PLEDGE OF ALLEGIANCE Deputy Mayor Mullin led the Pledge of Allegiance. MOMENT OF SILENCE Mayor Vaus led a moment of silence. PRESENTATIONS Mayor Vaus spoke regarding the retirement of Sheriff's Department Lieutenant, Michael Knobbe. Sheriff's Department Captain Dave Schaller provided a brief background of Lieutenant Knobbe's time with the Department, he added that he will be missed and wished him well. 1009 City of Poway — Minutes — February 1, 2022 PUBLIC COMMENT Yuri Bohlen asked regarding an opening date of the Amazon Fresh Store. Janet Lettang, via teleconference, spoke regarding `America the Beautiful", a free upcoming concert performed by the US Army Field Band and Soldiers Chorus to take place at the Poway Center for the Performing Arts. Sarah Sleipness, via teleconference, spoke regarding concerns of jaywalking on Community Rd near the Walmart Supercenter. Sheriff's Department Captain Dave Schaller provided a brief update on the pedestrian accident which recently occurred on Community Road. Captain Schaller indicated it would be one to two months before all reports related to the accident are completed. Mayor Vaus reordered the agenda to hear COUNCIL COMMITTEE REPORTS and ANNOUNCEMENTS at this juncture. CONSENT CALENDAR Motioned by Mayor Vaus seconded by Councilmember Frank to approve Consent Calendar Items 1 through 3. Approval of Reading by Title Only and Waiver of Reading in Full of Ordinances on this Agenda 2. Adoption of Resolution No. 22-006 entitled "A Resolution of the City Council of the City of Poway, California, Finding and Declaring the Continued Existence of an Emergency within the City due to the Novel Coronavirus (COVID-19) Global Pandemic" 3. City's Investment Report as of December 31, 2021 (Mayor Vaus reordered the agenda to hear the following Item after Item #6) ORDINANCES FOR INTRODUCTION: 4. Electing to Become Subject to the California Uniform Public Construction Cost Accounting Procedures of the Public Contract Code and Amending Poway Municipal Code, Title 3 (Revenue and Finance), Chapter 3.28 to Provide Informal Bidding Procedures for Public Projects Pursuant to the California Uniform Public Construction Cost Accounting Act Assistant Director, Maintenance & Operations for Public Works Will Wiley presented the item along with a PowerPoint presentation. He stated that the item before Council this evening is for the consideration of a resolution to elect to become subject to the procedures set forth in the California Uniform Public Construction Cost Accounting Act (CUPCCAA) and to consider amending Chapter 3.28 of the Poway Municipal Code establishing informal bidding 1010 City of Poway — Minutes — February 1, 2022 procedures. He stated the amendments would allow public projects of $60,000 or less to be awarded by contract without formal bid procedures or Council approval. He added that for public projects greater than $60,000 but less or equal to $200,000, it would allow for informal bidding procedures of at least three quotes, with the award of contracts by Council. Additionally, for all public projects more than $200,000, formal competitive bidding will still be required, and the contract must be awarded by the Council to the lowest responsible bidder. The amendments would increase the limit for Public Works projects from $5,000 to the thresholds outlined by CUPCCAA and extends the informal bit limits for supplies, services, and equipment to $60,000, amends the cooperative purchasing provisions to allow for purchases from agencies outside the state and directly off contracts made by agencies not belonging to cooperative purchasing programs. It also increases the City Manager's signing authority from less than $50,000 to less than $60,000 with any contract in the amount of $60,000 or more requiring City Council approval. CUPCCAA will allow staff to quickly and efficiently administer small routine public works projects leading to more cost-effective use of public funds. No speakers. Motioned by Mayor Vaus, seconded by Deputy Mayor Mullin to adopt Resolution No. 22-007 entitled "A Resolution of the City Council of the City of Poway, California, Electing to Become Subject to the California Uniform Public Construction Cost Accounting Procedures of the Public Contract Code." Motion carried 5/0. Motioned by Mayor Vaus, seconded by Deputy Mayor Mullin to adopt Ordinance No. 853 entitled "An Ordinance of the City Council of the City of Poway, California, Amending