A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, ACCEPTING REAL PROPERTY AT THE
NORTHERN TERMINUS OF HOLLY OAK WAY LYING WITHIN
CITY OF POWAY TRACT MAP 99-01 R, MAP NO. 14360
WHEREAS, the City of Poway Tract Map 14360, recorded on April 2, 2002, as Map No.
14360 in the Office of the County Recorder, offered for dedication for street purposes a certain
portion at the terminus of Holly Oak Way;
WHEREAS, on said Map No. 14360, the City of Poway rejected the offer of dedication of
said portion as hereinafter more particularly described;
WHEREAS, the State of California Government Code (Subdivision Map Act) Section
66477.2(a) provides that a rejected offer of dedication shall remain open and may be accepted
by resolution at any later date; and
WHEREAS, because of the approval and recordation of the final map of City of Poway
Tract Map 21-003, it is in the best public interest of the City of Poway that said portion now be
accepted for public use for street purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
SECTION 1: The City of Poway hereby rescinds the rejection of said portion, and does
hereby accept for public use for street purposes the following:
a. That portion of Lot 9 designated as "portion of Lot 9 reserved for future street" on City
of Poway Tract Map 99-01 R, recorded April 02, 2002 as Map No. 14360 in the office
of the County Recorder of San Diego County, California.
SECTION 2: The City of Poway is hereby authorized and directed to certify the passage
of this resolution and to cause its recordation in the office of the Recorder of San Diego County.

PASSED, ADOPTED AND APPROVED at a Regular Meeting of the City Council of the
City of Poway, California on the 16th day of May, 2023 by the following vote, to wit:
