Res 06-075 RESOLUTION NO. 06-075 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN OF THE CITY OF POWAY (GPA 06-02) WHEREAS, the City Council of the City of poway recognizes that the need may arise to amend the City's General Plan; and WHEREAS, Section 65350, et seq., of the California Government Code describes the procedures for amending General Plans; and WHEREAS, the City of Poway has initiated a General Plan Amendment, GPA 06-02, which involves the consideration of the re-designation of land use and zoning of two adjoining parcels consisting of 0.5 acres and 9.07 acres, respectively, from Automotive/General Commercial (A1GC) to Commercial General (CG); and WHEREAS, on September 5, 2006, and September 19, 2006, the Cjty of poway held a properly noticed public hearing in accordance with the California Government Code and the California Environmental Quality Act to consider that request; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows: Section 1: The City Council has considered the Environmental Initial Study (EIS) and Negative Declaration (ND) for General Plan Amendment 06-02, Zone Change 06-02 and Specific Plan Amendment 95-01C and public comments received on the Environmental Initial Study (EIS) and Negative Declaration (ND). The subject EIS and ND documentation are fully incorporated herein by this reference. The City Council finds, on the basis of the whole record before it, that there is no substantial evidence the project will have a significant impact on the environment. The City Council hereby approves the Negative Declaration. Section 2: The City Council finds that the proposed General Plan Amendment and the corresponding Zone Change would maintain land use compatibility with the surrounding properties and provide an expanded list of potential land uses available to development located on the subject parcels. Section 3: The City Council hereby approves General Plan Amendment, GPA 06-02, an amendment to the Land Use Element of the Poway General Plan, re-designating the land use of two adjoining parcels consjstjng of 0.5 acres and 9.07 acres, APNs: 317-130-41 and 47, respectively, located on the northeast corner of Poway Road and Midland Road from Automotive General Commercial (A1GC) to Commercial General (CG) as shown on Exhibit A.
