The order proposes to shorten the time cities have to process applications for small cells to either 60 or 90 days, depending on whether they are being mounted on an existing or new structure; Limit application fees for small cells to $100 per site, and recurring fees to $270 per site, per year, for small cells in the rights-of-way; Prohibit cities from assessing fees that include anything other than a “reasonable approximation” of “reasonable costs” directly related to maintaining the rights-of-way and the small cell facility; and Limit aesthetic review to what is published by the governing jurisdiction. As a result, staff has created and posted a bulletin using existing policies and regulations to guide applications and agreements for the establishment of small wireless facilities within the City right-of-way. The effective date of the order was January 14, 2019, however, the City Attorney believes that this order will likely be challenged and will not be effective for several months if at all. Hop Stop Minor Development Review Application (MDRA18-039) at 14055 Midland Road The Hop Stop, a restaurant serving craft beers, has submitted an application to construct a new building and patio cover at the north end of Old Poway Village shopping center. The Hop Stop wants to establish a restaurant with a large covered outdoor dining area using the existing building and outdoor area formerly occupied by the Poway Pond and Garden business. The new proposed building would contain the kitchen and restroom facilities. They are also proposing to create an outdoor game area for use by patrons. The architecture of the new building and structures would be in keeping with the historic architecture of the shopping center. Warmington Residential Pre-Development Conference Request (PDC19-001) south of Poway Road and southeast of the cul-de-sac terminus on Golden Way Warmington Residential has requested a pre-development conference with the City Council. The proposed development consists of 19 detached townhome style units on a two-parcel site (2.73 total acres), located in the western Garden Road area on Golden Way. A neighborhood park is included as a part of the proposal. The proposed development would necessitate rezoning the two parcels from Residential Single Family-2 (RS-2) to Residential Condominium (RC). This would act as a buffer between commercial uses to the north and low-density rural residential uses to the south. Director’s Notes January 16, 2019 Page 2 Serendipity Hospitality Pre-Development Conference Request (PDC19-002) at 14082 Stowe Drive Studio E Architects has requested a pre-development conference with the City Council. The proposed development consists of a 4-story boutique hotel in the South Poway Commercial (SPC) Zone. The 1.23 acre parcel, owned by Serendipity Hospitality, is on the vacant pad adjacent to the Hampton Inn & Suites by Hilton site and would share the same parking area. Pomerado Energy Storage on Stowe Drive (DR 18-010) on a vacant lot on Stowe Drive, between 13615 Stowe Drive and 13655 Stowe Drive An application was submitted to construct a stand alone battery energy storage facility. The facility would be composed of lithium energy batteries installed in containers and other associated equipment to interconnect with 12 kilovolt SDG&E facilities east of the project site on Stowe Drive. The facility would not generate electricity, but would provide a service by receiving energy from the point of connection with the SDG&E electric transmission system, storing energy, and then later delivering energy back to the point of connection. The subject property is currently vacant and compliance with development standards in the South Poway Specific Plan is required. Ridgeview buildings A & B at 14400 and 14500 Kirkham Way There are two new industrial buildings that are in plan check. Both buildings are tilt up only so there will be tenant improvements and occupants determined once the shell buildings are finaled. Building A is 356,588 square feet at 14500 Kirkham Way, APN 323-091-09 and Building B is 174,287 square feet at 14400 Kirkham Way, APN 320-910-90. JL Billet at 12260 Crosthwaite Circle (Previously Green Flash Brewing Company) Business License Application A business license application was submitted by JL Billet LLC (JL Billet) to occupy the space at 12260 Crosthwaite Circle that was previously occupied by Green Flash Brewing Company. JL Billet manufactures ArmaLite Rifle (AR) parts and accessories. Their business license application is “on hold” due to code enforcement violations noted below. JL Billet at 12260 Crosthwaite Circle (Previously Green Flash Brewing Company) Stormwater and Building Violation On January 9, 2019, Poway’s code compliance, engineering and public works staff responded to a complaint of a strange odor emanating from the creek near the Poway Royal Estates. City staff determined that 50 to 100 wooden cask barrels were drained and