RESOLUTION NO. P-06-45
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING TEMPORARY USE PERMIT 06-75
TO HOLD THE ANNUAL TRAIN SONG FESTIVAL
WHEREAS, Temporary Use Permit 06-75, City of Poway Community Services,
Applicant, requests approval to hold the annual Train Song Festival at Old Poway Park,
located at 14134 Midland Road, on Saturday, October 7,2006, from 10:00 a.m. to 4:00
p.m. and from 7:00 p.m. to 9:00 p.m.; and
WHEREAS, on October 3, 2006, the City Council considered the above-
referenced item.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Poway, as follows:
Section 1: The City Council finds that Temporary Use Permit 06-75 is Categorically
Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to
Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will
have no effects on the environment.
Section 2: The proposed use is in accordance with the purposes and standards of
Section 17.26.030.A of the Poway Municipal Code.
Section 3: The City Council hereby approves Temporary Use Permit 06-75, the annual
Train Song Festival at Old Poway Park, located at 14134 Midland Road, on Saturday,
October 7,2006, from 10:00 a.m. to 4:00 p.m. and from 7:00 p.m. to 9:00 p.m., subject
to the following conditions:
A. The event and related off-site parking shall be conducted as shown on the site
plan and application on file in the Development Services Department.
B. This permit is valid during the hours of 10:00 a.m. to 9:00 p.m. on Saturday,
October 7, 2006, after which time the site shall be restored to its original
condition.
C. Approval of this activity shall not excuse compliance with all other sections of the
Zoning Ordinance and all other applicable State, County, and City Ordinances
presently in effect.
D. The site shall be developed in accordance with the approved site plan on file in
the Development Services Department, Planning Division, except as otherwise
provided herein.
E. Prior to the event, the applicant shall comply with the following:

1. The following City of Poway departments shall be contacted for
appropriate permits, coordination, and inspections: Public Works,
Community Services, Customer Services, Development Services
(including the Building, Traffic Engineering, and Planning Divisions),
Safety Services, and the Sheriffs Department.
2. Obtain permits from the Fire Department for any tent that exceeds 200
square feet or any canopy that exceeds 400 square feet.
3. All proposed signs shall be approved by the Development Services
Department, Planning Division, and shall be in accordance with Section
17.40 of the Poway Municipal Code.
F. During the event, the applicant shall comply with following:
1. Do not block emergency vehicle access to any street, building, fire hydrant
or fire sprinkler connection.
2. Provide a fire extinguisher with a minimum rating of 2A:10BC at any booth
where food is cooked.
3. Secure any compressed gas cylinders from falling over.
G. At the conclusion of the event, the applicant shall comply with the following:

Public streets, off-street parking sites, and areas within and adjoining the
proposed area for the event shall be cleared of debris, litter, temporary
signs and all other evidence of the event.
