RESOLUTION NO. 06 -052
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
APPROVING AN ADJUSTMENT TO EDCO WASTE AND RECYCLING SERVICES'
RATE SCHEDULE PURSUANT TO THE PROVISIONS OF THE SOLID WASTE
FRANCHISE AGREEMENT, AND RESCINDING RESOLUTION NO. 05-039
WHEREAS, Section 40059 of the Public Resources Code provides that each city
may determine all aspects of solid waste handling which are matters of local concern,
including charges and fees; and
WHEREAS, the City Council awarded an exclusive Solid Waste Franchise
Agreement to Mashburn Waste and Recycling Services (Contractor) on September 21,
1994, which was assigned to EDCO Disposal Corporation upon City Council approval on
July 28, 1998; and
WHEREAS, the City has broad discretion to set the amount of the franchise fee,
pursuant to Section 8.68.340 of the Poway Municipal Code and Section 49300 of the
Public Resources Code; and
WHEREAS, the City of Poway has initiated a special rate review pursuant to
Section 8.4 of the Franchise Agreement; and
WHEREAS, EDCO Waste and Recycling Services' current rate schedule has been
revised to reflect the effects of a change in the franchise fee from five percent (5%) to ten
percent (10%) of the gross receipts from the collection and disposal of refuse or from the
collection and sale of recyclable materials earned by the Contractor under the Franchise
Agreement during each fiscal year ending June 30, or fraction thereof, that this
Agreement is in effect.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1. Resolution 05-039 is hereby rescinded.
Section 2. Section 4.3 of the Solid Waste Franchise Agreement is hereby
amended to read: "The Contractor agrees to pay to the City a franchise fee
of ten (10) percent of the gross receipts ("Gross Receipts" shall mean all
gross income or gross revenues received by Grantee from the collection
and disposal of refuse or collection and sale of recyclable materials) earned
by the Contactor under this Agreement during each fiscal year ending June
30, or fraction thereof, that this Agreement is in effect. Said sums shall be
payable quarterly on or before the 15th day of January, April, July, and
October throughout the duration of this Agreement and the total amount
paid each year shall be appropriately adjusted based on the annual reports
required by this Agreement. The sums herein agreed to be paid to the City
by the Contactor shall be in lieu of any and all business license, permit or
truck fees that are collected by the City.

Section 3. The City Council hereby sets the solid waste franchise fee to be
collected by the Contractor and paid to the City at ten (10) percent of the
gross receipts from the collection and disposal of refuse or from the
collection and sale of recyclable materials.
Section 4. The attached "Schedule of Maximum Rates to be Charged and
Collected for Collection Services of Garbage or Rubbish in the City of
Poway, July 1, 2006," is hereby adopted as shown in Exhibit A.
Section 5. The fees adopted herein are for the exclusive right to collect
from and charge Poway customers for solid waste, recyclables, yard waste,
compostables, and other services at rates fixed by the City Council from
time to time.
Section 6. The attached "Schedule of Maximum Rates to be Charged and
Collected for Collection Services of Garbage or Rubbish in the City of
Poway" shall be implemented on July 1, 2006, to correspond with the next
regular billing cycle following the effective date of the rate increase.
PASSED, ADOPTED, AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting this 20th day of June, 2006.
