CC 1993 11-02 CITY OF POWAY, CALIFORNIA NINUTES OF THE CITY COUNCIL REGULAR MEETING NOVEMBER 2, 1993 The November 2, 1gM3, regular meeting of the City Council of the City of Poway, was called to order at 7:04 p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive, Poway, California. COUNCILMEMBERS PRESENT AT ROLL CALL Mickey Cafagna, Susan Callery, Bob Emery, Tony Snesko, Don Higginson STAFF NEMBERS PRESENT James Bowersox Marjorie Wahlsten Steve Eckis John Fitch Peggy Stewart Bob Thomas Mark Weston Reba Wright-Quastler Randy Williams Penny Riley City Manager City Clerk City Attorney Assistant City Manager Director of Administrative Services Director of Community Services Director of Engineering Services Director of Planning Services Director of Public Services Management Analyst PLEDGE OF ALLEGIANCE Boy Scout Troop 479 led the Pledge of Allegiance. PRESENTATION Mayor Higginson presented a plaque to Bob Siebenthaler, Code Compliance Officer, from the California Code Enforcement Council for his service as President of their organization. PUBLIC ORAL COMMUNICATIONS Mayor Higginson explained the procedure for Public Oral Communications. The following persons were present wishing to speak: Charles Cross, 13514 Mora Circle, representing the Poway Soccer Club, thanked the City Council for soccer fields at Hilleary Park and Twin Peaks School. Darlene Davis, 2912 Ingelow Street #4, San Diego, asked the City to vote 'no' on MTDB administering the City of San Diego's paratransit contract. Peggy Shea, 12423 Paseo Colina, again stated that she was not given the correct information regarding mobile home parks begin assessed for the lighting district. She also asked why the payroll has doubled for lighting district administration. 5031 Page 2 - CITY OF POWAY - November 2, 1993 William Scandalis, 12881 Indian Trail, coach for the United Poway Swim Team, stated that since the pool is now closed from 1:30 to 3 p.m. the Rancho Bernardo Water Polo Team cannot practice. He asked that the pool be opened for them. He also stated that the recent issue of Poway Today offers a Master's Swim Program for free. Other agencies make this a revenue producing program. He also stated that the pool temperature is dropping. His thermometer showed it to be 75 degrees when the City's thermometer shows it at 81 degrees. Ian Caswell, 15846 Cumberland Drive, stated his family had moved here because of Poway Unified School District and the United Poway Swim Club. Chris Jensen, 12719 Robison Boulevard, #16, thanked the City Council for their action to give the public more access to lap lanes. CONSENT CALENDAR Motion by Councilmember Emery, seconded by Councilmember Callery to approve the Consent Calendar as follows: 8. Ratification of Warrant Register - October 14, 1993. (401-10) 9. Denial of claim for damages: Auto Club of So. California for Jeff Ezor. (704-13) 10. Appropriation of $14,120 from Poway's Transportation Development Act (TDA) Capital Reserve Fund for the Creekside Plaza bus stop and the Lake Poway transit call box. {401-30) 11. Renewal of contract to SunCal Outdoor Advertising to maintain and administer the City Residential Kiosk Program. (602-01, #894) 12. Acceptance of pedestrian bridge on Poway Creek at Bowron Road; and lighting for two existing pedestrian bridges on Poway Creek from Western Contracting Company. {602-01, #992) 13. Adoption of Resolution No. 93-158, entitled, "A Resolution of the City Council of the City of Poway, California Establishing a Yield Sign on Poquito Street at Buckskin Trail." {1160-01} Motion carried unanimously. ITEM 5 (602-01, #199) GOLDEN WAY SEWER REIMBURSEMENT AGREEMENT Mayor Higginson opened the public hearing. Staff report by City Manager Bowersox. The City Attorney has determined that the reimbursement agreement 5032 Page 3 - CITY OF POWAY - November 2, 1993 prepared by staff for the sewer main construction in Golden Way is not appropriate. Staff is recommending this item be removed from calendar in order for staff to review other funding mechanisms. Speaking in opposition to staff recommendation: James Francella, 13103 Golden Way, urged staff to expedite this project as they are having problems with their septic system. Motion by Councilmember Cafagna, seconded by Councilmember Emery to remove this item from calendar. Motion carried unanimously. ITEM 6 (401-22) YOUTH RECREATION SCHOLARSHIPS Staff report by Director of Community Services Thomas. This program would provide