and inspection fees shall be paid by the developer/applicant.
4. All damaged off-site publ ic works facil ities, including parkway trees,
shall be repaired and replaced prior to exoneration of bonds and
improvements, to the satisfaction of the Director of Engineering Services.
5. The developer shall acquire an encroachment permit for any private
improvements placed within the public right-of-way.
6. Prior to any work performed in the publ ic right-of-way or City-held
easements, a right-of-way permit shall be obtained from the Engineering
Services Department and appropriate fees paid, in addition to any permits
required.
DRAINAGE AND FLOOD CONTROL
1. Intersection drains shall be required at locations specified by the
Director of Engineering Services and in accordance with standard
engineering practices.
2. Portland cpment concrete gutters shall be installed where water crosses
the roadways.
3. Concentrated flows across driveways and/or sidewalks shall not be
permitted.
4. Existing drainage devices that would be affected by improvements to the
parking lot and Agsten Lane shall be respectively improved to City
standards. Improvement shall include but is not to be limited to the
extension, if needed, of the underground drainage pipelines in Agsten Lane
and appurtenant structures.

5. The applicant shall pay the respective drainage fees prior to issuance of
a building permit on each of the parcels as follows:

The above fees were established by City Ordinance No. 247, adopted June 7,
1988 and as contained in the Final, Revised Drainage Report for Midland
8asin, prepared by BSI consultants on April 20, 1988.
UTILITIES
I. All proposed electrical/communication/CATV utilities within the project
(lines between the structures and the nearest pole) shall be installed
underground. The property owner shall record a deed covenant agreeing
not to oppose an undergrounding district and to pay a pro rate share of
future undergrounding costs. The covenant shall be completed and recorded
prior to issuance of building permits.
2. Utility easements shall be provided to the specification of the serving
utility companies and the Director of Engineering Services.
3. The developer shall be responsible for the relocation and undergrounding
of existing public utilities as required.
4. Water, sewer, and fire protection systems shall be designed and
constructed to meet the requirements of the City of Poway.
5. New water lines, when required by the City's Fire Marshal for fire hydrant
installation, shall have a water system analysis prepared to establish the
proper size and location of the public water system. Said analysis shall
be paid for by the applicant upon demand by the City. The amount shall be
determined by the cost of the analysis and shall be paid prior to
submittal of improvement plans.
6. Within 30 days after receiving City Council approval of the project, the
applicant shall apply for a Letter of Availability (LOA) to reserve
sewerage availability for 16.50 EDU's and post with the City, a
nonrefundable reservation fee equal to 20% of the sewerage connection fee
in effect at the time the LOA is issued. The remaining fee shall be paid
prior to issuance of a building permit on each of the five phases herein
below mentioned. Payment of total sewer fees shall be made within 2
years, per City Ordinance No. 83, unless time extension is granted by the
City.

The total number of sewer EDU's is calculated from the total number of 66
fixture units as provided by the applicant. The calculation was based on
1 EDU/4 fixture units. Breakdown of sewer EDU's is as follows:
7 EDU's - Phase 1 (New Fellowship Hall and existing sanctuary)
5.50 EDU's - Phase II (Nursery/Preschool and Preschool/Classroom Buildings)
3 EDU's - Phase II I (Sanctuary Renovation)
o EDU - Phase IV (Sanctuary/Balcony In-fill)
1 EDU - Phase V (Preschool/Sanctuary Addition)
Prior to payment of the sewer fees, the appl icant shall provide the
Engineering Services Department with a copy of the building plans (working
drawings) for verification of the actual number of fixture units. The
total sewer EDU's may change and the corresponding payments shall be
adjusted accordingly.
8. Existing telephone, gas, electric, water, sewer, and other public utility
lines and appurtenances shall be shown on the grading/improvement plans.
9. All on-site private sewer mains shall be constructed to public sewer
standards and specifications and shall be shown on the grading/improvement
plans.
10. Water and sewer main lines and appurtenances that will be installed at
locations other than within public streets shall have an easement, a
minimum of 20 feet wide for each line, dedicated to the City of Poway.
Dedication shall be made prior to issuance of a certificate of occupancy
of the first building of this development review application.
Easement dedication to the City is subject to a processing fee to be paid
at submittal of the easement document for review by the Engineering
Services Department.
11. All public utility lines (i.e., water, sewer, drainage) not located within
public streets shall have an improved access over and along the respective
easement, the surfacing and width of which shall be acceptable to the City
Engineer.
OTHER REOUIREMENTS
1. A covenant of property merger for those parcels identified as APN 317-110-
45 and APN 317-110-71 shall be completed prior to issuance of a building
permit for the Fellowship Hall Building (Phase I). The merger is needed
to meet the Planning Services Department's minimum building setback
requirement.
A processing fee shall be paid to the Engineering Services Depa;'tment at
submittal of application for the merger. Contact the Engineering Services
Department for submittal requirements.

