Council action is required to authorize this process. Recommended Action: It is recommended that the City Council direct staff to escheat the warrants listed on Attachment A and return the funds to the respective General, Water or Sewer Fund, and if the money is in a fund other than the General, Water or Sewer Fund, then transfer it to the General Fund, if the noticed warrants are not claimed. Discussion: California Government Code Sections 50050 through 50055 have provisions that permit warrants which remain unclaimed for at least three years to be escheated. Any warrant fifteen dollars ($15) or more must be noticed once a week for two consecutive weeks in a newspaper of general circulation published in the City. If the money is unclaimed, it becomes the property of the City on a designated date that is between 45 and 60 days after the first notice. If the money is in a fund other than the General, Water or Sewer Fund, the City Council may transfer it to the General Fund. The City has 209 warrants that are outstanding and unclaimed for three or more years totaling $56,174.49 (see Attachment A). Of the 209 unclaimed warrants, 184 totaling $51,493.33 are related to the General Fund and in funds other than the General, Water or Sewer Fund, 25 totaling $4,681.16 are related to the Water Fund, and none are related to the Sewer Fund. Monthly, an updated list of outstanding warrants over six months old is posted on the City's website at www.poway.org in the Finance Department section. In addition to posting the list of unclaimed funds, attempts are also made to locate payees of stale dated checks by retrieving contact information from issuing departments and reviewing the status of water accounts for Poway addresses. 1 of7

Fiscal Impact: If the noticed warrants are not claimed by the designated date of July 19, 2021, funds totaling $51,493.33 will be escheated to the General Fund and $4,681.16 will be escheated to the Water Fund. Public Notification: Public Notice was published in the Poway News Chieftain on consecutive Thursdays, June 3, 2021, and June 10, 2021. The list of the 209 unclaimed warrants that are three or more years old also appeared on the City's website, along with the other warrants that are over six months old. Attachments: A.