scholarships to subsidize the recreation class fees of Poway resident youth who are in need of financial assistance in order to participate. Funds to support this program will be solicited from corporations, service clubs, and individuals. Program criteria have been established, based on input from other cities in the County and the Parks and Recreation Advisory Committee. (Councilmember Cafagna left the room during this report.) Motion by Councilmember Snesko, seconded by Councilmember Callery to approve the Youth Recreation Scholarship Program. Motion carried 4-0 with Councilmember Cafagna out of the room. ITEM 7 (1403-13) RECYCLING MARKET DEVELOPMENT ZONE Staff report by City Manager Bowersox. The California Integrated Waste Management Board is soliciting applications for designation as a Recycling Market Development Zone (RMDZ) which would require an agency to identify additional incentives to recycling and recycled product manufacturing businesses to locate within the RMDZ. Staff from North County cities have begun discussions regarding benefits of obtaining such a designation collectively. Approval from each City Council is required to proceed further. Motion by Councilmember Snesko, seconded by Councilmember Emery to adopt Resolution No. 93-159, entitled, "A Resolution of the City Council of the City of Poway, California Approving the Development of an Application to the California Integrated Waste Management Board for Recycling Market Development Zone Designation," direct staff to investigate and report on the opportunities and benefits of participation, and assist in the preparation of an application to be approved by the City Council. Motion carried 4-0 with Councilmember Cafagna out of the room. 5033 Page 4 - CITY OF POWAY - November 2, 1993 (Councilmember Cafagna re-entered the meeting.) CITY MANAGER ITEMS 14. City Manager Bowersox reported that the fire in the north part of the city has burned 1,500 acres but there were no residences lost. The source of the fire has not been determined. MAYOR AND CITY COUNCIL-INITIATED ITEMS 19. Mayor Higginson asked that his item of discussion of permanent solid waste entity be continued to November 16, 1993 since the November 5, 1993 Interim Commission's workshop has been rescheduled to later in the month. 20A. Speaking under Councilmember Snesko's item of change in revenue split between City and contract recreation instructors were the following: Marlys West, 12813 Selma Court, 8 year instructor of "Let's Make Music Class" through the Community Services Department. Sharon Mello, 13805 Paseo Cevera, San Diego, co-instructor with Ms. West. Deborah Childress, 714 S. Citrus, Escondido, children's dance instructor through the Community Services Department. Speakers suggested the Council needs to decide if these classes are to provide a service or make money. They objected to the decrease in their portion of the class revenue and cited communication problems with staff and problems with the registration process. Councilmember Snesko suggested staff needs to meet with the instructors. He stated the cost cited by the City for their staff time per hour of class is too high and the City should pay for the insurance for the classes, not require the instructors to provide their own insurance. City Manager Bowersox stated this is a broad policy issue and the MSI report approved by the City Council on April 22, 1993 proposed that the City recover a greater percentage of its costs for the recreation programs. This new revenue split with the instructors works towards that goal. Mayor Higginson requested a report from staff on the issues raised by the instructors, and the policies adopted with the MSI report. 2OB. Councilmember Snesko stated he had met with Sheriff Roache three weeks ago to request a six month trial of taking into custody persons committing misdemeanors that do not have identification and booking them in the same manner as drunk drivers. City Manager Bowersox stated the Sheriff or his representative will be at the November 9, 1993 meeting. 5034 Page 5 - CITY OF POWAY - November 2, 1993 Gerardo Camacho, 14291 Mariana Drive, stated the Sheriff should not be asked to determine if a person is in this country legally since the only way to prove legal citizenship is with a certified birth certificate or a passport and very few citizens carry those documents with them. This is a problem for the Federal government to solve, not the City of Poway.
