Adoption of Resolution No. 21-020 entitled "A Resolution of the City Council of the City of Poway, California, Finding and Declaring the Continued Existence of an Emergency within the City due to the Novel Coronavirus (COVID-19) to Continue the Existence of a Local Emergency Global Pandemic" 4. Award of Bid for the Annual Supply of Chemicals for the Lester J. Berglund Water Treatment Plant; RFB Bid No. 21-023 5. Award of Agreement with BrightView Landscape Services, Inc., LaBahn's Landscaping, and Steven Smith Landscaping, Inc. for Landscape Maintenance Services; RFP No. 21-018 In response to Council comment, Director of Public Works Eric Heidemann explained that despite having a higher contract cost, Brightview Landscaping had considerable municipal experience and resources therefore they were selected. Assistant City Manager Wendy Kaserman responded to Council's inquiry regarding the Poway Center for the Performing Arts and stated Poway Unified School District pays 35 percent cost share which includes landscape services. 6. Adoption of Resolution No. 21-021 entitled "A Resolution of the City Council of the City of Poway, California, Authorizing Acceptance of Grant Funding from the Federal Emergency Management Agency in the amount of $137,906.25 or more, if available; and authorizing the City Manager, or Designee, to Execute any Necessary Documents to Meet the Grant Requirements and to Complete the Hazardous Tree Removal Wildfire Mitigation Project." 3 of7 June 1, 2021, Item #2 City of Poway -Minutes -May 4, 2021 8. Second Reading and Adoption of Ordinance No. 847 entitled "An Ordinance of the City Council of the City of Poway, California, Amending Chapter 10.42 (Truck Routes and Maximum Gross Weight Limits) of the Poway Municipal Code" Yuri Bohlen, via teleconference, spoke in support of the adoption of the Ordinance. Motioned by Councilmember Frank, seconded by Councilmember Mullin to adopt Ordinance No. 847 entitled "An Ordinance of the City Council of the City of Poway, California, Approving Specific Plan Amendment 21-001 to the Poway Road Specific Plan to Allow Thrift Stores in the Commercial Office and Mixed Use Land Use Districts and Antique Shops and Consignment Stores in the Mixed Use Land Use District". Variance 21-001; a Request to Allow a Mailroom Structure to Observe a Reduced Front Yard Setback at 12421 Aria Court. APN: 317-534-43 Mayor opened the public hearing at 7: 15 p.m. Associate Planner Oda Audish presented the report along with a PowerPoint presentation. Ms. Audish explained the project site is part of the Aria Estates subdivision and is a designated open space lot that is privately owned and will be maintained by Aria Estates. Ms. Audish further explained the 120-square-foot mailroom structure requires a 40-foot setback but due to the unique circumstances applicable to the property, the applicant is requesting a variance for convenient location of the structure for future residents. Mayor closed the public hearing at 7:23 p.m. In response to Council inquiry, Ms. Audish explained that as an approval of the Tentative Tract Map, there is a requirement to landscape along a sidewalk and slope on Pomerado Road which will be completed before occupancy. 4of7 June 1, 2021, Item #2 City of Poway -Minutes -May 4, 2021 Motioned by Mayor Vaus, seconded by Councilmember Frank to adopt Resolution No. 21-022 entitled "A Resolution of the City Council of the City of Poway, California, Approving Variance 21-001 to allow a Mailroom to Observe a Reduced Front Yard Setback; Assessor's Parcel Number 317-534-43." Motion carried unanimously. STAFF REPORTS 12. Los Penasquitos Lagoon Restoration Project Senior Civil Engineer Tracy Beach presented the report along with a PowerPoint presentation. No speakers. In response to Council's inquiry Ms. Beach explained that in order to update the Water Quality Improvement Plan model, all of the copermittees have to agree to the update. Ms. Beach mentioned that there will be a new storm water permit with new requirements, which may require a new plan model. In response to Council inquiry, Director of Finance, Aaron Beanan, stated that the Phase 1 cost share will be covered by the unassigned fund balance. Motioned by Mayor Vaus, seconded by Councilmember Frank to authorize the City Manager to execute the Phase 1 Cost Share Agreement for the Los Penasquitos Lagoon Restoration Project and authorize the City Manager to appropriate funds. Motion carried unanimously. 13. Pre-Development Conference 21-002, a Request for Review of a Proposal to Amend the Old Coach Estates Specific Plan to Designate Portions of a Remainder Parcel as Residential, Establish Development Standards for a Six-Lot Subdivision on a Property Located North of the Intersection of Espola Road and Old Coach Road, and Allow for the Development of One Residential Unit East of Old Coach Road and Approximately One Mile North of Espola Road Senior Planner Austin Silva presented the report along with a PowerPoint presentation. Mr. Silva discussed a request from Sunroad Enterprises to modify the Old Coach Golf Estates Specific Plan in order to subdivide a remainder parcel into six residential lots and a new remainder lot. Uri Feldman, Vice President of Sunroad Enterprises, stated the plan they formulated was to provide more housing without any additional density. No speakers. Council discussion ensued. Council provided feedback to staff and the applicant to evaluate community benefits, conduct a traffic study to ensure residents are able to access their homes safely and protect access to trails. WORKSHOPS 14. Review of the Draft 2020-2029 Housing Element Update and Submittal of Draft to the California Department of Housing and Community Development for 60-Day Review 5 of7 June 1, 2021, Item #2 City of Poway -Minutes -May 4, 2021 City Planner David De Vries presented the report along with a PowerPoint presentation. Mr. De Vries explained state law requires General Plans include seven mandatory elements. He further elaborated that one of the mandatory elements is the Housing Element which provides an assessment of the community's housing needs and requires frequent updates, the last of which was done in 2013. Amit Asaravala, via teleconference, suggested increasing Poway's in-lieu fees. Marianna Benedict-Bacil/a, via teleconference, suggested that the Big Stone Lodge site be removed from the low-income housing building site. Yuri Bohlen, via teleconference, spoke about Proposition FF. Jana Johnson, via teleconference, suggested installation and implementation of Electrical Vehicle chargers and the addition of a roadway for biking or pedestrians. Michael Yee, via teleconference, suggested access of electrical personal mobility devices for residents. Mike Hegstad submitted email correspondence requesting that the homes have solar panels, contain electrical appliances and the community have an Electrical. Vehicle. charging destination. Laura Nunn submitted email correspondence suggesting that affordable housing be developed. Michael Yee submitted email correspondence suggesting secure charging access fore-bikes and other personal mobility devices and improving the mobility options for those who cannot afford a car. Chris Cruse submitted email correspondence suggesting that several of the parcels owned by the Poway Housing Authority on the Residential Sites Inventory need to be sold if development does not commence by August 2022. Council discussion ensued. In response to Council inquiry Mr. De Vries explained the City was short on requirements for built housing units and as a result, there had to be a certain number of by-right housing units. Mr. De Vries further clarified affordable housing overlays were done on three sites and the overlays already included the by-right requirements, therefore, rezoning did not take place on any sites. Mr. De Vries shared the penalty for not adopting the Draft Housing Element by August 13, 2021 is that the housing element would be required to be updated after four years, instead of an eight-year cycle. Council provided direction to staff to authorize the Draft Housing Element to be submitted to the California Department of Housing and Community Development for 60-day review.
