CC 1993 03-09 CITY OF POWAY, CALIFORNIA HINUTES OF THE CITY COUNCIL REGULAR HEETING NARCH 9, 1993 The March 9, 1993, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PRESENTATION Mayor Higginson presented plaques to the outgoing Committee members in appreciation for their service to the City: Joyce Eiswald, Jim Francis, Jim Keeley, Darwin Drake and Linda Richardson from the Landscape Maintenance District Advisory Committee; Dianne Rath of the Business Advisory Committee; Deanna Stephens of the Performing Arts Committee; Bud Wiederrich of the Poway Road Specific Plan Advisory Committee; Joe Oliva of the Transportation Advisory Committee and Scott Gray of the Redevelopment & Housing Advisory Committee. PUBLIC ORAL COMMUNICATIONS Mayor Higginson explained the procedure for Public Oral Communications. The following person was present wishing to speak: 4820 Page 2 - CITY OF POWAY - March 9, 1993 Betty Rexford, 11570 Creek Road, presented a letter from Margaret Williams to Assemblyman Goldsmith asking questions about the water standby charge proposed by MWD. They are concerned about annual increases. She also presented some information about a mortgage credit program available to low income persons that she feels the city should get involved in. Staff will report back on these two issues. CONSENT CALENDAR Motion by Councilmember Snesko, seconded by Councilmember Emery to approve the Consent Calendar as follows: Approval of Minutes - City Council: February 16, 1993, Regular Meeting 10. Ratification of Warrant Register - February 18, 1993. (401-10) 11. Acceptance of Community Road Pressure Reducing Station from J. E. Brokaw and Sons, Inc. (602-02, #954) 12. Adoption of Resolution No. P-93-08 entitled, "A Resolution of the City Council of the City of Poway, California Approving Temporary Use Permit 93-03" for a bicycle race sponsored by the San Diego Bicycle Club to be held in the South Poway Business Park on April 17, 1993. (203-07) 13. Adoption of Resolution No. 93-037, entitled, "A Resolution of the City Council of the City of Poway, California Ordering the Expansion of Poway Landscape Maintenance District 86-3 With the Annexation of DR 91-28 with Written Consent of all Property Owners, APN 317-473-06." (203-14) 14. Adoption of Resolution No. 93-038, entitled, "A Resolution of the City Council of the City of Poway, California Ordering the Expansion of Poway Landscape Maintenance District 83-1 with the Annexation of CUP 91-05 with Written Consent of Property Owner, APN 275-231-02." (203-08) 15. Acceptance of landscape improvements within Landscape Maintenance District 86-3B, Tentative Parcel Map 90-04, Wal-Mart Stores, Inc(203-02) 16. Acceptance of landscape improvements within Landscape Maintenance District 83-1A, Tentative Tract Map 86-04, Midland Estates, Janette- Midland Ltd. (203-01) 19. Approval of First Amendment to McMillin Equity Partners II Development Agreement for Tentative Tract Map 88-04R. (602-01, #874) Motion carried unanimously. 4821 Page 3 - CITY OF POWAY - March 9, 1993 ITEM 5 (701-04) ORDINANCE NO. 407/SECOND READING SPEED LIMITS/HILLEARY/TED WILLIAMS Mayor Higginson read the title of Ordinance No. 407, "An Ordinance of the City of Poway, California, Adding to Section 10.32.230 of the Poway Municipal Code Establishing Speed Limits on Hilleary Place Between Midland Road and Community Road; Ted Williams Parkway Between Twin Peaks Road and Pomerado Road; and Ted Williams Parkway Between Pomerado Road and West City Limits." There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Snesko to waive further reading, close the public hearing and adopt Ordinance No. 407. Motion carried unanimously on a roll call vote. ITEM 6 (203-21) SPECIFIC PLAN 92-01 OLD POMERADO ROAD AREA Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. This item was noticed to be heard at this meeting, however additional time was requested by the subcommittee and staff is recommending continuance to April 13, 1993. There was no one present wishing to speak. Motion by Councilmember Emery, seconded by Councilmember Callery to continue Specific Plan 92-01 to April 13, 1993. Motion carried unanimously. ITEM 7 (1160-01) LOADING ZONE GARDEN ROAD ELEMENTARY SCHOOL Item introduced by City Manager Bowersox. Staff report by Director of Engineering Services Weston. To accommodate safer passenger drop-off and pick-up in front of Garden Road Elementary School, the Traffic Safety Committee recommends approval of a time restricted loading zone adjacent to the school. The existing crosswalk for the school is at the intersection of Garden Road and Floral Street, west of the school. When permanent curbs, gutters and sidewalks are installed on the south side of Garden Road, the crosswalk can be moved to be more directly in front of the school. City Manager Bowersox stated that the cost of extending an asphalt sidewalk and moving the flashing light is approximately $15,000 to $18,000. This item is on the agenda for the next PUSD/City subcommittee meeting. 