MINUTES OF THE CITY COUNCIL ADJOURNED REGULAR HEETING
NOVEMBER 12, 1993
The November 12, 1993, meeting, adjourned from the November 9, 1993 regular
meeting of the City Council of the City of Poway, was called to order at 7:00
p.m., by Mayor Higginson at the City Council Chambers, 13325 Civic Center Drive,
Poway, California.

IMMIGRATION REFORM LEGISLATION
Assemblyman Jan Goldsmith and Border Patrol Supervisor Teddy Hampton were present
to discuss with Council and the public current pending legislation in the State
Legislature and current issues faced by the Border Patrol. Mayor Higginson
stated that Congressman Duke Cunningham was scheduled to be present however he
had to cancel.
Assemblyman Goldsmith stated he believes there are three approaches to the
problem: secure the border, enforce laws against employment of illegal
immigrants, and prevent taxpayer funds from being used to provide services for
illegal immigrants. He co-authored five bills which were enacted this session
and signed by the Governor. Other bills to be considered in the next session
include AB 2402, AB 2404 and AB 86 which would create state crimes for conduct
that violates the federal immigration laws. They would enable local enforcement
of federal immigration laws.
He stated that the City could assist in getting the League of California Cities
to rescind their Resolution supporting the immigrants because of the cheap labor
force they supply and citing economic benefits to the State. He also suggested
the City work to get someone appointed to the Governor's Task Force on
Immigration.

Mr. Hampton, in response to a proposal raised by Councilmember Snesko some time
ago, stated that there is currently no provision for a city to contract with the
Border Patrol for additional enforcement. Federal enabling legislation would be
necessary.
He also explained that the Border Patrol is the law enforcement side and cannot
interfere with the Immigration and Naturalization Service. He stated there are
currently several programs an immigrant can seek legal status under and can
continue to stay in this country until their cases are decided. The documents
they are provided during that time are easily duplicated or forged which makes
the job of determining if they are legally here very difficult.
Citizens present to speak included:
Bill Hickey, 13204 Ridgedale Drive, asked about the cost of Assemblyman
Goldsmith's legislation.
DeAnne Erickson, 15051 Vali Hai Road, suggested citizens should get
involved and report illegal camping or shoplifting to the proper
authorities.
Joe Nalven, 14738 Shadowbrook Court, stated a national identification card
is essential in screening out misuse of resources.
Kathy Ries, 13530 Old Winery Road, stated persons illegally camping should
be cited and fingerprinted.
Council discussed several items including a national identification card with a
hologram making it impossible to forge and need for citizen involvement since
city resources are limited.
ADJOURNMENT
Mayor Higginson adjourned the meeting at 8:45 p.m. on motion by Councilmember
Callery, seconded by Councilmember Snesko.
