RESOLUTION NO. 06-058
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
ESTABLISHING A POLICY TO DELEGATE REJECTION OF TORT CLAIMS TO THE
DIRECTOR OF ADMINISTRATIVE SERVICES AS AUTHORIZED BY GOVERNMENT
CODE SECTION 935.4
WHEREAS, Section 935.4 of the Government Code of the State of California
provides that a local public entity may authorize an employee of the local public entity to
reject claims against the local public entity; and
WHEREAS, the City of Poway has now determined to adopt such a policy;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
Section 1. That the Director of Administrative Services, or Director's designee,
is authorized to take administrative actions necessary to reject claims against the City of
Poway pursuant to the provisions of Government Code Section 935.4.
Section 2. That this Resolution shall become effective immediately upon its
adoption.
Section 3. That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original resolutions.
PASSED, ADOPTED AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting thereof this 18th day of July, 2006.
