CC 2006 09-19 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING SEPTEMBER 19, 2006 The September 19, 2006, Regular Meeting of the City Council of the City of Poway, was called to order at 7:05 p.m. by Mayor Cafagna at the Poway City Council Chambers, 13325 Civic Center Drive, Poway, California, for a Regular City Council Meeting. CITY COUNCILMEMBER ANNOUNCEMENTS A. Poway Bob's Restaurant Review. Councilmember Emery gave a retro-reviewof Zuke's, an Italian restaurant dating back to 1968-69, owned by long-time Poway resident Daniel Zukaitis, who recently passed away. Deputy Mayor Rexford expressed concern about broken glass found in Old Poway Park and requested staff to look into the situation. Deputy Mayor Rexford reported a resident had contacted her regarding the safety of the Water Treatment Plant against terrorism. She requested staff report back to Council on the safety of the plant and the types of security the City has in place. 8715 Page 2 - CITY OF POWAY - September 19,2006 PRESENTATIONS Presentation of Proclamation to John Mciver, Chairman of the Poway Family Focus Committee, in support of Family Focus Night. Mayor Cafagna presented the proclamation to John Mciver, Chairman of the poway Family Focus Committee, declaring May 21,2007 as Poway Family Focus Night. Jose Nuncio, Senior Transportation Engineer with SANDAG, gave a PowerPoint presentation on Transportation Progress around the Region. PUBLIC ORAL COMMUNICATIONS Mayor Cafagna explained the procedures for Public Oral Communications noting that State law may prohibit the City Council from taking action on items not on the agenda, and items will be referred to staff. The following people spoke: Mike Vildibill, Poway, spoke about the SDG&E Sunrise Powerlink and the need for more neighborhood meetings. Val Derkach, Poway, spoke about the need to have handrails installed on buildings at Haley Ranch as well as the installation of speed bumps in the park. Joe St. Lucas, Poway, spoke about the trash in his neighborhood at an abandoned home and thanked code enforcement and City staff for their assistance. Andy Adams, Poway, thanked Mr. Gould for his assistance in addressing some of his concerns and expressed concerns with the mobile recreation center and children's safety. Kevin Campbell, Poway, spoke about his concern with the poor service provided by EDCO. CONTINUED PUBLIC HEARINGS 1. (a) Ordinance No. 643 - Second reading, entitled: "An Ordinance of the City of Poway, California, Changing the Zoning Classification of Certain Properties Located at the Northeast Corner of Poway Road and Midland Road (ZC 06-02) APNs: 317-130-41 and 47;" (b) Environmental Assessment/General Plan Amendment 06-02/Specific Plan Amendment 95-01 C; Bruce Geernaert and Raymond Frey/Kimco Realty Corporation, Applicants. A request to rezone two adjacent parcels, totaling 9.57 acres, located on the northeast corner of Poway Road and Midland Road, from Automotive/General Commercial (AlGC) to Commercial General (CG), and to amend the Poway Road Specific Plan to reflect map and text changes resulting from the General Plan Amendment/Zone Change. (0220-40) 8716 Page 3 - CITY OF POWAY - September 19, 2006 Deputy City Clerk Sherrie Worrell presented the staff report. On September 19, 2006, the City Council opened the public hearing introducing Ordinance No. 643. There was no public testimony offered at that time. The owners of Poway City Centre and the adjoining office building, located on the northeast corner of Poway Road and Midland Road, are completing an expansion and revitalization of their shopping centers, which now support a wide variety of restaurant and general retail uses. Both of the subject parcels are zoned A/GC. The applicants are requesting a change in land use and zoning from A/GC zoning to CG, as the existing A/GC land use matrix precludes their ability to attract additional desirable tenants such as jewelry stores, flower shops, and financial institutions, as these uses are not allowed in the A/GC zone. The parcels are located with the Poway Road Specific Plan; therefore, the Plan must be amended to reflect map and text changes resulting from the GPA/ZC. Motion by Deputy Mayor Rexford, seconded by Councilmember Higginson, to close the public hearing, waive further reading and adopt Ordinance No. 643, entitled: "An