4822 Page 4 - CITY OF POWAY - March 9, 1993 Frank Spitzer, 16028 Paragon Mesa Road, showed a video of the traffic conditions in front of the school in the afternoon. Cars park on the empty dirt lot on the south side of Garden Road and children and adults cross the street all along the school's frontage. Non-school related traffic and parents coming to pick up their students create a chaotic traffic situation. He requested additional improvements. Also speaking in favor of additional improvements: Connie Spitzer, 16028 Paragon Mesa Road Randy Wilkins, 14617 Acton Court Marijane Miyake, 13404 Montego Drive Karen Opatik, 13515 Quiet Hills Drive Fran Hjalmarson, 15125 Garden Road, PTA President Laura Polls, 14331Minya Lane Council concurred we need to look at long term solutions including moving the crosswalk and adult crossing guards. Motion by Councilmember Emery, seconded by Councilmember Callery to adopt Resolution No. 93-039, entitled, "A Resolution of the City Council of the City of Poway, California Establishing a Loading Zone on Garden Road," which is 275 feet on the north side adjacent to the school to be in effect 7:30 a.m. to 3:00 p.m., Monday through Friday on school days. ITEM 7.1 (1180-12) STATE BUDGET IMPACTS PUBLIC INFORMATION CAMPAIGN Staff report by City Manager Bowersox. In response to Governor Wilson's proposed 1993-94 State budget which would seize approximately $3.2 million from Poway, it is recommended that the City Council approve a public information campaign involving mailers in the water bills, installing information signs over the water conservation signs, bumper stickers, public service announcements, press releases and a Poway Today article. This is similar to a program put together by the City of Santee and will cost approximately $4,000. Motion by Councilmember Emery, seconded by Councilmember Callery to approve the proposed program and appropriate $4,000 from the unappropriated fund balance for this purpose. Motion carried unanimously. Mayor Higginson suggested that the form letters be revised slightly to better suit the audience and that the water conservation sign on the west end of Poway Road be relocated closer to the stop light. 4823 Page 5 - CITY OF POWAY - March 9, 1993 ITEM 7.2 (1180-05) COMMUNITY CONTRIBUTION REQUEST POWAY HIGH TITAN BASEBALL BOOSTER CLUB Staff report by City Manager Bowersox. The Titan Baseball Booster Club is requesting a $250 donation for the Poway High School Varsity baseball team to go to the Western Regional Tournament in Las Vegas. Under the City's Community Contribution Policy they are eligible to receive a contribution and staff recommends approval. Motion by Councilmember Emery, seconded by Councilmember Callery to approve a $250 donation as requested. Motion carried unanimously. CITY ATTORNEY ITEHS City Attorney Eckis requested a closed session pursuant to Government Code §54956.9(c) to decide whether or not to initiate litigation. MAYOR AND CITY COUNCIL-INITIATED ITEMS 23. Councilmember Callery, city's representative to the San Dieguito River Valley Joint Powers Authority requested Council appoint someone as alternate. Councilmember Snesko agreed to be her alternate if she would be his alternate to ADAPT. Council concurred. 25. Mayor Higginson announced that Mary Mitchell is being appointed to the Redevelopment & Housing Advisory Committee by Councilmember Snesko. 26A. Councilmember Snesko suggested that a Housing Commission member replace the Redevelopment & Housing Advisory Committee on the tenant selection committee for the handicapped units at Haley Ranch Estates. He also requested a workshop with the newly-appointed Commission to discuss their duties. 26B. Councilmember Snesko stated the city needs some housing for minimum wage workers and asked what is being done about Single Room Occupancy facilities. Councilmember Cafagna pointed out that the Poway Road Specific Plan Advisory Committee is working on designating mixed use sites along Poway Road. 26C. Councilmember Snesko suggested the drug hotline also be used for a community watch program where people could call to report suspicious activity and have an answering machine take the calls. Director of Safety Services Sanchez will report back. CLOSED SESSION Mayor Higginson called for a closed session at 8:30 p.m. 4824 Page 6 - CITY OF POWAY - March 9, 1993 CALL TO ORDER AND ADJOURNHENT Mayor Higginson called the meeting back to order at 9:00 p.m., and announced that Council had instructed the City Attorney to not initiate litigation during closed session.
