ORDINANCE NO. 643
AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
CHANGING THE ZONING CLASSIFICATION
OF CERTAIN PROPERTIES LOCATED AT THE
NORTHEAST CORNER OF POWAY ROAD AND MIDLAND ROAD
(ZC 06-02)
APNs: 317-130-41 and 47
WHEREAS, the Cjty Council of the City of Poway has initiated a General Plan
Amendment, GPA 06-02, a request to amend the land use of two adjoining parcels consisting
of 0.5 acres and 9.07 acres, respectively, located on the northeast corner of Poway Road
and Midland Road; and
WHEREAS, the City Council finds that the zoning classification of the property should
also be changed to maintain consistency with the General Plan, as required by Section
65860 of the California Government Code and the California Environmental Quality Act; and
WHEREAS, on September 5, 2006, and September 19, 2006, the City Council held a
duly advertised public hearing to solicit comments from the public, both pro and con, relative
to thjs application.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS:
Section 1: The City Council has considered the Environmental Initial Study (EIS) and
Negative Declaration (ND) for General Plan Amendment 06-02, Zone Change 06-02 and
Specific Plan Amendment 95-01C, and public comments received on the EIS and ND. The
subject EIS and ND documentation are fully incorporated herein by this reference. The City
Councjl finds, on the basis of the whole record before it, that there is no substantjal evidence
the project will have a significant impact on the environment.
Section 2: The City of Poway Zoning Map is amended as follows:
A. The zoning of two adjoining parcels, 0.5 and 9.07 acres, respectively, APNs: 317-130-
41 and 47, located on the northeast corner of Poway Road and Midland Road, is
changed from Automotive/General Commercial (A1GC) to Commercial General (CG)
as shown in Exhibit A.
EFFECTIVE DATE: This Ordinance shall take effect and be in force thirty (30) days
after the date of passage; and before the expjration of fifteen (15) days after its passage, it
shall be published once with the names and members voting for and against the same in the
Po way News Chieftain, a newspaper of general circulation published in the City of Poway.

Introduced and first read at a regular meeting of the City Council of the City of Poway
held the 5th day of September 2006, and thereafter PASSED AND ADOPTED at a regular
meeting of said City Council held the 19th day of September 2006, by the following roll call
vote:

NOES: NONE
ABSENT: BOYACK
