Res P-07-20 RESOLUTION NO. P-07-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING TEMPORARY USE PERMIT (TUP) 07-21 TO HOLD THE COMMUNITY BAND FESTIVAL 2007 WHEREAS, Temporary Use Permit 07-21, City of Poway Community Services Department, Applicant, requests approval to hold the Community Band Festival 2007 at Old Poway Park, located at 14134 Midland Road, on Saturday, May 5, 2007, from approximately 12:00 p.m. to 8:00 p.m., and on Sunday, May 6,2007, from 12:00 p.m. to 7:30 p.m.; and WHEREAS, on May 1, 2007, the City Council considered the above-referenced item. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway, as follows: Section 1: The City Council finds that Temporary Use Permit 07-21 is Categorically Exempt (Class 4) from the California Environmental Quality Act (CEQA), pursuant to Section 15304(e) of the CEQA Guidelines, as the event is temporary in nature and will have no permanent effects on the environment. Section 2: The proposed use is in accordance with the purposes and standards of Section 17.26.030.A of the Poway Municipal Code. Section 3: The City Council hereby approves Temporary Use Permit 07-21, the Community Band Festival 2007 at Old Poway Park, 14134 Midland Road, on Saturday, May 5,2007, from approximately 12:00 p.m. to 8:00 p.m., and on Sunday, May 6, 2007, from 12:00 p.m. to 7:30 p.m., subject to the following conditions: A. The event and related off-site parking shall be conducted as shown on the site plan and application on file in the Development Services Department. B. This permit is valid during the hours of approximately 12:00 p.m. to 8:00 p.m. on Saturday, May 5, 2007, and from 12:00 p.m. to 7:30 p.m. on Sunday, May 6, 2007, after which time the site shall be restored to its original condition. C. Approval of this activity shall not excuse compliance with all other sections of the Zoning Ordinance and all other applicable State, County, and City Ordinances presently in effect. D. The site shall be developed in accordance with the approved site plan on file in the Development Services Department, Planning Division, except as otherwise provided herein. Resolution No. P-07-20 Page 2 E. Prior to the event, the applicant shall comply with the following: 1. The following City of Poway departments shall be contacted for appropriate permits, coordination, and inspections: Public Works, Customer Services, Development Services (including the Building, Traffic Engineering, and Planning Divisions), Safety Services, and the Sheriffs Department. 2. Obtain a permit from the Fire Department for any tent that exceeds 200 square feet or any canopy that exceeds 400 square feet. 3. All proposed signs shall be approved by the Development Services Department, Planning Division, and shall be in accordance with Chapter 17.40 of the Poway Municipal Code. F. During the event, the applicant shall comply with following: 1. Do not block emergency vehicle access to any street, building, fire hydrant, or fire sprinkler connection. 2. Provide at least one fire extinguisher with a minimum rating of 2-A:1 O-B.C. at any booth where food is cooked or warmed. 3. All compressed gas cylinders must be secured from falling over. G. At the conclusion of the event, the applicant shall comply with the following: 1. Public streets, off-street parking sites, and areas within and adjoining the proposed area for the event shall be cleared of debris, litter, temporary signs, and all other evidence of the event. Section 4: This approval shall become null and void on Sunday, May 6, 2007, at 7:30 p.m., at which time the utilized site shall be restored to its original condition.