2. A traffic mitigation fee of $1461.91 shall be paid to the City prior to
issuance of a permit for the first building to be built in this
development review application.
3. Should there be a need for additional water meter installation and/or
sewer lateral construction, appropriate fees shall be paid to the City's
Engineering Department prior to said installation and/or construction.
COMPLIANCE WITH THE FOLLOWING CONDITIONS IS REQUIRED. COMPLIANCE SHALL BE
APPROVED BY THE DEPARTMENT OF SAFETY SERVICES.
1. Roof covering shall meet Class A fire retardant testing as specified in
the Uniform Building Standards No. 32-7 for fire retardant roof covering
materials, per City of Poway Ordinance No. 64.
2. The buildings shall display their numeric address in a manner visible from
the access street. Building addresses shall also be displayed on the roof
in a manner satisfactory to the Director of Safety Services, and meeting
Sheriff's Department - ASTREA criteria. Minimum size of building numbers
is 6 inches on facade of building.
3. Every bUilding hereafter constructed shall be accessible to Fire
Department apparatus by way of access roadways with all-weather driving
surface of not 1 ess than 20 feet of unobstructed width, wi th adequate
roadway turning radius capable of supporting the imposed loads of fire
apparatus having a minimum of 13'6" of vertical clearance. The road
surface type shall be approved by the City Engineer, pursuant to City of
Poway Municipal Code.
4. The buildings will be required to have installed within them an approved
fire sprinkler system meeting P.M.C. requirements. The entire system is
to be monitored by a central monitoring company. System post indicator
valves with tamper switches, also monitored, are to be located by the City
Fire Marshal prior to installation.
5. Prior to delivery of combustible building material on site, water and
sewer systems shall satisfactorily pass all required tests and be
connected to the public water and sewer systems. In addition, the first
lift of asphalt paving shall be in place to provide adequate, permanent
access for emergency vehicles. The final lift of asphalt shall not be
installed until all other construction activity has been substantially
completed to the satisfaction of the City.
6. An automatic fire alarm system shall be installed to approved standards by
a properly 1 icensed contractor. System shall be compl etely monitored by
a U.L. listed central station alarm company or proprietary remote station.
7. A hood and duct extinguishing system shall be installed for all cooking
facilities within the kitchen area. Plans to submitted and approved prior
to installation.
8. A 'Knox' security key box shall be required for the building at a location
determined by the City Fire Marshal. A 'Knox' padlock shall be required
for the fire system Post Indicator Valve.

9. Fire Department access for use of fire fighting equipment shall be
provided to the immediate job construction site at the start of
construction and maintained at all times until construction is completed.
10. Permanent access roadways for fire apparatus shall be designated as 'Fire
Lanes' with appropriate signs and curb markings.
11. Minimum 2A:IOBC fire extinguishers are required to be placed for every
3,000 square feet and 75 feet of travel distance.
12. If an elevator is installed, it shall be sized to accommodate a normal
hospital gurney. Minimum dimensions for the inside car platform shall be
6'S" wide by 4'3" deep.
13. The addition of on-site fire hydrants is required. The location of the
hydrants shall be determined by the City Fire Marshal.
14. Retrofit of existing church facilities shall conform to Poway Municipal
Code Chapter 15.24.340, Section 2:
Where an exi st ing buildi ng or structure is not protected by an
automatic fire extinguishing system, but would otherwise be required to
be protected if built as a new building, its use will be allowed to
continue until such time as any structural change takes place which
modifies, alters, or affects any bearing wall or similar structural
assembly at which time it shall be made to conform to the provisions of
this code.
APPROVED and ADOPTED by the City Council of the City of Poway, State of
California, this 13th day of February 1996.
