CC 2006 04-11 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING APRIL 11, 2006 The April 11, 2006, Regular Meeting of the City Council of the City of Poway, was called to order at 7:07 p.m. by Mayor Cafagna at the Poway City Council Chambers, 13325 Civic Center Drive, Poway, California, for a Regular City Council Meeting. CITY COUNCILMEMBER ANNOUNCEMENTS A. Poway Bob's Restaurant Review. Councilmember Emery reviewed Round Table Pizza noting its long-standing popularity for youth sports parties and its excellent pizza. B. Deputy Mayor Rexford attended the Midland School ceremony and was presented with pictures of Midland School before and after the renovation. She also attended the Earth/Arbor Day festivities. C. Councilmember Boyack stated the Earth Day event was excellent. PUBLIC ORAL COMMUNICATIONS Gail Trunnell, Poway, commented on the San Diego County's public meeting on benzene gas emissions detected at the old landfill site near Garden Road. She asked Council to stay up- to-date on this issue. She also said she likes the weekly Council meeting over the pilot program schedule. Dee Fleischman, Poway, voiced her concerns on the five-lot development on Midland Road. 8624 Page 2 - CITY OF POWAY - April 11, 2006 WORKSHOP ITEMS ITEM 1 (0700-10) 2006 RESIDENT SATISFACTION SURVEY REPORT OF FINDINGS Paolo Romero, Management Analyst, City Manager's Office, stated that at its February 21, 2006, City Council meeting, the Council authorized the City Manager to execute a contract with Godbe Research to conduct the 2006 Resident Satisfaction Survey to assess resident opinion and satisfaction with the quality of life in Poway. Additionally, the study was to gauge views on specific City services and issues facing the community. Brian Godbe and Jaime Barrett of Godbe Research were on hand to present a report with an executive summary of the important findings, conclusions and recommendations, a question-by-question summary of data, and a complete set of cross-tabulations. This information will be used by staff to continue to analyze the information garnered from the survey to develop work plans that will address the community issues and needs expressed by the residents. The City Council heard the presentation and directed the report be filed. ITEM 2 (0400-95) CITY OF POWAY FINANCIAL POLICIES Tina White, Director of Administrative Services, presented the staff report and asked the City Council to consider formalizing financial policies. The proposed policies would provide guidelines against which budgetary performance can be measured, and proposals for future programs can be evaluated. Motion by Council member Emery and seconded by Deputy Mayor Rexford to direct staff to meet with the Budget Review Committee to establish formal policies and bring the item back to a future City Council meeting with an approving resolution. Motion carried unanimously. ITEM 3 (0710-95) PROPOSED CODE OF ETHICS Kristen Crane, Assistant to the City Manager, presented the staff report. An ethics code provides a framework for day-to-day actions and decision-making by those in public office. While the City of Poway and its representatives have been and remain models of professional and ethical conduct, codifying existing practices will help ensure these practices continue in the future. The Code of Ethics proposed for Poway emphasizes values as opposed to rules and identifies examples of behaviors that reflect the values. It is proposed that the Code of Ethics would apply to City of Poway elected officials, officers, employees, members of committees and commissions, and volunteers. Motion by Council member Boyack and seconded by Councilmember Emery to conceptually approve the Code of Ethics and directed it be brought back at a future meeting with an approving resolution. Motion carried unanimously. 8625 Page 3 - CITY OF POW A Y - April 11, 2006 ITEM 4 (0720-10) AB1234 PHASE 1 TRAINING: CONFLICTS OF INTEREST AND PERSONAL FINANCIAL GAIN Interim City Attorney Lisa Foster presented a training session to the City Council and staff. AB 1234, a new state law enacted October 7, 2005 (Government Code section 53235), requires all local officials, such as City Councilmembers and district governing board members, to receive two hours of mandatory ethics training every two years. The training presented at this meeting was the first phase of the two-part training covering topics related to conflicts of interest and personal financial gain. The second hour oftraining will be presented at a future City Council Workshop. The City Council received the training as presented by the Interim City Attorney. CITY ATTORNEY ITEMS 6. Interim City Attorney Foster requested a closed session for the following: A. Conference with Legal Counsel - Existing Litigation Government Code 54956.9a Gagliano Family Trust vs. City of Poway San Diego Superior Court Case No. GIC 847242 CLOSED SESSION Mayor Cafagna called for a Closed Session at 7:18 p.m. as requested by the Interim City Attorney. CALL TO ORDER AND ADJOURNMENT Mayor Cafagna called the meeting back to order at 7:30 p.m. with all Councilmembers present. There was no reportable action taken in Closed Session.
