Ord 638 ORDINANCE NO. 638 AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA, AMENDING THE DEVELOPMENT SERVICES DEPARTMENT BUILDING DIVISION FEE SCHEDULE AND RESCINDING ORDINANCE NO. 545 WHEREAS, the City of Poway provides Building Permit services to the citizens of Poway; and WHEREAS, the processing of such permits requires staff time to investigate the circumstances surrounding the application and perform other related tasks; and WHEREAS, California Government Code Section 66016, et seq., establishes procedures for the adoption of fees for services provided by local government; and WHEREAS, the last comprehensive revision to the permit fee schedule for building services was last amended by the City Council on April 6, 1993, by Resolution No. 93-049; and WHEREAS, the City Council finds that it is appropriate to amend the fee schedule to more accurately reflect the cost of the services provided; and WHEREAS, before enacting this Ordinance, the City Council held a public hearing on June 20, 2006, at which oral or written presentations could be made as part of a regularly scheduled meeting; and * WHEREAS, after receiving the evidence presented at the public hearing, including the staff report and the oral or written presentations from the public, if any, the City Council found and determined that the amounts of the fees established by this Ordinance do not exceed the estimated reasonable cost of providing the service for which the fees are charged. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: SECTION 1: The City Council hereby finds that this amendment is statutorily exempt from the California Environmental Quality Act, pursuant to Section 15273(a)(1) of the CEQA Guidelines, because it entails only the modification of a charge for the purpose of meeting operating expenses for building services. SECTION 2: The City Council hereby adopts the Development Services Department Building Division Fee Schedule as set forth in the attached Exhibit A. SECTION 3: The City Council hereby adopts the 2005 valuation table created by the San Diego Area Chapter of the International Code Council as set forth in the attached Exhibit B, and it shall become effective one year from the effective date of this ordinance. Ordinance No. 638 Page 2 SECTION 4: The revised fee schedule contained in Exhibits A and B shall not apply to any project for which a substantially completed application, as determined by the Director of Development Services, for Building Permit, Development Review, Conditional Use Permit, Variance, or Minor Development Review Application has been submitted prior to the effective date of this ordinance. However, if the applicant does not obtain approval of the application within one year of submittal, or if the approval of the application expires and no Building Permit is obtained prior to its expiration, then any re-submittal of the application or submittal of a new application would be subject to the Building Permit fees in effect at the time of Building Permit application. Section 5: Ordinance 545 is hereby rescinded. EFFECTIVE DATE: This Ordinance shall take effect and be in force sixty (60) days after the date of its passage; and before the expiration of fifteen (15) days after its passage, it shall be published once with the names of members voting for and against the same in the Poway News Chieftain, a newspaper of general circulation published in the City of Poway. Investigation Fee. The fee shall be equal to, and in addition to, the permit fee for the work, whether or not a permit is issued. 8. Plan Review Fee. When a plan or other data is required to be submitted for plan review, a plan review fee shall be paid at the time of submitting plans and specifications for review. Said plan review fee shall be 65% of the building permit fee as established after disabled access inspection fees and energy code inspection fees have been added to the building permit fee. (Residential sub- division or tract development projects may have production units that are duplicates of the model units reduced to 30% of the permit fee). 9. Permit Issuance Fee (non-refundable) $36.00 10. Disabled Access Inspection Fee (applies 10% of Building Permit Fee to all projects required by State law to be accessible to the physically disabled) 11. For each air-handling unit to and including 10,000 $10.80 cubic feet per minute, including ducts attached thereto. Note: This fee shall not apply to an air-handling unit which is a portion of a factory-assembled appliance, cooling unit, evaporative cooler or absorption unit for which a permit is required elsewhere in this code. 13.
