A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
POWAY, CALIFORNIA, ORDERING THE SUMMARY VACATION
OF A PORTION OF EASEMENT RESERVATION ON LOTS 1, 5
AND A OF THE CITY OF POWAY TTM21-004, PARCEL MAP
16577 (VACATION NO. 23-0006)
WHEREAS, the City Council of the City of Poway desires to summarily vacate a portion
of an easement reservation in accordance with the procedures provided in Chapter 4, Part 3,
Division 9 of the Streets and Highways Codes of the State of California, commencing at Section
8300;
WHEREAS, said portions of the easement reservation was created and dedicated to the
County of San Diego through the recordation of a grant of easement for County Highway Road,
recorded January 5, 1938, in Book 728, Page 382;
WHEREAS, said public highway easement was vacated and abandoned reserving and
excepting from vacation and abandonment easements and rights at any time and from time to
time to construct, maintain, operate, replace, remove and renew sanitary sewers, storm drains
and appurtenant structures including access to protect the property from all hazards in, upon,
over and across the above -described portions of highways proposed to be vacated and
abandoned. Said vacation was declared through resolution and recorded on October 29, 1971,
in the County of San Diego; and
WHEREAS, the area to be vacated does not have any public utilities and is not needed
for public utility purposes.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
SECTION 1: This summary vacation is made under the provisions of Chapter 4, Part 3,
Division 9 of the Streets and Highways Code of the State of California.
SECTION 2: The City Council hereby finds that the portion of the herein below described
easement reservation is unnecessary for present public use. (Section 8333(c)).
SECTION 3: The City Council hereby declares that the portion of the easement reservation
as described in Exhibit A and depicted in Exhibit B, is hereby vacated.
SECTION 4: The City Clerk of the City of Poway is hereby directed to cause this Resolution
to be recorded in the Office of the San Diego County Recorder in accordance with the provisions
of Section 8336 of the Street and Highways Code of the State of California.