discharged into the City storm drain outfall and made its way into a detention basin near the corner of Metate Lane and Community Road. Water from within the detention basin flows directly into the creek. City staff located a commercial property at 12260 Crosthwaite Circle which was previously Green Flash Brewing Company with evidence of liquids being poured into a storm drain. Staff noted 50-100 wooden cask barrels being kept in the parking area of the property, and a sour odor was present in the area. Due to the discharge impacting the creek, City staff was required to notify the State Water Quality Board of the incident. D-Max, Poway’s storm water consultant, sent staff to retrieve water samples for further testing in the detention basin. The property owner has been asked to clean the City’s storm drain that was affected by the discharge. Building inspection staff noted evidence of construction activity occurring without a building permit at the location. Their business license application is “on hold” until code enforcement violations are corrected. Director’s Notes January 16, 2019 Page 3 CAPITAL IMPROVEMENTS 36” Water Main Assessment A site meeting was held with the consultant in December to discuss project specifics and timing for the assessment. This project will drain and inspect the 36” water main that connects the clearwell with the City’s water distribution system. Staff is coordinating to have temporary high-line equipment onsite in February to begin set up and testing of the temporary system. The high-line will continue to provide water to the City while the assessment of the water main is completed. The water main assessment is scheduled for the week of March 18. Carport Mounted Photovoltaic System – PCPA Monthly Report For the month of December 2018, the PCPA Carport PV system was estimated to produce 61,176 kWh (red line on both graphs) but under-produced for a total of 59,974 kWh (blue bars on both graphs). During December 2018, the system over-produced all but 11 days. Under production can be attributed to lack of sunshine during cloudy days and/or inclement weather. All mechanical systems appear to be functioning properly. DECEMBER 2018 MONTHLY TOTAL PRODUCTION SINCE PRODUCTION SYSTEM OPERATIONAL Community Park Electrical Upgrades The electrical gear and pedestal equipment have been installed and SDG&E has completed Director’s Notes January 16, 2019 Page 4 their inspection. Staff is currently coordinating the switchover to the new electrical gear. The schedule will be dependent on SDG&E availability. Twin Peaks Driver Feedback Signs The schedule for this project was intended for construction to be complete prior to school resuming last week. Both feedback signs were installed and fully operational, on time. All punch list items are complete. 2018 CMP Repairs Lining work began last week at the Vaughan Road and Tobiasson Road location. All impacted residents/property owners were notified in advance of the work. The lining work is anticipated to take a total of two weeks to complete, depending upon weather. WTP Washwater Tank Upgrades A preconstruction meeting was held last week. This project will rehabilitate Washwater Tank No. 1 at the Water Treatment Plant. A Notice to Proceed has been issued and mobilization activities will begin this week. Espola Road Bike Lanes Staff has reviewed all proposals and selected NV5 to complete design services for this project. This project will widen the west side of Espola Road between Poway Grade and Range Park Road to accommodate designated bike lanes. Staff is preparing an award report for City Council. LAND DEVELOPMENT Kassen Residence Trail Easement City staff issued comments on the first review of the proposed trail easement at the northeast corner of the lot for the proposed Kassen residence on Skyridge Road. Mansur Parking Lot Staff provided minor comments to the applicant for the second review of the project that proposes to extend the existing parking lot at the California Keg & Liquor store on the corner of Garden Road and Claire Drive. The parking lot extension will be used to store U-Haul rental vehicles. Residential Care Facility The applicant has submitted the grading plan package for first review of the proposed care facility on Aubrey Street. Lara Residence The applicant has submitted a grading plan package for first review of a single-family residence proposed on Golden Way. Aria Estates Director’s Notes January 16, 2019 Page 5 City staff has returned comments for first review of the final map, improvement plans and grading plans for the 7-lot subdivision proposed along Pomerado Road. The subdivision would take access off Danes Road. Tao Residence City staff received the third submittal and returned corrections for the floodplain development permit consisting of a proposed storage room addition within the floodplain on Kennebunk Street. Mabie Pickle Ball Court City staff has approved a floodplain development