Granite Construction Amended Conditional
Use Permit Application
Tuesday April 4th at 7 pm
(In person and via online)
This update was sent the moment we
heard about the City of Poway City
Council meeting to approve or denythe request to amend the existing
sandmining Conditional Use Permit.
04/04/23: This project is to install a
generation transmission (gen-tie) line
for the proposed Nighthawk EnergyStorage Project within the City of
San Diego. The gen-tie line spans the
City of San Diego, the City of Poway,
and a small segment on the Miramar
Marine Corps Air Station. Thecomponents within the City of San
Diego jurisdiction begin South of
Beeler Canyon Road and will providethe connection to the San Diego Gas
and Electric Company (SDG&E)
Sycamore Canyon Substation(approximately 0.6 miles of gen-tie
facilities). In my first meeting with the
developers, they agreed tounderground the transmission line
rather than overhead as initially
proposed.
The City of Poway is reviewing theapproximately 300-megawatt battery
energy storage system (BESS)
located on an 82.93-acre site on APN320-031-0300. The proposed BESS
Project is located southeast of the
intersection of Paine St. & KirkhamWay, Poway, CA.
The proposed generationtransmission line will be utilized to
transfer energy to and from the
SDG&E Sycamore Canyon
Substation and the Nighthawk Battery
The Scripps Ranch Planning Group in
March unanimously recommended
approval of the City of San DiegoConditional Use Permit including the
inclusion of Nighthawk cleaning and
maintaining the establishedemergency access routes and
Stonebridge Estates Homeowners
Association approval of the necessaryeasements.

Nighthawk developers issued aconfirmation letter to the City of San
Diego Fire Department Fire Marshall
regarding cleaning and maintainingthe emergency access routes. Here is

Energy Storage project. The project
will include telecommunicationfacilities in the form of underground
fiber optic lines and a 138 kV gen-
tie. Construction of the gen-tie line willtake roughly 3 months to complete.
All areas will be restored to the pre-
construction condition following
construction.
The Stonebridge Estates
Homeowners Association hasrecieved a request to grant an
easement to underground the
proposed transmission line. Thehomeowners association attorneys
are evaluating the offer.
On March 29th there was a Scripps
Ranch community digital meeting withthe Nighthawk developers to provide
an update as to the project.
Scheduled for an hour the meetinglasted for two hours. Questions were
submitted in writing and in person at

The City of Poway is processing anamendment to an existing Conditional
Use Permit and a separate project
Conditional Use Permit. Tonight is ahearing on the Granite Construction
sandmining Amended Conditional

There should be a seperate City of
Poway City Council hearing on theNighthawk Conditional Use Permit.

I wish to express my concerns about Agenda Item #8 for tonight’s
meeting in three points.
1. I wish to know what the plan is for providing trail access to Twin Peaks
Mountain from Larchmont Street as was promised by the Council. I do not
see any trail plans from the plans and have asked Austin Silva the same
question and have gotten no response. I own property next to thedevelopment, which includes trails. I want to make sure that wildlife and
existing trails are protected properly.
2. When my development, Chimney Rock, was planned, it was requiredthat the colors of the homes blend in with the natural environment. I don’t
see how the white colors of Lyon Estates keep in line with that. I think that
natural tones would blend in better with Twin Peaks, especially since some
of the homes will be in line with the mountain peak views.
3. The noise from Lyon estates has been excessive. Right now, as I write,
they are again pounding rocks with large machinery and it is very, very
loud. I ask is that the developer be a good neighbor, as they have askedme to be, and let us know when excessively noisy work is planned to be
performed. No member of our household can work from home when such
work is being done (and Andrew has court hearings via zoom from home).
I had asked Austin about this in October (after a June request forinformation), and he told me that they should not be doing noisy work, as
it wasn’t even grading approval yet. I invite anyone into my backyard to
hear the noise.
I regretfully cannot attend tonight’s meeting, due to conflict with a
planning meeting for the Poway Community Safety Fair for Kiwanis Club of
Poway. But please know that I am concerned about these issues and hope
to get answers.

