Item 21 - Acceptance of the Martincoit Road Sewer Upsize Project; Bid 19-015 with Blue Pacific Eng. as CompleteJune 15, 2021, Item #21AGENDA REPORT CityofPoway DATE: TO: FROM: CONTACT: June 15, 2021 Honorable Mayor and Members of the City Council Robert Manis, Director of Development Services/,JI\ Melody Rocco, City Engineer lJjv (858) 668-4653, mrocco@poway.org CITY COUNCIL SUBJECT: Acceptance of the Martincoit Road Sewer Upsize Project; Bid No. 19-015 with Blue Pacific Engineering & Construction as Complete Summary: On May 21, 2019, the City Council awarded the contract for the Martincoit Road Sewer Upsize project; Bid No. 19-015 to Blue Pacific Engineering & Construction in the amount of $2,414,880.00. This action will accept the project as complete. Recommended Action: It is recommended that the City Council: (1) Accept the Martincoit Road Sewer Upsize project as complete; (2) Authorize the City Clerk to file and record the Notice of Completion; (3) Authorize the release of the retention in the amount of $120,129.32, if unencumbered, 45 days after City Council acceptance; (4) Release the North American Specialty Insurance Company for Material and Labor in the amount of $2,414,880.00 after the release of retention; and (5) Retain the North American Specialty Insurance Company Bond for Faithful Performance for a period of one year. Discussion: This project involved the upsizing of existing sewer mains along Martincoit Road and within an equestrian trail and sewer easement, between Camino del Valle and Martincoit Road. Approximately 3,360 lineal feet of existing 8-inch, 10-inch, and 12-inch vitrified clay pipes (VCP) were to be upsized to 12-inch and 15-inch polyvinylchloride (PVC) pipe, and 16-inch high-density polyethylene (HDPE) pipe, respectively. There were three change orders during this project totaling a project decrease of $12,293.67. One change order resulted from field elevations that were found to be different from elevations shown on the plan. This resulted in changing the creek crossing from a trench less jack and bore method to open 1 of 2 June 15, 2021, Item #21trench after staff obtained a Regional General Permit 63 permit from the U.S. Army Corps of Engineers. The second change order added installation of eight feet of UV liner at a connection to existing pipe to prevent infiltration. It was found that the existing pipe was concrete encased and could not be properly exposed for a sealed connection. The third change order adjusted the bid item quantities to zero-out the exact quantities constructed and to pay for several items agreed to during negotiations related to a claim for delays and disputed work submitted by the contractor. The final contract amount based upon these three change orders is $2,402,586.33. Staff continues to negotiate the outstanding claims on this project. Since all construction activities are complete, staff recommends accepting the work so that retention can be released and the warranty period can begin. Should any negotiations result in additional payment to the contractor, that amount would be presented to the City Council as part of the settlement process. Environmental Review: The matter of acceptance of public improvements that have been completed, which were the subject of a prior environmental determination, is not subject to the California Environmental Quality Act. Fiscal Impact: Sufficient funds are available in the Martincoit Road Sewer Upsize project account (SWR0004) for the release of retention. Funds remaining in the project after resolution of outstanding claims will be returned to the sewer fund for future projects. Public Notification: None. Attachments: None.