permit application for the addition of a pickle ball court to an existing residence located on Sagewood Drive within the floodplain and floodway. Groe Residence The applicant has submitted an application for second review of a proposed detached accessory dwelling unit and remodel of existing residence in the floodplain along Camino Del Valle. Chick-Fil-A The applicant has submitted plans for the fourth review of the grading plans and stormwater reports associated with the Chick-Fil-A restaurant proposed on Poway Road. Demolition of the existing building has occurred this week. Villa de Vida Housing The applicant has submitted the grading plan package; water improvement plans and easement documents for first review of the 54-unit special needs housing development proposed on Oak Knoll Road. Parkway Summit The second submittal of the grading plans have been submitted to the City for the proposed buildings at the eastern end of Kirkham Way within the South Poway Business Park. The grading plan resubmittal included revised geotechnical, retaining wall, stormwater and drainage reports. Malowney Residence Grading A construction change revising the proposed drainage and driveway materials was submitted to the City for the grading plan of the proposed single-family residence on Markar Road. STORMWATER Regional Management Committee The San Diego Regional Stormwater Co-permittees met at the end of the year to vote on the budget items. A member from each of the 21 co-permittees was in attendance. The committee voted to approve a request to carry over funds from the Fiscal Year 2017-18 budget to the current budget. A small amount will not carry over and will be credited to the co-permittees on their bill for this fiscal year. The credit amount will be based upon Director’s Notes January 16, 2019 Page 6 population and land area, which is the method used to determine cost sharing. The committee also voted on the proposed Fiscal Year 2018-19 budget. The total budget is $824,410 of which Poway’s share is $20,727. Each vote passed unanimously. Memorandum of Understanding City staff has received and is currently reviewing the second draft Memorandum of Understanding (MOU) for the Implementation of the County-Wide Storm Water Management Plan since the current MOU is set to end in August 2019. The MOU outlines the responsibilities of the Co-permittees and establishes a Regional Storm Water Management Committee, comprised of one representative from each of the Co-permittees. The committee provides regional coordination for urban runoff management activities; and prepares, approves and distributes an annual budget of estimated shared costs and expenses for Regional General Programs. Water Quality Improvement Plan (WQIP) Annual Reports City staff is proceeding with final preparations to the Annual Reports for both the San Dieguito River and the Los Penasquitos Watersheds. The Statements of Certification have been executed. Annual Reports for both watersheds will be finalized later this month. These annual reports cover two different reporting periods: July 1, 2017 through June 30, 2018 for the Jurisdictional Runoff Management Plans and WQIP strategy implementation; and October 1, 2017 through September 30, 2018 for monitoring and assessment programs. Over-Irrigation Audit The San Diego Water Board completed a program audit of San Diego County Co-permittees to assess each jurisdiction’s program effectiveness to prohibit over-irrigation. The San Diego Water Board has identified non-storm water discharges resulting from over-irrigation as a source of pollutants to receiving waters. The audit evaluated the City’s Jurisdictional Runoff Management Plan (JRMP), ordinances, public outreach and education program (available on its website), implementation of its Illicit Discharge Detection and Elimination (IDDE) and enforcement program, and jurisdictional strategies for active and effective implementation of provisions set forth in the Municipal Storm Water Permit. The audit found areas where the City’s program meets the provision requirements and some areas where the City potentially does not meet the provisions and requires responses in the Annual Report. City staff is currently reviewing the audit and working to provide revisions to the City website and overall program in order to comply with requirements. Revisions will be discussed in the Jurisdictional Runoff Management Plan (JRMP) Annual Reports. Education/Outreach Stormwater calendars were produced as part of the public outreach and education program comprised of all co-permittees. Each city is allocated calendars to be publicly distributed. Poway has made the calendars available at the kiosk in the City Hall, the counter of Development Services and the tables in the foyer of the Council Chambers. INSPECTION Director’s Notes January 16, 2019 Page 7 Poway Tech Center West Flint Place, Dearborn Place, Paine Place (G17-0003) - Bio-basin construction