I am writing today to oppose item 7, on Poway Council City meeting a request to
modify CUP granite construction. date April 4, 2023. On Poway City agenda
I don’t believe you should be rewarded for bad behavior that Calmat cement company and now Granite did for over the last 40 year. Which the Matz family
still owns the land and want to make a large profit by selling it to Nighthawk.
Calmat Mr. Matz proposed a cement plant in Poway Creek Road and Beelercanyon road area was County then. Creek Rd homeowners took it to court. Court
said it was a County road and those days you could put anything anywhere.That’s why we became a City to control our own destiny. We lived here first in
case you want to say we knew they were here. San Diego County gave them apermit for 14 years, they were to clean it up and leave the canyon many years ago.
Which they did not.
Calmat never adhere to the permit the County gave them. Creek Road neighborscomplaining calling San Diego County to no avail, Calmat ran cement trucks all
hours of the day by our homes, crushed rock at night search spotlight lighting thecanyon at night broken our windshields with rocks driving by our homes and
many many more to numerous to mention we live through hell.
They did not obeyed any of the permit or any of permit conditions. Even theowner of Calmat at that time came to my house to apologize Mr. Rudy Matz said
he did not have the money to do what the county permit ask him to do having hisbusiness there In my world if you don’t have money to run a business, then you

don’t run the business and destroy a neighborhood, but he continue to do it.
Fast forward 1980 Poway became a City took over their permit with the promisethey be leaving soon and would clean up the habitat land in the Canyon they
destroyed. And to follow the permit to the laws.Then Poway build Business Park, Calmat wanted to put an asphalt plant down in
canyon and run it through Business Park, Poway said no after a long battle withthe residence. They allow them to stay there with Calmat to be leaving soon and
cleaning up they were supposed to be leaving according to their permit. Andputting the land back together, the stream and habitat.
Sorry if I’m boring you Im explaining this because the majority of the council
members were not here when this happened 40 years ago when all that transpiredover time. But many of the residents of Poway were here and are still here. I
believe the city Council is elected to represent all the residents of the City ofPoway. So sorry Mary Shepardson died. She could’ve did the story much better.
So no, I don’t support the Matz family Calmat and Granite, construction putting
the industrial pad in a slightly different place, which will require manufactureslopes, and to be allowed to build the industrial pad before they are finished with
the mining and have restored the land. The reason they want to do this is becauseone of the partners Matz in the mining project wants to put a battery storage farm
on the pads.
It would be a novelty, for Poway City to make people do what they’re supposed todo adhering to the federal and state laws and just the conditions of the city of
Poway.
In general, battery storage is an important strategy in converting to cleaner energyuse. The batteries can store the energy from rooftop solar so it’s available when
the sunsets. One problem, is that these battery farms have fires that are difficult toput out and create toxic clouds that require people to remain indoors for days.
Plus the area is in a hi-fire area that could be problematic if the fire spreads. Andit’s hard for firefighters to put out. They are extremely dangerous for firefighters
to fight as we have records of what happened to firefighters and how hard it is toput the fires out.
This location is not the best location for this plant in a thriving business Park, and
close to homes in a high risk Beeler canyon which has had many of the large firesin Poway over the years and burnt many homes. The project is a PG&E not a
SDG&E although I don’t know why PG&E is setting their project in San Diegocounty probably money.
At a previous council workshop, all the council members gave negative feedback
for the project. The owner has supposedly gotten permits to underground theutilities.
Which Poway wanted I went to meeting with the developers Nighthawk in
Scripps last summer they were talking they didn’t know who I was and they said that F -ing Poway is making us underground the lines. Who does that F -ing
Poway think they are ? I would call that not good business practice. I know theoriginal council would not want a business in Poway that talked about us like that
.
The permits for the battery storage farm will not be decided on Tuesday, but theCUP changes are leading up to the project being approved by counsel of a later
date.This is the reason the council is doing this because the minute they give the OK to
change what they need to do for a pad in the business park Tesla nighthawk,energy storage, Project. Is moving forward as we speck.
Sorry, I cannot make the meeting tonight but wanted to give my concerns