Sections 3.28.060, 3.28.070, 3.28.110, 3.28.120 And Adding 3.28.150 to Chapter 3.28 (Purchasing) of the Poway Municipal Code." Post 2020 Census Redistricting Process — Fourth Public Hearing Mayor Vaus opened the Public Hearing at 7:15 p.m. City Attorney Alan Fenstermacher stated that he would be presenting on items five and six together. He noted that item five is the fourth scheduled public hearing and the second public hearing specific to the draft map. He reminded Council of federal and state requirements for the map noting that the current map remains in compliance with all legal requirements. He 1011 City of Poway — Minutes — February 1, 2022 reviewed the minimal census changes from 2010 to 2020 as they pertain to the current City Council district boundaries and stated that the deviations are within federally accepted standards. He concluded that staff is recommending that Council retain the existing district map, adopted in 2017, which remains in full compliance with all laws. Public Comment: Yuri Bohlen spoke in support of retaining the current district map. End of Public Comment. Mayor Vaus closed the Public Hearing at 7:20 p.m. By consensus, Council directed staff to continue with the process and proceed with the recommendation as presented. 6. Introduction of Ordinance Adopting the Post 2020 Census Redistricting City Council District Map Mayor Vaus opened the Public Hearing at 7:20 p.m. City Attorney Alan Fenstermacher previously presented the report along with item five. He noted that item six is the introduction and first reading of an ordinance to adopt the existing district map as the Poway map for the next 10 years. He added that if adopted tonight, the ordinance second reading will be scheduled for February 15. Public Comment: Yuri Bohlen spoke regarding the current re -districting process specifically in regards to what he believes to be excessive submissions of draft maps by Poway residents; he recommended allowing only one draft map per private citizen in future redistricting processes. Mayor Vaus closed the Public Hearing at 7:23 p.m. Council discussion ensued. Motioned by Deputy Mayor Mullin, seconded by Councilmember Leonard to adopt Ordinance No. 852 entitled "An Ordinance of the City Council of the City of Poway, California, Adopting Boundaries for City Council Districts Pursuant to the Fair Maps Act (Government Code 21601 Et Seq.)." Tentative Tract Map 22-001 — Del Norte Professional Office Buildings Condo Conversion; a request to convert two existing commercial office buildings into office condominiums Mayor Vaus opened the Public Hearing at 7:24 p.m. Senior Planner Austin Silva presented the report along with a PowerPoint presentation. He noted this item is at the request of Strong Entitlement, permitting for a tentative tract map for an office condominium conversion. He gave the project location, site size, and noted its surroundings. He stated that the site is developed with two office buildings totaling over 23,000 square feet, housing 19 suites combined between the two buildings which currently lease as commercial and medical uses. The easterly building was approved and constructed prior to the City's incorporation and in October of 2004, the City Council approved a development request to construct the smaller building to the west of the original building. He added this conversion into office condominiums will allow the suites to be individually sold and owned. He added that an owner's association will be established making them responsible for maintenance of common areas such as the parking lot and landscaping. He noted that although no changes are proposed to the building, the approval of a comprehensive sign program is required prior to final map approval and no significant exterior changes are proposed to the site. Driveway improvements may be required if it is found not to meet ADA standards. Public Comment: Terry Strom, owner representative, offered his support to staff and his availability to answer any questions. Mayor Vaus closed the Public Hearing at 7:32 p.m. Council discussion ensued. Motioned by Mayor Vaus, seconded by Councilmember Leonard to adopt Resolution No. 22-008 entitled "A Resolution of the City Council of the City Of Poway, California, Approving Tentative Tract Map 22-001 for the Conversion of Two Existing Commercial Office Buildings Into Commercial Office Condominiums; Assessor Parcel Number 275- 461-12."
