Katherine Hirsch, referencing the preliminary findings from the Community Park Needs Assessment, spoke regarding impact and cultivation of the arts. Adoption of Resolution to Continue the Existence of a Local Emergency Within the City of Poway Due to the Novel Coronavirus (COVID-19) Global Pandemic 4. Adoption of the 2022 City Council Meeting Calendar 5. Resolution Authorizing the Updated Emergency Response Plan and Emergency Operations Center Handbook 6. Approval of Agreement with PROS Consulting for a Cost of Services and Fee Study of the Pmvay Center for the Performing Arts and Appropriate Funds for the Completion of the Study 7. Authorization to Purchase: One (1) Compact Track Loader, One (1) Medium Duty Truck with Plumbers Depot Equipment, Three (3) Full-size Cab/ Chassis Only, and Three (3) 3-4 Yard Steel Construction Dump Bodies through the Sourcewell Cooperative Purchase Agreement, the State of California Department of General Services State Contract, and a Competitive Bid Process In response inquiry by Councilmember Grosch, Director of Finance Aaron Beanan confirmed that the funds for the purchase of equipment are from sewer and or water funds. 8. Approval of Final Map for Tentative Tract Map 19-002; Kevin McNamara, Applicant. (APNs: 273-110-07, 273-110-08, and 273-110-18) Yuri Bohlen spoke regarding "The Farm" and asked if the 160 homes are part of the regional housing element allocation. 3 of 8November 16, 2021, Item #2 City of Poway -Minutes -October 19, 2021 In response to inquiry by Mayor Vaus, City Engineer Melody Rocco explained that once the final map is approved, officially the lots are created. She stated the applicant is in the process of getting a grading permit and will be finalizing the improvement plan, which is required for the final map. City Planner David De Vries explained that a large portion of the site is located in the very high fire hazard area, therefore the new tree species must be sensitive to that area. He added that the trees that are being removed will be replaced in kind in an approximate two to one ratio. In response to Council inquiry, Ms. Rocco stated that public improvements must be completed before occupancy and stated there is not a timeline to finish the project. The Farm subdivision applicant, Kevin McNamara, thanked staff for their hard work. City Planner David De Vries confirmed that the new homes do count toward Poway's allocation of the Regional Housing Needs Assessment. ORDINANCES FOR INTRODUCTION 9. Ordinance Amending the Poway Municipal Code Regarding Solid Waste Collection and Disposal Reduction Requirements Management Analyst Amelia Dominguez presented the report. Ms. Dominguez explained that the proposed Ordinance is a required action to comply with state regulations that take effect in January 2022. The regulations affect commercial and multi-family accounts, franchise haulers and self-haulers, commercial edible food generators and food recovery organizations and services and added that SB 1383 compliance is required by January 1, 2022. In response to Council inquiry, Ms. Dominguez further explained the differences between Tier I Generators and Tier II Generators. She stated the size of the venue and amount of people served daily and provided examples such as a stadium would be considered a Tier I Generator, whereas Tier II Generators are smaller businesses. Ms. Dominguez explained there will be outreach programs to further educate the community on these new regulations. In response to Council inquiry, Ms. Dominguez explained that community food connection will report annually and track how much of the food is being received from commercial business and food organizations and the amount of food that is disposed of. Motioned by Mayor Vaus, seconded by Councilmember Grosch introduce Ordinance No. 849 entitled "An Ordinance of the City Council of the City of Poway, California, Amending Sections 8.68.010, 8.68.020, 8.68.030, 8.68.195, 8.68.400 and Adding 8.68.225 and 8.68.230 to Chapter 8.68 (Solid Waste Management) of the Poway Municipal Code" and schedule adoption of the Ordinance for November 2, 2021. Second Reading and Adoption of Ordinance No. 848 entitled "An Ordinance of the City Council of the City of Poway, California, Approving Specific Plan Amendment 19-002 to the South Poway Specific Plan to Allow Wireless Communication Facilities to Have a Maximum Height of 90 Feet as a Conditionally Permitted Use" Yuri Bohlen spoke in opposition noting a potential for future issues if adopted. Motioned by Councilmember Mullin, seconded by Councilmember Frank to adopt Ordinance No. 848 entitled "An Ordinance of the City Council of the City of Poway, California, Approving Specific Plan Amendment 19-002 to the South Poway Specific Plan to Allow Wireless Communication Facilities to Have a Maximum Height of 90 Feet as a Conditionally Permitted Us". Approval of Agreement with Feeding the Soul Foundation dba O'side Kitchen Collaborative to Provide Catering Services for the Older Adult Congregate Meal Program at the Mickey Cafagna Community Center and Appropriation of Funds Assistant City Manager Wendy Kaserman presented the report. She explained the City in partnership with the Poway Valley Senior Citizens Corporation (PVSCC) took over providing older adult services when the Mickey Cafagna Community Center (MCCC) opened. The PVSCC has shifted its focus to activities that generate funding to offset the costs of the City providing older adult programming, including bingo and operating the ReRuns Resale Shop. While some structured and unstructured programming is being provided at the MCCC, the City and PVSCC have been working diligently to resume a congregate meal program. Unfortunately, the former Poway Senior Center lost the County nutrition grant which had previously funded the congregate meal program. After speaking with the County, there is no opportunity for the City to apply for these funds in the near future. Recognizing the importance of re-establishing a congregate meal program, the City and PVSCC are partnering to offer the program. The City Council is being asked to approve and an agreement with Feeding the Soul Foundation dba O'side Kitchen Collaborative (OKC) for adult congregate meals. The program will be offered Monday through Friday beginning November 1, advance reservations will be required. Program participants will pay $5 toward the cost of each