CC 1993 09-21 CITY OF POWAY, CALIFORNIA MXNUTES OF THE CXTY COUNCXL REGULAR MEETXNG SEPTEHBER 21, 1993 The September 21, 1993, regular meeting of the City Council of the City of Poway, was called to order at 7:04 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive, Poway, California. COUNCILNEHBERS PRESENT AT ROLL CALL Mickey Cafagna, Susan Callery, Bob Emery, Tony Snesko, Don Higginson STAFF MEMBERS PRESENT James Bowersox Marjorie Wahlsten Steve Eckis John Fitch Mark Weston Reba Wright-Quastler Randy Williams Patrick Foley Peter Moote Penny Riley City Manager City Clerk City Attorney Assistant City Manager Director of Engineering Services Director of Planning Services Director of Public Services Principal Management Analyst Senior Management Analyst Management Analyst PLEDGE OF ALLEGIANCE Representatives from Boy Scout Troops 608 and 1800 led the Pledge of Allegiance. PRESENTATIONS Mayor Higginson presented employee suggestions awards to Senior Management Analyst Peter Moote for his suggestion to have a self-pay entry station at Lake Poway during the week when the entry booth is not manned; and to Park Maintenance Worker III Mike Towne for his suggestion to install time clocks in city facilities in order to reduce electricity use. Mayor Higginson proclaimed October g, 1993 as "Sweater Saturday" and presented the proclamation to Arlene Potterton, Senior Community Relations Representative for SDG&E. They will be collecting sweaters and sweatshirts for the elderly and homeless. Janet Fairbanks, SANDAG Project Manager, gave a slide presentation regarding the North County Multiple Habitat Conservation Plan. (602-01, #901) 4997 Page 2 - CITY OF POWAY - September 21, 1993 PUBLIC ORAL COMMUNICATIONS Mayor Higginson explained the procedure for Public Oral Communications. The following persons were present wishing to speak: Larry Cruse, 13734 Utopia, asked about the status of an electronic city hall; requested that a copy of the city's record retention schedules be on file at the library; and asked if a municipal golf course is being discussed. Chris Jensen, 12719 Robison Blvd., asked why so many lap lanes at the community pool are used by the swim clubs. He stated that they were using eight of the ten lap lanes today. (Councilmember Cafagna left the meeting.) CONSENT CALENDAR Motion by Councilmember Emery, seconded byCouncilmember Callery, to approve the Consent Calendar as follows: Ratification of Warrant Registers: August 25, August 26, and September 2, 1993. (401-10) 6. Denial of claim for damages: John Pfannenstiel (704-13) Award of bids: A) Live Catfish to Valley Fish Farms in the amount of $1.70 per pound or $10,540 annually; and B} Live Trout to Whitewater Trout Company in the amount of $2.19 per pound or $70,080 annually. (601-03) Acceptance of Belvedere Waterline from H.S. Excel Corporation. (5709) (602-01, #188R) Adoption of Resolution No. 93-145, entitled, "A Resolution of the City Council of the City of Poway, California Establishing a "No Parking" Zone on Carriage Road North of Poway Road," that extends north 275 feet. (1163-01) 9.1 Approval of modification to contract with Mel Smith Electric for Poway Royal Estates Mobilehome Park Electrical Renovation to add gas line replacement for Phase II. (602-01, #180R) Motion carried 4-0 with Councilmember Cafagna out of the room. (Councilmember Cafagna re-entered the meeting.) 4998 Page 3 - CITY OF POWAY - September 21, 1993 CITY HANAGER ITEMS 10. City Manager Bowersox congratulated Director of Planning Services Wright- Quastler for her recent election as President-Elect of the California Chapter of the American Planning Association. CITY ATTORNEY ITEMS llA. City Attorney Eckis requested a closed session pursuant to Government Code §54956.8, real property transaction, Western Lumber site, and announced that negotiators will be City Manager Bowersox for the city; Mike McMahan and Attorney Bob Bell for Western Lumber. 118. City Attorney Eckis requested a closed session pursuant to Government Code §54956.8, real property transaction, former Longs Drug Store, and announced that negotiators will be City Manager Bowersox for the city; Ed Malone, Bob Carson, Mike Perry and Attorney Bob Bell for the purchaser. 11C. City Attorney Eckis requested a closed session pursuant to Government Code §54956.g{a), pending litigation, City of Poway v. Parkway Business Center. 11D. City Attorney Eckis announced that the Fair Political Practices Commission has adopted a regulation defining "public generally" as 10% of the population or 5,000, whichever is less. In our case it would be 4,600 or 10% of our population. CLOSED SESSION Mayor Higginson called for a closed session at 7:40 p.m. as requested by the City Attorney. CALL TO ORDER AND ADJOURNMENT Mayor Higginson called the meeting back to order at 8:50 p.m. with all Councilmembers present and announced that direction had been given to the City Attorney and the City's negotiator during closed session.
