8. Adoption of the City of Poway's Water Shortage Contingency Plan
Mayor opened the public hearing at 7:07 p.m.
Utilities Administrator Jessica Parks presented the report along with a PowerPoint
presentation. Ms. Parks explained that staff has developed its Water Shortage Contingency

Plan to establish new water use regulations, including standardizing water shortage
contingency levels for all water agencies, that complies with both Poway Municipal Code
Chapter 8.94 and Senate Bill 606 regulations.
Yuri Bohlen, via teleconference, spoke in opposition to water conservation efforts under the
current water rate structure.
Mayor closed the public hearing at 7: 13 p.m.
Council discussion ensued regarding Poway's reliable water supply.
Motioned by Mayor Vaus, seconded by Deputy Mayor Leonard to adopt Resolution No.
21-025 entitled "A Resolution of the City Council of the City of Poway, California,
Adopting the City of Poway's Water Shortage Contingency Plan". Motioned carried
unanimously.
9. Resolution Confirming and Authorizing Recovery of Costs Incurred to Abate Public Nuisance
at 137 46 Frame Road
Mayor opened the public hearing at 7:18 p.m.
City Attorney Alan Fenstermacher presented the report and gave an overview of the history
of code compliance efforts related to the accumulation of junk on the property since 2018. Mr.
Fenstermacher explained that the City provided the property owners with additional time to
voluntary comply many times, and noted that it was only after the issuance of the warrant, did
the property owners finally bring the property into reasonable compliance with the Poway
Municipal Code (PMC). He further explained that the City is entitled to recover its cost to abate
the nuisance because the City was forced to obtain a warrant to induce compliance. He noted
that the City previously obtained an inspection and abatement warrant which forced the
property owners to come into reasonable compliance with the PMC, however, the property
fell back out of compliance, resulting in this action. The City did not seek to recover the cost
associated with the first warrant.

Motioned by Councilmember Grosch, seconded by Deputy Mayor Leonard to adopt
Resolution No. 21-023 entitled "A Resolution of the City Council of the City of Poway,
California, Confirming Costs Incurred to Abate A Public Nuisance at 13746 Frame
Road." Motion carried unanimously.
10. Resolution Adopting an Amendment to the TransNet Local Street Improvement Program List
of Projects for Fiscal Years 2020-21 through 2024-25

Motioned by Mayor Vaus, seconded by Councilmember Mullin to adopt Resolution No.
21-026 entitled "A Resolution of the City Council of the City of Poway, California,
Adopting An Amendment to the Transnet Local Street Improvement Program of
Projects for Fiscal Years 2020-21 through 2024-25", and amend the Fiscal Year 2020-21
Capital Improvement Program Budget to reflect an increase in projected TransNet
revenue of $109,000 and appropriate those funds to the Espola Road Safety
Improvements (Phase 2) Projects STR0001. Motion carried unanimously.
STAFF REPORTS
11. Acceptance of the McCarthy Family Foundation Grant to Support a New Poway Center for
the Performing Arts Endowment
Assistant City Manager Wendy Kaserman presented the report and explained that following
the April 6, 2021 City Council workshop, the City received a letter from the McCarthy Family
Foundation which outlined general terms for the use of the $1 million grant offer. She
explained that the Foundation will provide $30,000 to conduct the fundraising feasibility study
discussed at the April 6, 2021 workshop. Following the results of the feasibility study, the
remaining $970,000 will be provided to the City as seed money to start a new PCPA
endowment. Ms. Kaserman concluded that the endowment will be used to help support the
PCPA along with fundraising options that the study determines.
Janet Lettang, via teleconference and email, expressed support for accepting the grant.
Kate Hirsh, via teleconference, expressed support for accepting the grant.
Jana Johnson, via email, expressed support for the grant.
Council expressed gratitude and appreciation to the McCarthy Family Foundation and its
president, Rachel McCarthy Henneforth, for their generous donation and dedication to the arts
in Poway.
Motioned by Mayor Vaus, seconded by Councilmember Frank to adopt Resolution No.
21-027 entitled "A Resolution of the City Council of the City of Poway, California,
Accepting the McCarthy Family Foundation Grant to Support A New Poway Center for
the Performing Arts Endowment" and authorize staff to work with the McCarthy Family
Foundation to execute an agreement clarifying the financial terms of the
grant/endowment. Motion carried unanimously.
12. Approval for Establishing Guidelines for City Issued Proclamations
City Manager Chris Hazeltine presented the report to request City Council direction on
establishing guidelines for City issued proclamations that have a direct significance to Poway.
He explained that staff is recommending refraining from issuing duplicative proclamations that
have a Federal, State or County focus.

Council discussion ensued in support of the guidelines developed by the City Manager's Office
and issuing Poway-focused proclamations. In addition, Council expressed interest in posting
the guidelines on the City's website, creating an option for online submissions, and generally
limiting public presentation participants to six people.
Council provided direction to staff to establish guidelines for City issued proclamations
that focus on proclamations that are uniquely Poway and have demonstrated a distinct
and direct relevancy to a Poway school, longstanding organization or individual.

Councilmember Mullin reported that he attended a recent meeting of the Finance Committee and
Metro Wastewater JPA.
Councilmember Frank reported on a new MTS mobile application that is now available for ticket
purchases.

City Attorney Alan Fenstermacher announced that there was no reportable action at the Closed
