Item 11 - An Ordinance Adopting the Titan Way Engineering and Traffic SurveyNovember 16, 2021, Item #11DATE: TO: FROM: CONTACT: SUBJECT: Summary: AGENDA REPORT CityofPoway November 16, 2021 Honorable Mayor and Members of the City CouncJ" Robert Manis, Director of Development Services ft'\ Melody Rocco, City Engineer ~ (858) 668-4653 or mrocco@poway.org CITY COUNCIL An Ordinance Adopting the Titan Way Engineering and Traffic Survey Speed limits are set by adopting an Engineering and Traffic Survey (E& TS) in accordance with the California Vehicle Code (CVC) and the California Manual on Uniform Traffic Control Devices (MUTCD). An approved survey is valid for seven years and can be extended to ten years if the roadway conditions have not changed. Titan Way is currently posted at "25 mph when Children are Present." However, the posted speed has not been set by an E& TS. Titan Way was not studied in the most recent 2019 E& TS adopted by the City of Poway in April 2020 because the segment is short, it is in front of Poway High School, and the pedestrian activity in the area generally resulted in lower speeds on Titan Way. During the COVID-19 Pandemic no pedestrian activity was present due to the school closure and there was a concern about higher speeds for this segment. Since then, a request has been made by the Sheriff's Department to conduct a speed survey which would allow a speed limit to be set. Recommended Action: It is recommended that the City Council take public input, close the public hearing and introduce the Ordinance (Attachment A) for first reading by title only, waive further reading, and schedule the adoption for December 7, 2021. Discussion: Sections 22357 and 22358 of the eve give local municipalities the authority to set speed limits below the maximum speed limits set forth by State law, where such speed limits are supported by an Engineering and Traffic Survey. On April 21, 2020, the City Council approved Ordinance 841 adopting the 2019 Engineering and Traffic Survey (2019 E& TS). The City's 2019 E& TS was prepared pursuant to the guidelines of the current MUTCD, which calls for speed limits to be established to the nearest 5 mph increment of the 85th percentile speed. For example, if the 85th percentile speed is 37 mph, the speed limit should be posted at 35 mph. However, 1 of7 November 16, 2021, Item #11if the 85th percentile speed is 38 mph, the speed limit should be posted at 40 mph. The manual allows a speed limit to be reduced from the 85th percentile speed by 5 mph due to a collision rate that is higher than the State average for that type of facility. The reduction is intended to assist in lowering the collision rate for the roadway segment. A reduction can also be taken for "non-apparent conditions" such as bicycles, pedestrians, vehicles, and intersections not readily visible to drivers. However, if the speed limit has been reduced 5 mph due to the collision rate, it cannot be lowered another 5 mph for "non-apparent conditions". The following traffic and safety conditions could potentially be used as conditions that are not apparent to drivers: driveways directly abutting the roadway with frequent turns, insufficient sight distances, mid-block pedestrian and/or equestrian crossings, and pedestrians and bikers within and along the roadway. Roadway physical conditions, such as width, curvature, grade and surface conditions, or any other condition readily apparent to a driver, in the absence of other factors, would warrant a speed reduction, as the basic rule of section 22350 is sufficient regulation as to such conditions. The proposed Titan Way E& TS (Attachment B) was prepared using the guidelines of the current MUTCD and will enable Sheriffs Deputies to use radar for traffic speed enforcement and provide the legal authority for court requirements. Speed survey data was collected in September 2021. This data was collected to support the setting of a speed limit on this road. Due to the proximity to the high school, the posted speed limit on this segment of Titan Way is 25 mph when children are present. The measured 85th percentile speed was 32 mph. Based on this data, the speed limit should be rounded down to 30 mph, and using the previously described MUTCD speed reduction allowance for mid-block pedestrian crossings, could be set at 25 mph. At the October 13, 2021 Traffic Safety Committee (TSC) meeting, staff recommended setting the speed limit at 25 mph on Titan Way. The TSC voted unanimously to support staff's recommendation. There were no residents in attendance at the TSC meeting for the Titan Way speed survey item. Attachment B provides the proposed E& TS for Titan Way. Upon adoption of the ordinance setting the speed limit on Titan Way at 25 mph, staff would remove the existing "25 mph when Children are Present" signs and replace with standard 25 mph speed limit signs and paint speed limit legends on the pavement. New School Zone signs will also be added to reinforce the presence of children near the school. Environmental Review: This item is exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to Section 15061 (b)(3) of the CEQA Guidelines as it entails adoption of an Engineering and Traffic Survey and establishing speed limits on one road segment, and there is no possibility that this will have a significant effect on the environment. Fiscal Impact: There are sufficient funds available in the Street Striping Account (411040-43300) to install new speed legends estimated at $500, and in the Sign Maintenance Materials Account (411040-45300) to make the speed limit sign changes estimated at under $250. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, ADOPTING THE TITAN WAY ENGINEERING AND TRAFFIC SURVEY WHEREAS, Sections 22357 and 22358 of the California Vehicle Code give local municipalities the authority to set speed limits below the maximum speed limits set forth by State law, where such speed limits are supported by an Engineering and Traffic Survey; WHEREAS, Section 627 of the California Vehicle Code defines the Survey requirements deemed necessary by the State; WHEREAS, Section 10.32.010 of the Poway Municipal Code allows the City Council to determine the most appropriate speed limits on certain streets within the City Limits based on an Engineering and Traffic Survey; and WHEREAS, the Titan Way Engineering and Traffic Survey, included in the staff report as Attachment B, has been prepared in accordance with Section 627 of the California Vehicle Code and Section 28.13 of the California Manual on Uniform Traffic Control Devices to set speed limits in the City of Poway. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES ORDAIN AS FOLLOWS: SECTION 1: The above recitations are true and correct. SECTION 2: The City Council finds that the adoption of this Ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA), pursuant to Section 15061 (b)(3) of the CEQA Guidelines, as it entails adoption of an Engineering and Traffic Survey and establishing speed limits on several road segments, and there is no possibility that this will have a significant effect on the environment. SECTION 3: The Titan Way Engineering and Traffic Survey is hereby adopted. SECTION 4: This Ordinance shall be codified.
