The January 10, 1995, regular meeting of the City Council of the City of
Poway, was called to order at 7:05 p.m., by Mayor Higginson at the City Council
Chambers, 13325 Civic Center Drive, Poway, California.

proceeds for the Parkway Business Centre. City Manager Bowersox stated
staff will respond to his questions in writing.

APPLICANT: POWAY CHURCH OF JESUS CHRIST L.D.S.
Mayor Higginson .opened the public hearing. Staff report by City Manager
Bowersox. This is a request to construct a 905 square foot auxiliary room on the
existing 18,340 square foot church building and a 600 square foot detached
storage building at 15705 Pomerado Road. Staff recommends approval.
There was no one present wishing to speak.
Motion by Councilmember Emery, seconded by Councilmember Callery to close the
public hearing and adopt Planning Resolution No. P-95-05, entitled "A Resolution
of the City Council of the City of Poway, California Approving County Use Permit
P65-77M(2) and Minor Development Review 94-52, Assessor's Parcel Number 275-461-
03." Motion carried unanimously.

EIR SCOPING HEARING
BILL SILVA PRESENTS ENTERTAINMENT CENTER
Mayor Higginson opened the public hearing. Item introduced by City Manager
Bowersox. Staff report by Director of Planning Services Wright-Quastler. Bill
Silva Presents is preparing to file a development application for an outdoor
performing arts center that can seat an audience of approximately 20,000 persons.
The project site is located in the South Poway Planned Community and within the
Paguay Redevelopment Project Area. The SPPC development plan does not
specifically address an open air amphitheater-type land use. Environmental

review, SPPC amendments and related permit approvals are prerequisites to the
implementation of the project. This hearing is to notify the public of the
City's intent to prepare an Environmental Impact Report for the Project and to
obtain public input on the scope and content of the EIR. Staff has identified
sixteen areas of potential environmental impact should the project or any
identified alternatives to the project be approved.
Mayor Higginson requested the public speakers be specific about the environmental
issues. Input in favor of or opposed to the project is not appropriate at this
hearing.
Greg Lichtenstein, 12265 Rue Cheumont, San Diego (Scripps Ranch), asked that
traffic impacts on his community and air pollution from the resultant traffic be
analyzed.
Marianne Reynolds, 13692 Quiet Hills Drive, asked about quality of life impacts,
impact on property values, and noise from fireworks. She requested that the
noise tests be done in May or June during typical concert times (8-12 p.m.) with
residents being notified of the date and time of the test.
Kathi Muela, 13333 Racquet Court, asked that quality of life impacts, traffic
analysis of eventual impacts up to ten years in the future, impact of lights on
the night sky, and impact on ridgelines be analyzed. She requested that the
noise test be done at a level that could be expected from a heavy metal concert.
Kathleen Brandon, 14441 High Pine, presented a letter outlining her concerns.
Gail Trunnell, 13314 Neddick Avenue, spoke about potential problems with off-road
vehicles and the impact on the ridgelines. She also requested that the noise
study be done for a one week period.
Charles McLauchlan, P.O. Box 12, requested that all properties in the Beeler
Canyon corridor be in the included in the EIR and that the appropriate land uses
for the entire area be determined.
Brian Groarke, 11710 Pickford Road, San Diego (Miramar Ranch North), spoke about
potential impacts on neighboring communities.
Eve Pearce, 14625 Fairburn, asked about traffic impacts on Scripps Poway Parkway
during commute times, impacts on other City streets, and impacts on law
enforcement throughout the community.
Cheryl Pehl, 12901Margate Avenue, asked about several noise issues, including
the level and duration, noise of a live audience, and noise from special effects.
Randy Wilkins, 14617 Acton Court, stated the sound study should be computer
modeled out to 2-1\2 miles. He also requested a committee of residents and staff
to write the conditions for a Conditional Use Permit and to enforce them.

Denise Hunter, 14534 Glenville, asked about impacts on medical emergency services
since there could be delayed response times for residents if personnel and
equipment were involved with an incident occurring as a result of the
amphitheater.
Bill Rickles, 13725 Utopia Road, representing the Southwest Poway Homeowners
Association, presented written concerns.
Ernest Piper, 14410 Crestwood Avenue, spoke about potential impacts on law
enforcement.

alcohol use at concerts and impacts on our local law
Bea Reuel, 13710 Paseo Bonita, asked the City Council to consider the quality of
life issues and suggested the stage might be turned to face the opposite
direction to reduce noise impacts.
Peggy Collette, 13969 Bernadotte Lane, asked that impacts of noise, crime,
traffic, air pollution, be considered as well as the impacts on horse riders in
the area.
George Wong, 17232 Metate Lane, spoke about impacts on Poway's quality of
life.
Richard Ludwig, 12720 Metate Lane, asked about increased traffic on Scripps
Parkway and the impacts on the concerts from Miramar Air Station jet noise.
Connie Spitzer, 16028 Paragon Mesa Road, stated they did hear the noise test at
their home and this will be something any future home seller will have to
disclose.
Richard Haas, 15454 Pendragon Road, spoke about impacts from noise, traffic,
crime, and light pollution.
Lisa Lucidi, 13260 Glen Circle, spoke about possible positive impacts, such as
economic impacts on Poway businesses.
John Voris, 14520 Garden Road, spoke about financial impacts on residents and
property values with and without the project.
Florence Larson, 14580 Kennebunk Street, requested that Bill Silva Presents as
a company be analyzed because a quality company would present quality shows.
Joyce Romero, 13614 Fairgate Drive, stated concerts were successful financially
for the Wild Animal Park and stated there could be economic benefits to Poway.

