CC 2006 03-07 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING MARCH 7, 2006 The March 7, 2006, Regular Meeting of the City Council of the City of Poway, was called to order at 7:02 p.m. by Mayor Cafagna at the Poway City Council Chambers, 13325 Civic Center Drive, Poway, California, for a Regular City Council Meeting. CITY COUNCILMEMBER ANNOUNCEMENTS A. Poway Bob's Restaurant Review. No restaurant review was given. PUBLIC ORAL COMMUNICATIONS Mayor Cafagna explained the procedures for Public Oral Communications. The following people spoke: Dee Fleischman, Poway, spoke on her concerns regarding the 8-foot-high wall and intrusive lights at Midland School. Allen Sterger, Poway, expressed his frustration over the left-turn lane project at Mina de Oro still being in the pre-design process. He and three (3) of his neighbors paid a total of $28,000 toward this project to the City in 2000 and felt a refund to them was in order. The Council referred this item to staff to bring back a project update with projected timelines. Mr. Sterger will be notified when this item returns to the City Council. 8597 Page 2 - CITY OF POWAY - March 7, 2006 Jared Rayburn, Poway, asked the City Council to waive the requirement to wear safety helmets in the Poway Skate Park for skateboarders 18 years of age and older. Gabriel Ho, owner of Poway Shell Gas Station, spoke on his inability to qualify for redevelopment funds because he is a national tenant and asked why other businesses in the same shopping center, that he considers national tenants, are receiving those funds. He asked for review of this process. CONSENT CALENDAR: Motion by Councilmember Higginson and seconded by Councilmember Emery to approve the Consent Calendar, Items 2 through 12, except Item 7 which was removed at the request by a member of the public for discussion. 2. Ratification of Warrant Reqisters for the periods of January 30 - February 3,2006 and February 6 - February 10, 2006. (0475-20) 3. Approval of Minutes - City Council February 7,2006 Regular Meeting February 14, 2006 Canceled Regular Meeting 5. Approval of Citv's Investment Report as of January 31,2006. (0450-80) 6. Adoption of Resolution No. P-06-13, entitled: "A Resolution of the City Council of the City of Poway, California Approving Temporarv Use Permit 06-05 to hold the Rendezvous in Poway 2006." The event is to be held at Old Poway Park, located at 14134 Midland Road on Friday, March 10,2006 from 9:00 a.m. to 4:00 p.m., on Saturday, March 11,2006 from 10:00 a.m. to 4:00 p.m., and on Sunday, March 12, 2006 from 10:00 a.m. to 2:00 p.m. APN: 314-202-19. (0210-60) 7. Reiection of Claim for Damages (1) - Gerrit Vander Ziel. (0190-10) This item was removed from the Consent Calendar at the request of the complainant. Gerrit Vander Ziel, Poway, asked the Council to consider his written statement submitted. Harold Padden, Poway, spoke on in support of Mr. Vander Zeils's concerns about the construction at the Ner Tamid Synagogue project. Motion by Council member Emery and seconded by Council member Boyack to reject the claim as submitted. Motion carried 4-0 with Deputy Mayor Rexford absent. 8. Adoption of Resolution No. 06-010, entitled: "A Resolution of the City Council of the City of Poway, California, Ordering the Expansion of Powav Landscape Maintenance District 86-3B and Poway Lighting District, Zones A and C with the Annexation of APN: 317-101-53 with Written Consent of Property Owner and Lessee." The property owner is the Poway Redevelopment Agency and the Lessee is Community Road Housing Associates, L.P. (0760-2010760-30) 8598 Page 3 - CITY OF POWAY - March 7, 2006 9. Approval of Final Map for Tentative Parcel Map (TPM) 03-04 and acceptance of the Janette Lane improvements, as Offered for Dedication on the Final Map, for the property located at 13679 Somerset Road. Danny and Antonia Gallipoli, Owners. APN: 314-242-08. (0200-50) 10. Approval of Final Map for Tentative Parcel Map (TPM) 04-03 and acceptance of public water, public access, public pedestrian access, and public utility easements as dedicated on the Final Map for the property located at the southerly terminus of Community Road. Tech Business Center, LLC, Owner. APN: 320-220-19. (0200-50) 11. Adoption of Resolution No. 06-011, entitled: "A Resolution of the City Council of the City of Poway, California, Commending Eaqle Scout Jason Edward Jensen;" Adoption of Resolution No. 06-012, entitled: "A Resolution of the City Council of the City of Poway, California, Commending Eaqle Scout Tanner McKav Konold;" and Adoption of Resolution No. 06-013, entitled: "A Resolution of the City Council of the City of Poway, California, Commending Eaqle Scout Beniamin S. Rollins." (071040) 12. Award of Contract to Aztec Janitorial Service in the amount not-to-exceed $77 ,000 for the first contract year for bus stop facility cleaning and maintenance services. (0700-80) Motion carried 4-0 with Deputy Mayor Rexford absent. CONTINUED PUBLIC HEARINGS: ITEM 1 (0520-20 #634) ORDINANCE NO. 634 - SECOND READING AMEND POWAY MUNICIPAL CODE SEC. 2.04.020 CITY COUNCIL COMPENSATION Mayor Cafagna read the title of the ordinance. On February 21, 2006, the City Council introduced Ordinance No. 634 that increases the Councilmembers' monthly salaries by $98.67. The salary increase will not be effective until after the November 2006 Municipal Election when the new City Council is sworn in. Government Code 936516 states that a change in compensation does not apply to a councilmember during his or her term of office. However, the compensation of all members of a city council serving staggered terms can be adjusted by virtue of the beginning of a new term of office for a single member. All Councilmembers were present at the first reading and no public testimony was given. There was no one present wishing to speak. Motion by Council member Higginson and seconded by Councilmember Emery to adopt Ordinance No. 634 entitled, "An Ordinance of the City of Poway, California, Amending Title 2, Chapter 2.04 of the Poway Municipal Code by the Amendment of Section 2.04.020 to Increase the Compensation of the Members of the City Council and the Mayor." Motion carried 4-0 by a roll call vote with Deputy Mayor Rexford absent. 8599 Page 4 - CITY OF POWAY - March 7, 2006 MAYOR AND CITY COUNCil-INITIATED ITEMS 15. Council member Boyack asked staff to follow-up on pedestrians crossing mid-street on Community Road at Wal-Mart creating a potentially unsafe condition. 16.
