CC 1993 09-07 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING SEPTEMBER 7, lgg3 The September 7, 1993, regular meeting of the City Council of the City of Poway, was called to order at 7:05 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PROCLAMATION Mayor Higginson read a proclamation for "Friends of the Library Month" for September, 1993 and presented it to Becky Stawiski, Membership Chair of the Friends. PUBLIC ORAL COMMUNICATIONS Mayor Higginson explained the procedure for Public Oral Communications. The following persons were present wishing to speak. Robert Good, 12730 Soule Street, expressed safety concerns about the proposed San Diego Gas & Electric pipeline in Pomerado Road and suggested they install it in 1-15 instead rather than through a residential neighborhood. Peggy Shea, 12423 Paseo Colina, stated she had learned that some of the answers she was given regarding lighting district assessments were not correct. Mayor Higginson suggested she meet with city staff to review the information she had received. 4987 Page 2 - CITY OF POWAY - September 7, 1993 CONSENT CALENDAR Motion by Councilmember Emery, seconded by Councilmember Callery to approve the Consent Calendar as follows: 6. Ratification of Warrant Register - August 12, 18 and 19, 1993 (401-10) e Approval of an amendment to the Regional Solid Waste Management Plan to include approval of the Organic West, Inc., composting facility site in Otay Mesa. (1170-04) Allocation of $3,500 Grant Funds from the SANDAG Bicycle Facilities Committee for the printing of bicycle safety brochures to be used in presentations at local schools and community organizations. (401-30) o Receive and file annual review of CalMat Poway Conditional Use Permit Reclamation Plan 89-05 for aggregate extraction and processing activities on a 166 acre site; located on the north side of Beeler Canyon Road, south of Kirkham Way, South Poway area. (203-08) 10. Adoption of Resolution No. P-93-44, entitled, "A Resolution of the City Council of the City of Poway, California Approving Temporary Use Permit 93-45," a closed loop bicycle race on Stowe Drive, Danielson Street and Crosthwaite Circle in the South Poway Business Park on September 12, 1993; The Ranchos Cycling Club/Alan Tragarz, applicant. (203-07) 11. Adoption of Resolution No. 93-139, entitled, "A Resolution of the City Council of the City of Poway, California Establishing a "Loading" Zone on Garden Road and Rescinding Resolution No. 93-039." (1160-01) 11.1 Adoption of opposition to SB 1255 which would impose a $5 penalty for every $10 of parking fines and asset forfeiture for schools. (701-11) 11.2 Approval of contract with David M. Griffith & Associates to prepare mandated cost claims for law enforcement activities; and appropriate $3,500 for up-front costs. (602-01, #998) 11.3 Approval of Tax Sharing Agreement with the County of San Diego (approved in concept May 25, 1993, Item 11). (602-01, #01R) Motion carried unanimously. ITEM 5 (701-04) ORDINANCE NO. 420 PERS AMENDMENT/TWO PERCENT AT 55 Mayor Higginson read the title of Ordinance No. 420, "An Ordinance of the City of Poway, California Authorizing an Amendment to the Contract Between the City Council and the Board of Administration of the California Public Employees' Retirement System and Declaring the Urgency Thereof." Staff report by City Manager Bowersox. The final step in effecting a contract amendment with the 4988 Page 3 - CITY OF POWAY - September 7, 1993 Public Employees' Retirement System is adoption of the enabling ordinance. This amendment accommodates the city's negotiated agreement with the non-safety employees and the management group. It specifies a retirement formula of 2% of pay at age 55 for each year of service credited with the employer. Motion by Councilmember Emery, seconded by Ordinance No. 420 to be effective immediately. roll call vote. Councilmember Callery to adopt Motion carried unanimously on a CITY MANAGER ITEMS City Manager Bowersox requested a closed session for the purpose of the legislative body reviewing its position and instructing its representative concerning personnel negotiations pursuant to Government Code 54956.6(a). MAYOR AND CITY COUNCIL-INITIATED ITEMS 16. Councilmember Emery stated that Bill Crawford, long-time employee of Poway Unified School District, and member of the City's Library Advisory Committee, has recently died and suggested he be commemorated somehow in the new library. 17A. Mayor Higginson stated he had received a response from CalTrans regarding the criteria they use for opening the HOV lanes during emergencies and he will distribute it to the Council. 17B. Mayor Higginson stated he received a letter today from the owners of Western Lumber with a purchase price for their property and suggested this be added to the agenda for a closed session. Motion by Councilmember Snesko, seconded by Councilmember Emery to make the finding that the need to hold a close session pursuant to Government Code §54956.8, real property transaction, arose within the 72 hours prior to the meeting. Motion carried unanimously. 18A. Councilmember Snesko stated that absentee owners of property are "doing business in Poway" and, as such, should have a business registration certificate. 18B. Councilmember Snesko stated that his concern in 18A is because too many rental properties are poorly maintained and a business registration requirement might help. City Manager Bowersox stated that if the concern is property maintenance, staff will look into ways to establish standards that can be enforced. Frank Spitzer, 16028 Paragon Mesa, realtor, stated that there are many vacancies in Poway with people unable to sell their property. 4989 Page 4 - CITY OF POWAY - September 7, 1993 18C. Councilmember Snesko asked if it would be possible to use low and moderate income housing funds for North County InterFaith Council to provide some transitional housing for the homeless in Poway. They are working with the City of Escondido to renovate an apartment complex. City Manager Bowersox suggested this be referred to the Redevelopment & Housing Advisory Committee. 18D. Councilmember Snesko asked why contract recreation program instructors are receiving a lower percentage of the class revenue than before. City Manager Bowersox stated this was a recommendation approved with both the MSI and Hughes, Heiss reports in an attempt to move toward greater cost recovery. Director of Community Services Thomas stated the move to recover 50% of the cost of youth activities and 75% of the cost of providing adult activities is being phased in over a 3 to 5 year period. CLOSED SESSION Mayor Higginson called for a closed session at 7:32 p.m. CALL TO ORDER AND ADJOURNMENT Mayor Higginson called the meeting back to order at 8:05 p.m. and announced that the City Council had instructed their negotiator, City Manager Bowersox, for personnel negotiations and real property negotiations. Upon motion by Councilmember Callery, seconded by Councilmember Emery, Mayor Higginson ordered the meeting adjourned in memory of Bill Crawford. The time of adjournment was 8:05 p.m. Marjor~e~K.