continues with the basins in different stages throughout the site. Excavation, liner placement, filter media installation, and planting are all ongoing. Driveway approach, concrete paving, curb and sidewalk installation is all ongoing and in different stages throughout the site. Storm drain work continues with the installation of onsite A-4 clean out box structures and the associated 18” HDPE pipe. The contractor requested and has obtained conditional occupancy for Building #1. Filhart Residence Water Improvements (WI18-001) - The contractor has completed the installation of the 10” water line. Compaction tests for trench backfill, high pressure test, high chlorination test and the low chlorination tests have all passed. The inspector took two bacteriological samples which were delivered to the laboratory for testing. Once passing results have been obtained the contractor will schedule the tie-in. Outpost Poway Road (G18-0002), (STI18-001) - With drilling, soldier beam placement, and the dewatering wells complete, the contractor has begun excavating the site perimeter to a depth of approx. 8’ to 10’. Ground water has been encountered at approx. 10’. Once at a depth of 8’ to 10’, the contractor will begin to install the soil nails also referred to as tiebacks. De-watering will begin only after the de-watering system has been reviewed and approved by City staff. Last week the contractor began potholing to locate all existing utilities fronting the project along Poway Road and exporting excavated material. SDG&E Substation Twin Peaks Road (G15-0010) - Last week the City’s landscape inspector held a landscape preconstruction meeting. In the coming weeks the contractor is scheduled to resume planting and punch list items. Franco Residence Highlands Ranch Road (G10-0008) - During the required pre-rain inspections the inspector tried to contact the site representative to correct onsite BMPs but learned that the project had changed ownership yet again. The project was stopped, the new owners were required to attend a preconstruction meeting, sign applicable paperwork and post securities prior to resuming work. The new preconstruction meeting has been held and the new project name and owner is Highland Ranch LLC. Mehdi Residence Spyglass Terrace (G14-0018) - The owner has begun work outside on the landscape and grading portion. The bio-basin has been excavated, the liner placed, and filter media installed. The contractor began work on the private driveway but stopped to prepare for upcoming rains. The owner has decided to hold off on the construction of the driveway until after the rains have stopped. Sidewalks, and landscape paver installation is ongoing and has become the focus. Crossland Residence Director’s Notes January 16, 2019 Page 8 Old Stone Road (G14-0016) - The owner has completed the footing placement for the basement, which must be done to complete the grading. The footing has been placed and the block wall built. Grout placement for the building wall is scheduled to take place this week weather permitting. Tooth Rock SFR Lot-1 (MDRA16-023), Lot-2 (MDRA16-024) - Bio-basin construction and landscape work continues. BMP maintenance and preparation for upcoming rains have been the focus in recent weeks. Burgess Residence Coyotero Drive (G10-0001) - The contractor has completed the steel and footing placement. Block placement was completed last week. Vertical steel was inspected, and the wall grouted. The owner has opted to wait the 28 days prior to backfilling to allow the wall to reach maximum strength. Malowney Residence Markar Road(G18-0004) - The contractor has completed cut, fill and compaction of the pad portion of grading. The brow ditch has been excavated and was scheduled to be placed last week but was not due to rain. Once complete the owner will then place an all-weather surface which will act as temporary fire access while constructing the home. Once complete the owner will then install the permanent driveway consisting of pervious paver stones. The buyer anticipates submitting plans to the City in the Spring/Summer of 2019. • Staff met with two potential new restaurant operators looking to locate in the former Bruski Burgers and Brew site. o Meetings with Existing Business • Staff finalized a lease agreement with Capexco to use the City’s vacant lot at 13100 Poway Road (Tarascan Lot) for material and construction equipment storage during construction of The Outpost project. o Each month, staff sends a letter to each new business that has received a Business Certificate. The letter welcomes the business to the City and provides information on City and other government services. In 2018, 110 letters were sent to new businesses. o Staff met on eight occasions with various representatives of Meridian Development to discuss the Poway Town Center Development. Staff and the City Attorney continue to work on the Disposition and Development Agreement for the properties.
