RESOLUTION NO. 06-086
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA
APPROVING THE GRANT AGREEMENT WITH THE CALIFORNIA CULTURAL
AND HISTORICAL ENDOWMENT (CCHE) UNDER THE CALIFORNIA
CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS,
AND COASTAL PROTECTION ACT OF 2002
WHEREAS, the people of the State of California have enacted the California
Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002,
which provides funds to the State of California for the California Cultural and Historical
Endowment (CCHE) Grant Program; and
WHEREAS, the City of Poway has been awarded a grant for the capital asset
project entitled Kumeyaay-Ipai Interpretive Center Phase I; and
WHEREAS, the California Cultural and Historical Endowment (CCHE) has been
delegated the responsibility for the creation and administration of the Grant Agreement
between the City of Poway and CCHE; and
WHEREAS, the Grant Agreement requires the City of Poway to certify by
Resolution the approval of the Grant Agreement and its terms before execution of the
Agreement; and
WHEREAS, upon execution of the Agreement and approval of its terms and
conditions, the City of Poway will perform all of the tasks stated in the Agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1. The City approves the terms and conditions of the Grant Agreement
to be funded from the California Clean Water, Clean Air, Safe Neighborhood Parks, and
Coastal Protection Act of 2002.
Section 2. The City certifies that it has or will have sufficient funds to operate
and maintain the Project.
Section 3. The City certifies that it has reviewed, understands, and agrees to the
Grant Agreement.
Section 4. The City Manager is authorized to execute the Agreement. The
Director of Public Works is authorized to conduct all negotiations, execute and submit
all documents including but not limited to the Scope of Work, CCHE Invoices, CCHE
Progress Reports, CCHE Final Reports, and other documentation that may be
necessary for the completion of the Project. The Public Works Operations Manager is
appointed as the Project Manager.