Ordinance of the City of Poway, California, Changing the Zoning Classification of Certain Properties Located at the Northeast Corner of Poway Road and Midland Road (ZC 06-02) APNs: 317-130-41 and 47;" Adopt Resolution No. 06-075, entitled: "A Resolution of the City Council of the City of Poway, California, Amending the Land Use Element of the General Plan of the City of Poway (GPA 06-02);" and, Adopted Resolution No. 06-076, entitled: "A Resolution of the City Council of the City of Poway, California, Amending the Poway Road Specific Plan to add the Commercial General Designation (SPA 95-01 C)." Motion carried 4-0 with Councilmember Boyack absent. CONSENT CALENDAR Motion by Deputy Mayor Rexford, seconded by Council member Higginson, to approve the Consent Calendar as submitted except for Item 7, which was removed for discussion. Motion carried 4-0 with Council member Boyack absent. 2. Ratification of Warrant Reaisters for the periods of August 14-18 and August21- 25, 2006. (0475-20) 3. Acceptance of the Surface Patch Proiect from J.D. Paving, Inc. (0700-10) 4. Acceptance of the Powav Center for PerforminQ Arts Millwork Proiect from Spooner's Woodworks, Inc. (0700-10) 5. Adoption of Resolution No. 06-077, entitled: "A Resolution ofthe City Council of the City of Poway, California, Authorizing the Submittal of Annual Grant Applications to the California Integrated Waste Management Board for the Tire- Derived Product Grant ProQram." Adoption of Resolution No. 06-078, entitled: "A Resolution ofthe City Council of the City of Poway, California, Governing Water and Sewer Service to Affordable Housina Units for Lower Income Households." (0930-90) 7. Adoption of Resolution No. P-06-42, entitled: "A Resolution of the City Council of the City of Poway, California, Approving Comprehensive Sian Proaram 06-01 APN: 317-540-56" for the property located at 13035 Pomerado Road, within the Community Business (CB) zone and the Poway Road Specific Plan area. Applicant: Stanford Sign & Awning. APN: 317-540-56. (0280-20) This item was removed from the Consent Calendar for public comment: Dee Fleischman, Poway, inquired as to whether the sign complied with the General Plan. Motion by Deputy Mayor Rexford and seconded by Council member Emery to adopt Resolution No. P-06-42, entitled: "A Resolution of the City Council of the City of Poway, California, Approving Comprehensive Sign Program 06-01 APN: 317-540-56." Motion carried 4-0 with Council member Boyack absent. 8. Award of Bid to HMS Construction. Inc., for the Traffic Installation and Upgrades Project (#5315) - Bid No. 06-014 in the amount of $358,777. The upgrades and installations are for the intersections at Twin Peaks Road and Budwin Lane, Scripps Poway Parkway and Kirkham Road, and Pomerado Road and Ted Williams Parkway. (0700-10) CITY MANAGER ITEMS 9. City Manager Gould thanked the Earlgate Court residents for contacting code enforcement concerning the abandoned house in their neighborhood. Mr. Gould reported that staff has already contacted the property owner; and following the 18-day period, required by law that allows the tenants to reclaim their property, the property owner has already committed to renovating the interior of the home. MAYOR AND CITY COUNCIL-INITIATED ITEMS 12. Councilmember Emery commended staff, the Chamber of Commerce and the community for a great Community Days Parade. Mr. Emery requested that staff meet with the school district to discuss the high schools' obligation to participate in and represent the City in which they receive specialty funds from. 14. Deputy Mayor Rexford thanked Bill Ruckle for contacting staff concerning the repair of the screen in the Council Chambers. Mrs. Rexford inquired as to the need for more code enforcement officers and requested a report back to Council; she also requested staff look into the safety concerns expressed by citizens with regards to the mobile recreation vehicle and how Jessica's Law may playa part in having the recreation vehicle in safe neighborhoods. 8718 Page 5 - CITY OF POWAY - September 19, 2006 15. Mayor Cafagna requested staff provide him with the list of property owners and their addresses that live in the Treadwell area so that he may pass the information onto SDG&E in regards to notification of neighborhood meetings about the proposed Sunrise Powerlink.
