Pursuant to Poway Municipal Code Section 17.08.180(A)(14) and in consideration of the approval of Building Permit B23-1165, a request to construct an Accessory Dwelling Unit ("ADU" hereinafter) at the above -referenced property, by the City of Poway ("CITY" hereinafter), OWNER hereby agrees that if either the main residence or the ADU is rented, the rental term shall be longer than 30 days. OWNER hereby agrees that the garage conversion to an ADU cannot be converted to a main residence addition without garage replacement. Upon granting of the certificate of occupancy in accordance with Building Permit B23-1165, there will be a maximum of two permitted housing units on the PROPERTY. OWNER hereby agrees that the additional bedrooms created by the conversion of the garage to an ADU will not result in an increase in the number of residents being cared for at the PROPERTY beyond the six already authorized for the PROPERTY by the state under the provisions of a Residential Care Facility for the Elderly. This Covenant shall run with the land, inure to the benefit of and be binding upon OWNER, future owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the respective parties, and is hereby expressly declared to be enforceable by the City of Poway. In the event that a Building Permit is never obtained to construct the proposed ADU at the request of the OWNER, the CITY shall expunge this Covenant from the record title of the PROPERTY.
