A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY
ORDERING THE SUMMARY VACATION OF AN
IRREVOCABLE OFFER TO DEDICATE
REAL PROPERTY (VAC 06-02) ON MONTE VISTA ROAD
WHEREAS, an Irrevocable Offer to Dedicate Real Property to the City of Poway
was recorded on the property located at 12708 Monte Vista Road through Grant Deed
85-109297 for the purpose of a temporary vehicular turnaround area; and
WHEREAS, the City Council of the City of Poway desires to summarily vacate
the Irrevocable Offer to Dedicate Real Property in accordance with the procedures
provided in Chapter 4, Part 3, Division 9 of the Streets and Highways Code of the State
of California, commencing at Section 8300; and
WHEREAS, Monte Vista Road terminates in a cul-de-sac within the public right-
of-way that replaces the need for a temporary vehicular turnaround area; and
WHEREAS, acceptance of the Irrevocable Offer to Dedicate Real Property would
result in an excess of public right-of-way of a street not required for street purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1. This summary vacation is made under the provisions of Chapter 4, Part 3,
Division 9 of the Streets and Highways Code of the State of California.
2. The City Council hereby finds that acceptance of the Irrevocable Offer to
Dedicate Real Property would result in an excess of public right-of-way of
a street not required for street purposes (Section 8334 (a)).
3. The City Council hereby declares that the Irrevocable Offer to Dedicate
Real Property recorded under Grant Deed 85-109297 is hereby vacated.
4. The City Clerk of the City of Poway is hereby directed to cause a certified
copy of this Resolution to be recorded in the office of the Recorder of San
Diego County in accordance with the provisions of Section 8336 of the
Street and Highways Code of the State of California.