meal and the PVSCC will reimburse the City for the remaining $5.50 in meal costs as well as the daily setup fee of $150. The costs per meal decrease after the first 50 meals in a day. Ms. Kaserman noted this is a short-term agreement that will provide time for the City to issue a request for proposals to 5 of 8November 16, 2021, Item #2 City of Poway -Minutes -October 19, 2021 select a long-term meal provider. The City will pay the invoices to OKC and then request reimbursement from the PVSCC for a portion of the costs. Cynthia Elizondo, President of the Poway Valley Senior Citizens Corporation, now known as the Friends of the Poway Seniors, thanked the City Council and spoke in support of the meal program. Ms. Elizondo noted that the Reruns Resale Shop, one of the major fundraising endeavors to support senior programming along with Bingo are both not only profitable but have proven to be good social outlets for seniors in the community. Additionally, she added that they were recently awarded an IRS grant to provide free tax preparation services to 500 local seniors starting in February 2022. Yuri Bohlen spoke in support of the agreement, he added that seniors in the community need this program to feel included. In response to Council inquiry, Assistant City Manager Wendy Kaserman spoke regarding funding and explained that Community Development Block Grant (CDBG)-Coronavirus grant money is being used to fund a weekly drive-thru meal program that was originally at the temporary Poway Senior Center and is now being offered at the MCCC. Program participants pick-up one week's worth of prepared food to take home. The drive-thru program differs from the proposed sit-down congregate meal program and will continue until all grant funds are expended. Ms. Kaserman stated that food for the congregate meal program will be prepared off-site, transported, and served hot to the members of the community, she added that once a long-term provider is identified, the goal is to use the commercial kitchen at the MCCC to prepare meals onsite. Motioned by Councilmember Frank, seconded by Councilmember Mullin, to approve the Agreement and authorize the City Manager to execute all necessary documents associated with the Agreement between the City of Poway and Feeding the Soul Foundation dba O'side Kitchen Collaborative (OKC) to provide catering services for the Older Adult Congregate Meal Program at the Mickey Cafagna Community Center and appropriate funds to pay for the service prior to the City receiving both participant fees and reimbursement from the Poway Valley Senior Citizens Corporation. Motion carried unanimously. 12. Approve the Execution and Delivery of an Installment Purchase Agreement for the Purpose of Causing the Issuance of Not to Exceed $15,000,000 Aggregate Principal Amount of Water Revenue Bonds, Series 2021A, and Approving the Execution and Delivery of Certain Documents in Connection Therewith and Certain Other Matters. Director of Finance Aaron Beanan explained Phase 1 of Series 2021 Water Revenue Bonds, a not-to-exceed $15,000,000 debt issuance, including project financing, it being a level dollar structure and it being a 30-year term bond. He introduced financing documents including indenture of trust, installment purchase agreement, and bond purchase agreement. He also introduced the preliminary official statement, continuing disclosure agreement, along with a debt management policy and a Standards & Poor's credit rating. He explained this was the first of three planned debt issuances to finance the Water Infrastructure Improvement Program and that the other two issuances were being timed and sized based on the project cash flow needs. Yuri Bohlen spoke in opposition of the Clearwell Water project and wanted to see reference to discussions of the water project prior to August 6, 2019. 6 of 8November 16, 2021, Item #2 City of Poway -Minutes -October 19, 2021 In response to Council inquiry, Mr. Beanan further explained the recourse if the Agreement was not approved by the Council. Mr. Beanan stated there were two possible options. The first option would be to pursue other projects with pay as you go financing requiring a 45% rate increase in the first year to fund 70 million dollars' worth of projects. The second option would be to do nothing leaving the water infrastructure as is. He spoke about how the different funds listed in the Bond Purchase Agreement, with the exception of the rate stabilization fund, will help to segregate the assets on the Trustee's end, not City side, as we make debt service payments. We are required to maintain a certain level of debt service coverage. As we make payments to the rate stabilization funds from prior year excess revenue, we have the potential to roll over the prior year excess revenues in the rate stabilization fund to help meet our debt service coverage requirements without requiring a rate increase. He stated there are call protection provisions to give investors' confidence on the shorter maturities that we are not going to call their bonds and shorten their investment. He also stated we have the right to prepay. In the event of the possibility of windfall such as from a grant, we could allocate the grant funds to reduce the rates. Motioned by Councilmember Mullin, seconded by Councilmember Grosch, to adopt Resolution No. 21-085 entitled "A Resolution of the City Council of the City of Poway, California, Approving the Execution and Delivery of an Installment Purchase Agreement for the Purpose of Causing the Issuance of Not to Exceed $15,000,000 Aggregate Principal Amount of Water Revenue Bonds, Series 2021A, and Approving the Execution and Delivery of Certain Documents in Connection Therewith and Certain Other Matters." Motion carried unanimously. Motioned by Authority Director Mullin, seconded by Authority Director Frank, to adopt Resolution No. F-21-001 entitled "A Resolution of the Board of Directors of the Poway Public Financing Authority Approving the Sale of Its Water Revenue Bonds, Series 2021A, In an Aggregate Principal Amount Not to Exceed $15,000,000 and Approving the Execution and Delivery of Certain Documents in Connection Therewith and Certain Other Matters." Deputy Mayor Leonard shared the Kiwanis Club would be holding a pancake breakfast to honor the residents of Villa De Vida on November 12th and will be holding a blood drive the following day.