Steve Redfern, Vice President of Bill Silva Presents, 9914 Bourbon Court, San
Diego, stated they have their own contract for on-site emergency medical
services.
Councilmember Emery asked what the timeline for this project is. Director of
Planning Services Wright-Quastler stated they anticipate having a draft
Environmental Impact Report to the City Council by the end of June, 1995.
Councilmember Rexford reiterated the points the speakers had made, including
noise level tests in different atmospheric conditions with notice to the
residents when they would take place and a number to call at City Hall during the
test. She also asked about using a computer model to show noise levels at
various distances from the site. She requested staff include citizen comments
including traffic, law enforcement impacts, experience of cities where other
amphitheatres are located, and light pollution.
Motion by Councilmember Emery, seconded by Councilmember Callery to close the
public hearing and direct staff to distribute the Notice of Preparation and
complete the EIR process. Motion carried unanimously.

MASHBURN'S RATE SCHEDULE
MULTI-FAMILY DWELLING UNITS
Staff report by City Manager Bowersox. On September 20, 1994, the City Council
awarded the exclusive Solid Waste Franchise to Mashburn Waste and Recycling
Services. On November 29, 1994 the City Council adopted Resolution 94-125 which
set unit prices for various services. Additional refinements have been
negotiated with Mashburn for centrally-billed, multi-family services for various
sizes of collection containers, number of collection days per week, and exclusion
of green waste if a gardener service is employed and they remove the green waste.
Staff recommends approval.
Speaking in opposition to staff recommendation:
Siegfried Mikuteit, 13685 Cynthia Lane, owner of Valley View Terrace
Apartments, stated his rates have increased 250%. Director of Public
Services Williams stated he will put him in touch with Mashburn who will
work with any property owner to determine the most economical way to
collect their trash.
Motion by Councilmember Emery, seconded by Councilmember Callery to adopt
Resolution No. 95-002, entitled, "A Resolution of the City Council of the City
of Poway, California Approving Mashburn Waste and Recycling Services' Rate
Schedule for Multi-Family Dwelling Units," which supplements the rate schedule
approved on November 29, 1994. Motion carried unanimously.

SHERIFF STATION POTENTIAL SITES
Staff report by City Manager Bowersox. At the December 13, 1994 meeting, the
City Council requested that a report be prepared indicating potential sites where
a new Sheriff Substation could be located and the advantages and disadvantages
of each site. The Board of Supervisors has authorized the acquisition of a
12,000 square foot facility. The San Diego County Real Property Management
Division indicated that the primary factor they would use in selecting a new site
is the cost. Other factors are 1) preference to be in commercial district; 2)
preference to not be in proximity to residential areas; 3) if in an existing
building, that they be the sole occupant; 4) existing building must comply or be
able to comply with Title 24 of the California Building Code; 5) adequate
parking; 6) located on a major arterial with ability to make left hand turns into
the station. The site needs to be approximately two acres to meet City
development standards. Staff has looked at 18 sites. The Sheriff's Department
has prioritized five sites, as follows: Western Lumber; Huber property;
southeast corner of Poway Road and Bowron Road; south side of Twin Peaks Road
west of the Circle K Market; southwest corner of Twin Peaks Road and Midland
Road. Staff is requesting guidance from the City Council regarding the siting
of the Sheriff's station.
Mayor Higginson suggested the Sheriff's station be placed on the east end of the
Huber site with family housing on the west end. The library could then be put
on the Poway Road frontage of the Western Lumber site with senior housing on the
back of that site. Councilmembers Cafagna, Callery and Rexford agreed they would
be willing to look at that concept. Councilmember Emery stated he did not want
the library on Poway Road.
City Manager Bowersox stated he would bring back a report regarding this concept.
ITEM 8 (1160-01)
1994 TRAFFIC SIGNAL REPORT
Staff report by City Manager Bowersox. In 1993, the Hughes Heiss Study
identified the need for a Traffic Signal Masterplan to be used in evaluating
safety and effectiveness at existing signalized intersections and in prioritizing
locations for future installations. The report has been reviewed by the Traffic
Safety Committee. He noted that 33 traffic signals have been added in the City
since incorporation.
Motion by Councilmember Callery, seconded by Mayor Higginson to adopt the 1994
Traffic Signal Report. Motion carried unanimously.

Mayor Higginson stated this is Melissa Tamberg's last night as a Poway
News-Chieftain reporter covering the City and congratulated her on her
promotion to the San Dieqo Union-Tribune.
Mayor Higginson received Council concurrence to give the 1995 Mayor's
Award at Creekside Plaza to the Poway High School Marching Band, "The
Emerald Brigade."
C. Mayor Higginson requested the workshop regarding the library be
rescheduled to Thursday, February 16, 1995. Council concurred.
CLOSED SESSION
Mayor Higginson called for a closed session at 9:25 p.m. as requested by the City
Attorney.
CALL TO ORDER AND ADJOURNMENT
Mayor Higginson called the meeting back to order with all Councilmembers present
and adjourned the meeting at 10:40 p.m.
